(03/2012) Page 25(c) In the case of an employee called out on overtime to work on a rest day, this clause will applyonly to hours worked outside his/her regular shift times for a normal workday.(d) Where any of the meals provided under (a), (b) or (c) above duplicates a meal to which anemployee is entitled because of travel status or field allowance, then the employee shall receive onlyone (1) benefit for each meal.16.7 No Layoff to Compensate for Overtime<strong>Employees</strong> shall not be required to layoff during regular hours to equalize any overtime worked.16.8 Right to Refuse Overtime(a) The most senior qualified employee shall have first choice for overtime work <strong>and</strong> may refuseovertime on a seniority basis providing there are other qualified employees available to perform thework. In such cases, the overtime shall be assigned to the least senior employee.(b) <strong>Employees</strong> shall not be required to work more than ten (10) hours of overtime per week. In caseswhere an employee has reached the maximum ten (10) hours, overtime shall be assigned to the nextjunior employee. In the rare circumstances where all employees have reached the maximum ten (10)hours of overtime in a week, overtime work shall be again allocated as per (a) above. When an offeredovertime shift will put an employee beyond the ten (10) hour maximum, the employee may accept ordecline the overtime shift in whole.16.9 Overtime for Regular <strong>Employees</strong>(a) A regular employee working less than the normal hours per day of a full-time employee, <strong>and</strong> whois required to work longer than his/her regular workday, shall be paid at the rate of straight-time for thehours so worked, up to <strong>and</strong> including the normal hours in the workday of a full-time employee.(b) A regular employee working less than the normal days per week of a full-time employee, <strong>and</strong>who is required to work other than his/her regularly scheduled workdays, shall be paid at the rate ofstraight-time for the days so worked up to <strong>and</strong> including the normal workdays in the workweek of afull-time employee.(c)Overtime rates shall apply to hours worked in excess of (a) <strong>and</strong> (b) above.16.10 Callout Provisions(a) A regular employee who is called back to work outside his/her regular working hours shall becompensated for a minimum of three (3) hours at overtime rates.(b) A regular employee who is called back to work outside his/her regular working hours shall becompensated from the time he/she leaves his/her home to report for duty until the time he/she arrivesback upon proceeding directly to <strong>and</strong> from work.(c) For the purposes of (1) <strong>and</strong> (2) above it is agreed that "callout" means that an employee has beencalled out without prior notice.16.11 Rest Interval After OvertimeAn employee required to work overtime adjoining his/her regularly scheduled shift shall be entitled toeight (8) clear hours between the end of the overtime worked <strong>and</strong> the start of his/her next regular shift. Ifeight (8) clear hours are not provided, a premium calculated at overtime rates shall apply to hours workedon the next regular shift.
