(03/2012) Page 14(b) A steward shall have the right to consult with a staff representative of the Union <strong>and</strong> to have alocal union representative present at any discussion with supervisory personnel which the stewardbelieves might be the basis of disciplinary action against the steward, providing that this does not resultin an undue delay of the appropriate action being taken.10.9 Rejection During ProbationThe General Manager may reject any probationary employee for just cause. A rejection during probationshall not be considered a dismissal for the purpose of Article 10.4 The test of just cause for rejection shallbe a test of suitability of the probationary employee for continued employment in the position to whichhe/she has been appointed, provided that the factors involved in suitability could reasonably be expectedto affect work performance.10.10 Ab<strong>and</strong>onment of PositionAn employee who fails to report for duty for three (3) consecutive workdays without informing theEmployer of the reason for his/her absence will be presumed to have ab<strong>and</strong>oned his/her position. Anemployee shall be afforded the opportunity to rebut such presumption <strong>and</strong> demonstrate that there werereasonable grounds for not having informed the Employer.11.1 Seniority DefinedARTICLE 11 - SENIORITYFor the purpose of this Agreement, service seniority shall mean the length of continuous services as aregular employee with the Employer. For those employees who transferred to this Employer from thePublic <strong>Service</strong> of <strong>BC</strong> on January 6, 1989, all previous seniority as a regular employee shall be credited.<strong>Service</strong> seniority for regular employees shall be prorated on the basis of one (1) year's service seniorityfor every nineteen hundred <strong>and</strong> fifty (1950) hours completed.11.2 Seniority ListA current service seniority list for regular employees as of December 31 st will be provided by theEmployer to the President of the Union on or before March 31 st of the following year.11.3 Loss of Seniority(a) A regular employee on a claim recognized by WorkSafe<strong>BC</strong> shall be credited with serviceseniority equivalent to what he/she would have earned had he/she not been absent <strong>and</strong> had been able towork.(b) A regular employee who is on leave of absence without pay in an elected or appointed position ofthe Union shall continue to accrue seniority during the leave period, provided that, upon returning, theemployee shall accept the first available position for which the employee is qualified. The Employershall make every reasonable effort to place the employee in his/her original classification. To facilitatethe administration of this clause when leave without pay is granted, the leave shall be given with basicpay, substitution pay where applicable, <strong>and</strong> the Union shall reimburse the Employer for salary <strong>and</strong>benefit costs, including travel time incurred.(c)An employee shall lose his/her seniority as a regular employee in the event that:(1) he/she is discharged for just cause;(2) subject to Article 11.4, he/she voluntarily terminates his/her employment or ab<strong>and</strong>onshis/her position;
