(03/2012) Page 8• To implement changed operational methods <strong>and</strong> procedures;• To determine the staffing requirements, to determine <strong>and</strong> change the size, composition <strong>and</strong>qualifications of the workforce;• To determine the kind <strong>and</strong> location of facilities, to transfer, relocate or consolidate any <strong>and</strong> all ofthe operation of the business;• To select, hire, promote, <strong>and</strong> transfer employees; to discipline, demote or discharge employeesfor just cause;• And to continue, modify <strong>and</strong>/or discontinue reasonable rules, regulations, <strong>and</strong> policies.The parties recognize that the above statement of management rights is not to be construed as restrictiveor interpret so as to exclude those prerogatives not mentioned which are inherent to the managementfunction, <strong>and</strong> which are not limited by the Collective Agreement.7.1 Union <strong>and</strong> Employer RepresentationARTICLE 7 - EMPLOYER/UNION RELATIONSNo employee or group of employees shall undertake to represent the Union at meetings with theEmployer without the proper authorization of the Union. To implement this the Union shall supply theEmployer with the names of its officers <strong>and</strong> similarly, the Employer shall supply the Union with a list ofits supervisory or other personnel with whom the Union may be required to transact business.7.2 Union Bargaining CommitteeA union bargaining committee shall be appointed <strong>and</strong> consist of two (2) employees. The Union shall havethe right at any time to have the assistance of members of the staff of the Union when negotiating with theEmployer.7.3 Union Representatives(a) The Employer agrees that access to its premises will be granted to members of the staff of theUnion when dealing or negotiating with the Employer, as well as for the purpose of investigating <strong>and</strong>assisting in the settlement of a grievance.(b) Members of union staff shall notify the excluded designated supervisory official in advance oftheir intention <strong>and</strong> their purpose for entering <strong>and</strong> shall not interfere with the operation of the Employer.(c) In order to facilitate the orderly, as well as the confidential investigation of grievances, theEmployer will make available to union representatives or stewards temporary use of an office or similarfacility.(d) The Employer agrees that access to its premises will be granted to local chairpersons <strong>and</strong>members of the Provincial Executive. Notification shall be given to the excluded designatedsupervisory official in advance of the intention <strong>and</strong> purpose for entering the Employer's premises <strong>and</strong>such access shall not interfere with the operations of the Employer.(e) Notwithst<strong>and</strong>ing Article 7.3(d), the Employer agrees that access to its premises will be extendedto persons designated by the President upon reasonable notice to the General Manager, or designate, oftheir intention <strong>and</strong> purpose for entering the Employer's premises <strong>and</strong> such access shall not interfere withthe operations of the Employer.(f)For the purposes of Article 7.3(b), (d), <strong>and</strong> (e) reasonable notice is twenty-four (24) hours.
