They were developed <strong>for</strong> <strong>the</strong> purpose of estimating <strong>the</strong> funding to be provided to<strong>the</strong> Arbitration Panel. It is not intended that <strong>the</strong> Arbitration Panel shall be constrained to any particularexpenditure line item.- As regards <strong>the</strong> Government of <strong>the</strong> Northwest Territories, refer to summaries <strong>for</strong> IAA (Project 29 - 2)<strong>and</strong> Justice (Project 29 - 1).<strong>Plan</strong>ning Assumptions:- The panel shall have jurisdiction to arbitrate in respect of any matter which <strong>the</strong> agreement stipulatesis to be determined by arbitration <strong>and</strong> any matter concerning <strong>the</strong> interpretation or application of <strong>the</strong>agreement where <strong>the</strong> parties agree to be bound by an arbitration decision in accordance with <strong>the</strong>dispute resolution chapter.- Until an Arbitration Panel is established, <strong>the</strong> Arbitration Act (NWT), applies to any arbitrationdescribed in 6.1.5.- Nothing under 6.2 shall prevent parties to a dispute from agreeing to refer it to an alternate disputeresolution mechanism such as mediation or arbitration pursuant to <strong>the</strong> Arbitration Act (NWT).- Nominees to <strong>the</strong> Arbitration Panel will be <strong>for</strong>mally appointed by Canada, as represented by <strong>the</strong>Minister of Indian Affairs <strong>and</strong> Nor<strong>the</strong>rn Development, <strong>the</strong> Government of <strong>the</strong> Northwest Territories asrepresented by <strong>the</strong> Minister of Justice <strong>and</strong> <strong>the</strong> <strong>Sahtu</strong> Tribal Council in writing, with copies provided to<strong>the</strong> o<strong>the</strong>r appointers.- The funding of <strong>the</strong> Arbitration Panel will be managed by <strong>the</strong> Nor<strong>the</strong>rn Claims <strong>Implementation</strong>Secretariat, DIAND.SAHTU IMPLEMENTATION PLAN 21
