(03/2012) Page 4(d) An employee filing a complaint that could be considered frivolous, vindictive, <strong>and</strong>/or vexatious innature may be subject to disciplinary action. Disciplinary action taken may be grieved pursuant toArticle 8 - Grievances.1.7 Harassment Complaint Procedure(a)All harassment complaints shall be dealt with in the strictest confidence.(b) An employee who believes he/she is being harassed or has observed harassment shouldimmediately notify their supervisor (unless he/she is the alleged harasser), union steward, or othercontact person as listed below to discuss potential means of resolving a complaint <strong>and</strong> requestassistance in resolving the matter. "Other contact person" shall include:(1) Local Human Resources representative; or(2) Another member of management.If the matter is resolved to the complainant’s satisfaction, the matter is deemed to be resolved.(c) If the matter is not resolved to the complainant’s satisfaction, the complainant may refer thematter to Step 2 of the grievance procedure.(d) Pending the determination of the complaint, the Employer may take interim measures to separatethe employees concerned, if deemed necessary. However, any such action taken will not be deemeddisciplinary in nature, or seen as presumption of guilt or innocence.(e)The complainant will not be relocated without their agreement.2.1 Bargaining Unit DefinedARTICLE 2 - UNION RECOGNITION AND RIGHTS(a) The bargaining unit shall comprise all employees included in the bargaining unit as defined inthis Agreement except those employees in positions mutually agreed to between the parties asmanagerial <strong>and</strong> (or) confidential exclusions.(b) <strong>Inc</strong>umbents of new positions established by the Employer shall automatically be included in thebargaining unit unless specifically excluded by the agreement or by the Labour Relations Board.2.2 Bargaining Agent RecognitionThe Employer recognizes the B.C. <strong>Government</strong> <strong>and</strong> <strong>Service</strong>s <strong>Employees</strong>' Union as the exclusivebargaining agent for all employees to whom the certification issued by the Labour Relations Board onMarch 8, 1974, as amended on applies.2.3 Correspondence(a) The Employer agrees that all correspondence between the Employer <strong>and</strong> the Union related tomatters covered by this Agreement shall be sent to the President of the Union or his/her designate.(b) The Employer agrees that a copy of any correspondence between the Employer <strong>and</strong> any employeein the bargaining unit covered by this Agreement pertaining to the interpretation or application of anyclause in this Agreement as it applies to that employee, shall be forwarded to the President of the Unionor his/her designate.2.4 No Other AgreementNo employee covered by this Agreement shall be required or permitted to make a written or oralagreement with the Employer or its representatives which may conflict with the terms of the Agreement..
