ANNEX AProject 23 - 1:Project Manager:Participant/Liaison:Acquisition of <strong>Sahtu</strong> municipal l<strong>and</strong>s <strong>for</strong> public purposesGovernmentDesignated <strong>Sahtu</strong> Organization (DSO)Obligations Addressed:23.3.1 <strong>Sahtu</strong> municipal l<strong>and</strong>s may be acquired by means of:(a) expropriation in accordance with legislation in respect of expropriation, provided that <strong>the</strong>requirements specified in 24.1.4 <strong>and</strong> 24.1.6 shall apply to any such expropriation; or(b) <strong>the</strong> process specified in 23.3.2, 23.3.3 <strong>and</strong> 23.3.4.23.3.2 <strong>Sahtu</strong> municipal l<strong>and</strong>s may be made available to local governments <strong>for</strong> <strong>the</strong> purpose of publicroad <strong>and</strong> utility corridors which will be of general advantage to <strong>the</strong> community. To this end, adesignated <strong>Sahtu</strong> organization shall enter into negotiations with a local government whichproposes to acquire <strong>Sahtu</strong> municipal l<strong>and</strong>s <strong>for</strong> public roads or utility corridors.Referenced Clauses: 6.3, 7.1, 23.3.3, 23.3.4, 24.1.4, 24.1.6ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Identify <strong>Sahtu</strong> municipal l<strong>and</strong>s required <strong>for</strong> government after settlementpublic purposeslegislation2. Notify <strong>the</strong> designated <strong>Sahtu</strong> organization of governmentl<strong>and</strong>s required <strong>and</strong> propose negotiations3. If <strong>the</strong> l<strong>and</strong> required does not exceed 10% government, designatedof <strong>the</strong> total area of <strong>the</strong> parcel negotiations, <strong>Sahtu</strong> organizationproceed based on <strong>the</strong> value of <strong>the</strong>improvements situated on <strong>the</strong> l<strong>and</strong> to beexpropriated4. If <strong>the</strong> l<strong>and</strong> required exceeds 10 % of <strong>the</strong> area expropriating authority,of a parcel, apply <strong>the</strong> provisions of chapter 24 designated <strong>Sahtu</strong>organization5. Agree to financial compensation <strong>and</strong>/or expropriating authority,exchange parcel of l<strong>and</strong>designated <strong>Sahtu</strong>organization6. If <strong>the</strong> negotiations fail, ei<strong>the</strong>r party may refer expropriating authority or<strong>the</strong> issue to arbitrationdesignated <strong>Sahtu</strong>organization7. Arbitrator makes a decision consistent with arbitrator<strong>the</strong> provisions in 23.3.48.
