ANNEX A- In <strong>the</strong> planning stage of government contracts <strong>for</strong> <strong>the</strong> provision of goods, services, construction, orleases in <strong>the</strong> <strong>Sahtu</strong> settlement area, including surveying <strong>the</strong> boundaries of <strong>Sahtu</strong> l<strong>and</strong>s pursuant to19.4, contracting authorities shall provide all reasonable opportunities to qualified <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong><strong>Metis</strong> firms to submit competitive bids. Where practicable <strong>and</strong> consistent with sound procurementmanagement, contracting authorities should consider, but not necessarily be limited to, <strong>the</strong> followingmeasures:(a) set <strong>the</strong> date, location, <strong>and</strong> terms <strong>and</strong> conditions <strong>for</strong> bidding so that <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> firmsmay readily bid;(b) invite bids by commodity groupings to permit small <strong>and</strong> more specialized firms to bid;(c) permit bids <strong>for</strong> goods <strong>and</strong> services <strong>for</strong> a specified portion of a larger contract package to permitsmaller <strong>and</strong> more specialized firms to bid;(d) design construction contracts in a way so as to increase <strong>the</strong> opportunity <strong>for</strong> smaller <strong>and</strong> morespecialized firms to bid; <strong>and</strong>(e) avoid artificially inflated employment skills requirements not essential to <strong>the</strong> fulfilment of <strong>the</strong>contract.- Whenever practicable, <strong>and</strong> consistent with sound procurement management, <strong>and</strong> subject to Canada'sinternational obligations, all of <strong>the</strong> following criteria, or as many as may be appropriate with respect toany particular contract, shall be included in <strong>the</strong> bid criteria <strong>for</strong> <strong>the</strong> awarding of government contracts in<strong>the</strong> <strong>Sahtu</strong> settlement area:(a) <strong>the</strong> existence or creation of head offices, administrative offices or o<strong>the</strong>r facilities in <strong>the</strong> <strong>Sahtu</strong>settlement area;(b) <strong>the</strong> employment of participants labour, engagement of participants professional services, or useof suppliers that are participants or <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> firms in carrying out <strong>the</strong> contract; or(c) <strong>the</strong> undertaking of commitments, under <strong>the</strong> contract, with respect to on-<strong>the</strong>-job training or skillsdevelopment <strong>for</strong> <strong>the</strong> participants.- The STC will make reasonable ef<strong>for</strong>ts to prepare <strong>and</strong> maintain a list of <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> firms,toge<strong>the</strong>r with in<strong>for</strong>mation on <strong>the</strong> goods <strong>and</strong> services which <strong>the</strong>y would be in a position to furnish inrelation to government contracts. This list shall be considered by Canada in meeting its obligationsunder 12.2.2.- The provisions of chapter 12 are intended to be implemented through programs <strong>and</strong> policies whichare in place from time to time without imposing any additional financial obligation on government.SAHTU IMPLEMENTATION PLAN 40
