ANNEX DGENERAL1. Canada, <strong>the</strong> Government of <strong>the</strong> Northwest Territories, <strong>and</strong> <strong>the</strong> <strong>Sahtu</strong> Tribal Council shall eachdesignate a representative to <strong>the</strong> <strong>Implementation</strong> Committee within 30 days of settlement legislation.2. The <strong>Implementation</strong> Committee will act in con<strong>for</strong>mity with <strong>the</strong> <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> agreement <strong>and</strong>will be guided by <strong>the</strong> <strong>Implementation</strong> <strong>Plan</strong>.3. The <strong>Implementation</strong> Committee shall operate on a consensus basis <strong>and</strong> shall keep a record of itsdeterminations.4. Each party shall be responsible <strong>for</strong> <strong>the</strong> costs of <strong>the</strong> participation of its appointee to <strong>the</strong><strong>Implementation</strong> Committee.5. The <strong>Implementation</strong> Committee shall provide <strong>the</strong> Minister of Indian <strong>and</strong> Nor<strong>the</strong>rn Affairs, <strong>the</strong>Government Leader of <strong>the</strong> Northwest Territories <strong>and</strong> <strong>the</strong> <strong>Sahtu</strong> Tribal Council with an annual report,which shall be made public, on <strong>the</strong> implementation of <strong>the</strong> <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> agreement on <strong>the</strong>anniversary date of settlement legislation <strong>and</strong> at 12 month intervals <strong>the</strong>reafter. Canada shall beresponsible <strong>for</strong> publishing <strong>the</strong> report.ROLES AND RESPONSIBILITIES6. In addition to <strong>the</strong> functions described in 29.2.3 of <strong>the</strong> <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong> agreement, <strong>the</strong>Committee shall:a. make recommendations respecting <strong>the</strong> implementation of <strong>the</strong> agreement; <strong>and</strong>b. pursuant to paragraph 10, determine when obligations have been fulfilled.7. The Committee will fulfil its ongoing responsibility to oversee, direct <strong>and</strong> monitor <strong>the</strong> implementationof <strong>the</strong> agreement by soliciting periodic activity reports from <strong>the</strong> government <strong>and</strong> <strong>the</strong> <strong>Sahtu</strong> TribalCouncil. The Committee will review <strong>the</strong> activity reports <strong>and</strong> communicate with <strong>the</strong> parties with respectto actions that could be taken to facilitate implementation.8. The Committee may revise <strong>the</strong> Activity Sheets, reallocate resources consistent with governmentbudgetary processes, or amend <strong>the</strong> <strong>Implementation</strong> <strong>Plan</strong> following consultation with <strong>the</strong> agencies orparties affected. Reallocation of funding by <strong>the</strong> Committee may be done only with respect to <strong>the</strong>allocations of funds set out in Annex B, Parts 1, 4 <strong>and</strong> 5.9. Should <strong>the</strong> <strong>Implementation</strong> Committee make a decision that requires resources additional to thoseidentified in <strong>the</strong> <strong>Implementation</strong> <strong>Plan</strong>, <strong>the</strong> <strong>Implementation</strong> Committee shall make its recommendations<strong>for</strong> additional resources to government. Government retains <strong>the</strong> right to accept, modify, or rejectrecommendations <strong>for</strong> additional resources.10. The <strong>Implementation</strong> Committee shall determine from time to time when an obligation has beenfulfilled. To determine whe<strong>the</strong>r an obligation has been fulfilled, <strong>the</strong> Committee shall review activityreports as follows:a. one-time activities will be fulfilled when <strong>the</strong> activity described in <strong>the</strong> <strong>Implementation</strong> <strong>Plan</strong> hasbeen completed.b. ongoing activities will be reviewed annually by <strong>the</strong> Committee which will determine whichobligations, if any, remain unfulfilled.SAHTU IMPLEMENTATION PLAN 188
