ANNEX DGENERAL1. Canada, the Government of the Northwest Territories, and the Sahtu Tribal Council shall eachdesignate a representative to the Implementation Committee within 30 days of settlement legislation.2. The Implementation Committee will act in conformity with the Sahtu Dene and Metis agreement andwill be guided by the Implementation Plan.3. The Implementation Committee shall operate on a consensus basis and shall keep a record of itsdeterminations.4. Each party shall be responsible for the costs of the participation of its appointee to theImplementation Committee.5. The Implementation Committee shall provide the Minister of Indian and Northern Affairs, theGovernment Leader of the Northwest Territories and the Sahtu Tribal Council with an annual report,which shall be made public, on the implementation of the Sahtu Dene and Metis agreement on theanniversary date of settlement legislation and at 12 month intervals thereafter. Canada shall beresponsible for publishing the report.ROLES AND RESPONSIBILITIES6. In addition to the functions described in 29.2.3 of the Sahtu Dene and Metis agreement, theCommittee shall:a. make recommendations respecting the implementation of the agreement; andb. pursuant to paragraph 10, determine when obligations have been fulfilled.7. The Committee will fulfil its ongoing responsibility to oversee, direct and monitor the implementationof the agreement by soliciting periodic activity reports from the government and the Sahtu TribalCouncil. The Committee will review the activity reports and communicate with the parties with respectto actions that could be taken to facilitate implementation.8. The Committee may revise the Activity Sheets, reallocate resources consistent with governmentbudgetary processes, or amend the Implementation Plan following consultation with the agencies orparties affected. Reallocation of funding by the Committee may be done only with respect to theallocations of funds set out in Annex B, Parts 1, 4 and 5.9. Should the Implementation Committee make a decision that requires resources additional to thoseidentified in the Implementation Plan, the Implementation Committee shall make its recommendationsfor additional resources to government. Government retains the right to accept, modify, or rejectrecommendations for additional resources.10. The Implementation Committee shall determine from time to time when an obligation has beenfulfilled. To determine whether an obligation has been fulfilled, the Committee shall review activityreports as follows:a. one-time activities will be fulfilled when the activity described in the Implementation Plan hasbeen completed.b. ongoing activities will be reviewed annually by the Committee which will determine whichobligations, if any, remain unfulfilled.SAHTU IMPLEMENTATION PLAN 188
