(03/2012) Page 19(b) An employee designated for layoff may fill a vacancy in any classification provided that theemployee is qualified <strong>and</strong> able to perform in the vacant position or can with a period of familiarizationqualify for the position.(c) <strong>Employees</strong> designated for layoff may bump a less senior employee based on their ability to do thejob within a period of familiarization.(d) <strong>Employees</strong> who fill a vacancy or bump a junior employee at a lower classification will retain theircurrent rate of pay or move to the maximum rate of pay at the lower classification, whichever is less, toa maximum of 15 percent (15%). The bumping employee shall be the first person offered the formerposition should it become available.(e)An employee shall retain but not accumulate seniority while on layoff.13.4 Severance Pay(a) Within thirteen (13) weeks of notice of layoff a regular employee, with written notice to theEmployer, may opt for severance. Severance pay shall be as follows:• for each completed year of continuous employment, two (2) weeks current salary.(b) <strong>Employees</strong> will not receive an amount greater than six (6) months current salary <strong>and</strong> will not beeligible for recall.13.5 Recall(a) Regular employees who are laid off shall be placed on a recall list for a period of twelve (12)months.(b) No new employees shall be hired until employees on the regular recall list are offered recall asspecified in (c).(c) Regular employees on the recall list shall be recalled in order of service seniority provided he/shepossesses the qualifications to perform the job after a period of retraining <strong>and</strong> familiarization.(d) If the recalled employee with the highest service seniority declines, the employee with the nexthighest service seniority shall be recalled.(e) An employee shall remain on the recall list for the period specified in (a) or until he/she declinestwo offers of work.(f) An employee shall notify the Employer of intention to return to work within seven (7) calendardays of being notified of recall by registered mail. Failure to return to work within fourteen (14)calendar days after being notified of recall will be deemed to be resignation. The Employer shall makeevery reasonable effort to use available information from the worksite to reach a laid off employeebefore sending the registered letter, which shall be deemed as proper notice.13.6 Retraining <strong>and</strong> Adjustment Period(a) <strong>Employees</strong> who assume a new position pursuant to this article will receive job training <strong>and</strong> shallbe allowed eight (8) weeks to familiarize himself/herself with his/her new duties.(b) If, after the period of familiarization, the employee is deemed unable to perform the duties of theposition, the following shall apply:(1) the employee may opt for severance pay as provided for in this Agreement;(2) the employee would be on layoff <strong>and</strong> notice is deemed to have been given at the originalnotification-of-layoff time.
