ANNEX AProject 17 - 1:Project Manager:Participant/Liaison:Establishment <strong>and</strong> operation of protected areasGovernment of <strong>the</strong> Northwest Territories (GNWT) - Economic Development <strong>and</strong>Tourism (ED&T), Canada - Affected departments<strong>Sahtu</strong> Tribal Council (STC), Local communitiesObligations Addressed:17.2.1 (a) Government shall consult with <strong>the</strong> <strong>Sahtu</strong> Tribal Council <strong>and</strong> with affected local communitiesprior to <strong>the</strong> establishment of any protected area, or changes in <strong>the</strong> boundaries of anestablished protected area. Such consultation shall commence not less than 12 monthsprior to <strong>the</strong> establishment of <strong>the</strong> protected area or <strong>the</strong> change in boundaries.(b) In an emergency <strong>for</strong> reasons of conservation, such consultation may take place in a shorterperiod. In <strong>the</strong> event of an emergency <strong>for</strong> reasons of conservation which requires immediategovernment action, government shall consult with <strong>the</strong> <strong>Sahtu</strong> Tribal Council as soon aspossible after <strong>the</strong> establishment of a protected area on <strong>the</strong> necessity of <strong>the</strong> action <strong>and</strong> <strong>the</strong>terms <strong>and</strong> conditions attached <strong>the</strong>reto.Referenced Clauses: 17.2.6, 2.1.1 (definition of "protected area"), 17.3ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Identify site of potential protected area ED&T or Canada - after settlementaffected departments legislation(proponent)2. Notify <strong>the</strong> STC <strong>and</strong> <strong>the</strong> local community(ies) proponent not less than 12 monthsof a proposal to establish a protected area orprior to protected areachange <strong>the</strong> boundary of an establishedbeing establishedprotected area; provide <strong>the</strong> STC with areasonable period of time to prepare views on<strong>the</strong> matter; <strong>and</strong> provide <strong>the</strong> STC with anopportunity to present those views3. Review <strong>the</strong> proposal <strong>and</strong> present views to <strong>the</strong> STC, local within period providedproponentcommunity(ies)4. Give full <strong>and</strong> fair consideration to <strong>the</strong> views proponentpresented5. Decide whe<strong>the</strong>r or not to establish <strong>the</strong> proponentprotected areas or change <strong>the</strong> boundary of aprotected area6. If a protected area is to be established, proponent within two years ofnegotiate a protected area agreement withcommencing<strong>the</strong> affected <strong>Sahtu</strong> community(ies)negotiations7. If a protected area agreement is not proponent, localnegotiated, each party may submit its own community(ies)proposal to <strong>the</strong> Minister responsibleSAHTU IMPLEMENTATION PLAN 82
