(03/2012) Page 15(3) he/she is on layoff for more than one (1) year; or(4) he/she becomes a casual employee.11.4 Re-employmentA regular employee who resigns his/her position <strong>and</strong> within sixty (60) days is re-employed as a regularemployee shall be granted leave of absence without pay covering those days absent <strong>and</strong> shall retain,effective the date of re-employment, all provisions <strong>and</strong> rights in relation to seniority <strong>and</strong> other fringebenefits, provided he/she has not withdrawn his/her RRSP contributions.11.5 Bridging of <strong>Service</strong>If a regular employee terminates employment as a result of a decision to raise a dependent child ordependent children, <strong>and</strong> is re-employed, upon application he/she shall be credited with the length ofservice accumulated at time of termination for the purposes of benefits based on service seniority. Thefollowing conditions shall apply:(a) the employee must have been a regular employee with at least three (3) years of service seniorityat time of termination;(b)the resignation must indicate the reason for termination;(c) the break in service shall be for no longer than six (6) years; <strong>and</strong> during that time the employeemust not have been engaged in remunerative employment for more than six (6) months exceptingemployment with this Employer as a casual;(d) the previous length of service shall not be reinstated until successful completion of theprobationary period on re-employment.11.6 Calculation of Seniority(a) When compiling a seniority list, the Employer shall calculate the seniority for regular full-time<strong>and</strong> regular part-time employees by calendar year <strong>and</strong> part thereof. Casual employees shall becalculated by hours worked.(b) It is understood that for the purposes of calculating seniority for casual employees, one thous<strong>and</strong>nine hundred <strong>and</strong> fifty (1950) hours will equal one (1) year of service.(c) Casual employees will carry their seniority of one thous<strong>and</strong> nine hundred <strong>and</strong> fifty (1950) hoursequal to one (1) year of service upon transfer to regular status.12.1 NotificationARTICLE 12 - SERVICE CAREER POLICYUnsuccessful internal applicants to posted positions will be notified in writing of the name <strong>and</strong>classification of the successful internal applicant, <strong>and</strong> the reasons they were unsuccessful. In the casewhere an external applicant is successful, the name will be withheld.12.2 Competition Appeal Procedure(a) Where a grievance has been filed, no permanent transfer or placement shall take place until thegrievance has been resolved.(b) (1) An unsuccessful applicant may grieve the decision provided the grievance is filed withinfourteen (14) days of the date of notification given by h<strong>and</strong>.
