ANNEX AProject 21 - 8:Project Manager:Participant/Liaison:Establishment of navigational aids <strong>and</strong> safety devices along navigable watersTransport Canada<strong>Sahtu</strong> Tribal Council (STC)Obligations Addressed:21.3.5 Notwithst<strong>and</strong>ing 21.3.2, government may establish, on <strong>Sahtu</strong> l<strong>and</strong>s, after consultation with <strong>the</strong><strong>Sahtu</strong> Tribal Council, navigational aids <strong>and</strong> safety devices along <strong>the</strong> shorelines of navigable watersprovided that <strong>the</strong> area occupied by each such navigational aid or safety device shall not exceed: (a) twohectares (approximately five acres), <strong>for</strong> range markers <strong>and</strong> buoy transits; <strong>and</strong> (b) 30.48 metres (100 feet)by 30.48 metres (100 feet), <strong>for</strong> single beacons.Referenced Clauses: 21.3.2ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Notify <strong>the</strong> STC of a proposal to establish, on Transport Canada after settlement<strong>Sahtu</strong> l<strong>and</strong>s, a navigational aid or safety devicelegislationalong <strong>the</strong> shoreline of a navigable water where<strong>the</strong> area occupied will not exceed 2 hectares(approximately 5 acres), <strong>for</strong> range markers <strong>and</strong>buoy transits; <strong>and</strong> 30.48 metres (100 feet) by30.48 metres (100 feet), <strong>for</strong> single beacons;provide <strong>the</strong> STC with a reasonable period oftime to prepare its views on <strong>the</strong> matter; <strong>and</strong>provide <strong>the</strong> STC with an opportunity to presentits views2. Review <strong>the</strong> proposal <strong>and</strong> present views to STC within period providedTransport Canada3. Give full <strong>and</strong> fair consideration to <strong>the</strong> views Transport Canadapresented4. Decide whe<strong>the</strong>r to proceed with <strong>the</strong> proposal Transport Canada5. Communicate <strong>the</strong> decision to <strong>the</strong> STC Transport Canada<strong>Plan</strong>ning Assumptions:- The relevant provisions of chapter 12 will be applied in <strong>the</strong> issuance of any contracts by governmentin <strong>the</strong> <strong>Sahtu</strong> settlement area <strong>for</strong> work associated with navigational aids <strong>and</strong> safety devices.- The Coast Guard shall consult with <strong>the</strong> STC with respect to its planned activities on <strong>Sahtu</strong> l<strong>and</strong>s priorto each navigation season. The Coast Guard will give periodic written reports to <strong>the</strong> STC if fieldoperations during <strong>the</strong> navigation season require modification of those plans.SAHTU IMPLEMENTATION PLAN 112
