ANNEX AProject 12 - 3:Project Manager:Participant/Liaison:Federal contracting in <strong>the</strong> settlement areaCanada<strong>Sahtu</strong> Tribal Council (STC)Obligations Addressed:12.2.1 Where government carries out public activities in <strong>the</strong> settlement area which give rise toemployment or o<strong>the</strong>r economic opportunities <strong>and</strong> government elects to enter into contracts withrespect to those activities,(a) <strong>the</strong> Government of Canada contracting procedures <strong>and</strong> approaches intended to maximizelocal <strong>and</strong> regional employment <strong>and</strong> business opportunities, including <strong>the</strong> provision ofopportunities <strong>for</strong> potential contractors to become familiar with bidding systems,shall be followedReferenced Clauses: 12.3.1ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Conduct seminars on contracting procedures Department of Supply after settlementin <strong>the</strong> settlement area <strong>and</strong> provide a list of <strong>and</strong> Services (DSS) legislationkey contacts to <strong>the</strong> <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong>firms interested in federal contracts2. Make available bid opportunities under <strong>the</strong> DSSOpen Bidding System3. Advertise contracts in local media contracting departments<strong>and</strong> agencies (o<strong>the</strong>r thanDSS)4. Participants may bid on contracts Participants5. Evaluate contract bids on <strong>the</strong> basis of <strong>the</strong> contracting departmentscontract criteria <strong>and</strong> award contracts<strong>and</strong> agencies<strong>Plan</strong>ning Assumptions:- Where <strong>the</strong> Government of Canada intends to invite bids <strong>for</strong> government contracts to be per<strong>for</strong>med in<strong>the</strong> <strong>Sahtu</strong> settlement area, it shall take all reasonable measures to in<strong>for</strong>m <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> firmsof such bids <strong>and</strong> provide <strong>the</strong>m with a fair <strong>and</strong> reasonable opportunity to submit bids. "Invite" meansto call publicly <strong>for</strong> bids. "<strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> firms" means an entity which complies with <strong>the</strong> legalrequirements to carry on a business in <strong>the</strong> area <strong>and</strong> which is a limited company with at least 51 % of<strong>the</strong> company's voting shares beneficially owned by participants, or is a cooperative controlled byparticipants, or is a participants' sole proprietorship or partnership.- Where <strong>the</strong> Government of Canada solicits bids <strong>for</strong> government contracts to be per<strong>for</strong>med in <strong>the</strong> <strong>Sahtu</strong>settlement area, it shall ensure that qualified <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> firms are included in <strong>the</strong> list ofthose firms solicited to bid. "Solicit" means to request bids from a limited number of businesses basedon some <strong>for</strong>m of pre-qualification.SAHTU IMPLEMENTATION PLAN 39
