ANNEX AProject 21 - 9:Project Manager:Participant/Liaison:Access to <strong>Sahtu</strong> l<strong>and</strong> by public utilitiesPublic UtilitiesDesignated <strong>Sahtu</strong> Organization (DSO), Surface Rights BoardObligations Addressed:21.3.6 (a) Any person authorized by legislation to provide to <strong>the</strong> public electrical power,telecommunications services or similar public utilities, not to include pipelines <strong>for</strong> <strong>the</strong>transmission of hydrocarbons, shall have access to <strong>Sahtu</strong> l<strong>and</strong>s <strong>and</strong> waters overlying suchl<strong>and</strong>s to carry out assessments, surveys <strong>and</strong> studies in relation to proposed services. Suchpersons shall consult with <strong>the</strong> designated <strong>Sahtu</strong> organization prior to exercising suchaccess.(b) Where such access under (a) results in damage to <strong>Sahtu</strong> l<strong>and</strong>s or interference with <strong>the</strong> useof <strong>and</strong> peaceable enjoyment of <strong>Sahtu</strong> l<strong>and</strong>s by <strong>the</strong> participants, such person shallcompensate <strong>the</strong> participants in an amount agreed to by that person <strong>and</strong> <strong>the</strong> designated<strong>Sahtu</strong> organization or, failing such agreement, in an amount determined by <strong>the</strong> SurfaceRights Board.Referenced Clauses: 7.1, 27.2ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. In<strong>for</strong>m <strong>the</strong> DSO of an intent to carry out public utility after settlementassessments, surveys <strong>and</strong> studies onlegislation<strong>Sahtu</strong> l<strong>and</strong>s in relation to proposed services2. In<strong>for</strong>m <strong>the</strong> public utility of <strong>the</strong> views of <strong>the</strong> DSOparticipants regarding <strong>the</strong> proposed access3. Advise <strong>the</strong> DSO of <strong>the</strong> nature <strong>and</strong> timing of public utility<strong>the</strong> access4. If <strong>the</strong> participants claim damage to <strong>Sahtu</strong> DSOl<strong>and</strong>s or interference with <strong>the</strong> use of <strong>Sahtu</strong>l<strong>and</strong>s by <strong>the</strong> <strong>Sahtu</strong> <strong>Dene</strong> <strong>and</strong> <strong>Metis</strong>, submita written claim to <strong>the</strong> public utility5. If a claim is submitted, undertake public utility, DSOnegotiations to resolve claim6. If an agreement on <strong>the</strong> claim is not public utility, DSOreached, ei<strong>the</strong>r party may refer <strong>the</strong> matterto <strong>the</strong> Surface Rights Board7. If referred to <strong>the</strong> Surface Rights Board, Surface Rights Boardreview <strong>and</strong> validate or reject <strong>the</strong> claim8. If <strong>the</strong> claim is validated, determine <strong>the</strong> Surface Rights Boardcompensation9.
