(03/2012) Page 3(25) "workday" - is a period of twenty-four (24) consecutive hours commencing with the starting timeof any shift. For the purpose of calculating compensatory overtime rates only, the time worked prior to,but adjoining to, a shift shall be deemed as time worked after a shift;(26) "work schedule" - means the roster of work hours <strong>and</strong> days to meet the annual hours of work.1.1 Purpose of AgreementARTICLE 1 - PREAMBLE(a) The purpose of this Agreement is to establish <strong>and</strong> maintain orderly collective bargainingprocedures between the Employer <strong>and</strong> the Union.(b) The parties to this Agreement share a desire to improve the quality of services provided.Accordingly, they are determined to establish, within the framework provided by the law, an effectiveworking relationship at all levels of operation in which members of the bargaining unit are employed.1.2 Future LegislationIn the event that any future legislation renders null <strong>and</strong> void or materially alters any provision of thisAgreement, the remaining provisions shall remain in effect for the term of the Agreement, <strong>and</strong> the partieshereto shall negotiate a mutually agreeable provision to be substituted for the provision so rendered null<strong>and</strong> void or materially altered.1.3 Conflict with PolicyIn the event that there is a conflict between the contents of this Agreement <strong>and</strong> any policy made by theEmployer, or on behalf of the Employer, this Agreement shall take precedence over the said policy.1.4 Singular <strong>and</strong> PluralWherever the singular is used in this Agreement the same shall be construed as meaning the plural if thecontext requires unless otherwise specifically stated.1.5 Human Rights Act(a)The parties hereto subscribe to the principles of the Human Rights Act of British Columbia.(b) The Employer will make available to all interested employees a file containing the Human RightsAct of British Columbia <strong>and</strong> other readily available information relating to that Act.1.6 Harassment in the Workplace(a) The Employer, in cooperation with the Union, will promote a work environment that is free fromharassment of any kind where employees are treated with respect <strong>and</strong> dignity. Harassment betweenemployees, supervisor (a person in position of authority) to employee, <strong>and</strong>/or employee to supervisor (aperson in position of authority), will not be tolerated in the workplace.(b) Sexual harassment is one form of harassment <strong>and</strong> discrimination which is defined as unwelcomesexual advances or requests for favours which will influence a decision to alter the terms <strong>and</strong> conditionsof employment of an individual who submits to or rejects such advances; <strong>and</strong>/or any unwelcome sexualconduct that creates an intimidating, hostile, or offensive working environment.(c) This clause does not preclude an employee from filing a complaint under Section 13 of the <strong>BC</strong>Human Rights Code.
