ANNEX AProject 17- 5:Project Manager:Participant/Liaison:Proposed Canol Trail and Dodo Canyon Park (or Parks)Government of the Northwest Territories (GNWT) - Economic Development andTourism (ED&T), Department of Indian Affairs and Northern Development(DIAND)- Northern Affairs Program (NAP)Sahtu Tribal Council (STC), Affected government departmentsObligations Addressed:17.3.1 (a) Within three months of the date of settlement legislation, the Government of the NorthwestTerritories shall submit to Canada a proposal for the creation of a territorial park (or parks)within the lands described in the schedule to this chapter, including a request for a reserveof such lands.(b) Canada shall make a decision with respect to the proposal in (a) within two months of thedate of its submission.(c) The Government of the Northwest Territories shall, within three years of the date of thereservation of lands, submit an application to Canada for the transfer of such lands. Theapplication shall include a park management plan (or plans).(d) Canada shall make a decision with respect to the application in (c) within one year.(e) Subject to existing rights, titles or interests in the lands in (a) existing at the date ofsettlement legislation, Canada shall not, prior to a decision with respect to the application in(c), dispose of any interest in such lands or authorize any activity in such lands where thedisposition of that interest or the authorization of that activity would be inconsistent with theestablishment of a territorial park. To the extent that legislation permits subsurfaceexploration and development within territorial parks, this provision shall not preventgovernment from authorizing subsurface exploration and development in the lands in (a).(f) For greater certainty, a territorial park (or parks) created on the Canol Trail/Dodo Canyonshall be a protected area within the meaning of this agreement.(g) Nothing in 17.3 requires Canada or the Government of the Northwest Territories todevelop, establish or operate a territorial park (or parks) in the vicinity of Canol Trail andDodo Canyon but in the event that a territorial park (or parks) is established, the costs ofdeveloping, establishing and operating the park (or parks), other than the incremental costswhich, in the absence of this agreement are costs that would not have been incurred by theGovernment of the Northwest Territories, shall not be costs of implementing thisagreement.Referenced Clauses: 17.3.1(d), Schedule to chapter 17,ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. In the event of the establishment of a park ED&T within the timeframe(or parks) it will be pursuant to chapter 17identified in theapplicationFunding:- As part of the overall funding to be provided by Canada to the Government of the NorthwestTerritories, the Government of the Northwest Territories will allocate the funds as follows:1993 Constant DollarsYear 1 Year 612,500 7,500- This allocation is subject to change by the Government of the Northwest Territories as provided forin Annex B, Part 5.Planning Assumptions:- In the Sahtu Dene and Metis agreement "protected area" means all areas and locations of land setapart and protected by government in the settlement area including historic parks and sites, nationalwildlife areas, migratory bird sanctuaries, territorial parks, conservation areas, and archaeologicalsites but does not include national parks. "Territorial park" means an area dedicated as a recreationpark under 4(1)(a) and (b) of the Territorial Parks Act and any other territorial park outside localgovernment boundaries the area of which exceeds 130 hectares (approximately 321 acres).SAHTU IMPLEMENTATION PLAN 89
