ANNEX AProject 12 - 6:Project Manager:Participant/Liaison:First opportunity to negotiate contracts <strong>for</strong> Government of <strong>the</strong> NorthwestTerritories projects on settlement l<strong>and</strong>sGovernment of <strong>the</strong> Northwest Territories (GNWT)ParticipantsObligations Addressed:12.2.3 When <strong>the</strong> Government of <strong>the</strong> Northwest Territories intends to carry out activities on settlementl<strong>and</strong>s which give rise to employment or o<strong>the</strong>r economic opportunities, <strong>and</strong> when <strong>the</strong>Government of <strong>the</strong> Northwest Territories elects to enter into contracts with respect to thoseactivities without going to public tender, participants shall be given <strong>the</strong> first opportunity tonegotiate such contracts, provided <strong>the</strong>y satisfy all criteria including any qualifications particularto <strong>the</strong> contract <strong>and</strong> price.Referenced Clauses: 12.3.1ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Declare intention to. contract out an activity GNWTon settlement l<strong>and</strong>s without public tender2. Offer to negotiate contract with GNWT following <strong>the</strong> decision inparticipants activity 13. Negotiate contract GNWT, Participants4. Forward negotiated contract to Minister or GNWTFinancial Management Board <strong>for</strong> approval,or put to public tender if agreement is notreached5. If agreement is reached <strong>and</strong> approval GNWT, Participantsgiven, enter into contractTraining/Economic Opportunities:- Opportunity to enter into contracts<strong>Plan</strong>ning Assumptions:- Participants have <strong>the</strong> right to bid on public tender contracts on <strong>the</strong> same basis as any o<strong>the</strong>rnor<strong>the</strong>rners.- The provisions of chapter 12 are intended to be implemented through programs <strong>and</strong> policies whichare in place from time to time without imposing any additional financial obligation on government.SAHTU IMPLEMENTATION PLAN 43
