Such rest periods shall not be taken the first hour<strong>and</strong>/or the last hour of the shift, subject to operational requirements.14.5 St<strong>and</strong>by Provisions(a) Where regular employees are required to st<strong>and</strong> by to be called for duty under conditions whichrestrict their normal off-duty activities, they shall be compensated at straight-time in the proportion ofone (1) hour's pay for each three (3) hours st<strong>and</strong>ing by. An employee designated for st<strong>and</strong>by shall beimmediately available for duty during the period of st<strong>and</strong>by at a known telephone number. No st<strong>and</strong>bypayment shall be made if an employee is unable to be contacted or to report for duty when required.The provisions of this clause do not apply to regular employees who are not assigned a regular workschedule <strong>and</strong> who are normally required to work whenever called.(b) <strong>Employees</strong> required to st<strong>and</strong> by under (a) above will not be required to st<strong>and</strong> by on two (2)consecutive weekends or two (2) consecutive designated paid holidays, except by mutual agreement.This provision will not apply in emergency situations.(c)<strong>Employees</strong> shall be assigned st<strong>and</strong>by on an equitable basis.14.6 Flextime(a) For the purpose of this Agreement, flextime means the hours worked by an employee, or a groupof employees, who are given authority by the General Manager to choose their starting <strong>and</strong> finishingtimes.(b) By mutual agreement between the Employer <strong>and</strong> Union, a compressed workweek may be utilizedwithin the bargaining unit based on the following guidelines:(1) The Employer will determine the individuals, classifications, <strong>and</strong>/or departments who areeligible for a compressed workweek schedule based upon operational requirements;(2) Shift start <strong>and</strong> finish times, numbers of shifts, <strong>and</strong> hours comprising a workday will bedetermined by the Employer affecting only those employees eligible for a compressed workweekschedule;(3) The work schedule for full-time employees will be based on an average of (thirty-seven<strong>and</strong> one-half (37½) hours per workweek;(4) An employee’s scheduled work assignments will not exceed a ten (10) hour shift, exceptthe mobile lab employees whose shift will not exceed a twelve (12) hour shift;(5) An employee shall be entitled to no less than two (2) consecutive days off per workweekin accordance to 14.2(c);(6) <strong>Employees</strong> of a similar classification may exchange shifts with the approval of theEmployer, provided that advance written notice is given by the employees <strong>and</strong> provided there isno increase in cost to the Employer, <strong>and</strong>;(7) A compressed workweek schedule can be amended or cancelled by the Employer bygiving one (1) weeks advanced notice prior to posting of the new schedule.14.7 Scheduling LimitationsUnless otherwise specified in this article, the following shall always apply:(a) <strong>Employees</strong> shall not be required to work split shifts except by mutual agreement between theemployee <strong>and</strong> Employer.
