ANNEX AProject 21 - 2:Project Manager:Participant/Liaison:Terms <strong>and</strong> conditions attached to certain types of access to <strong>Sahtu</strong> l<strong>and</strong>sDesignated <strong>Sahtu</strong> Organization (DSO)Government of <strong>the</strong> Northwest Territories (GNWT) - Intergovernmental <strong>and</strong>Aboriginal Affairs (IAA), Department of Indian <strong>and</strong> Nor<strong>the</strong>rn Affairs (DIAND) -Nor<strong>the</strong>rn Claims <strong>Implementation</strong> Secretariat (NCIS), Arbitration PanelObligations Addressed:21.1.7 (a) The designated <strong>Sahtu</strong> organization may propose terms <strong>and</strong> conditions, o<strong>the</strong>r than fees orcharges, <strong>for</strong> <strong>the</strong> exercise of access pursuant to 21.2, 21.3.1, 21.4.2 or 21.4.3, inaccordance with <strong>the</strong> following:(i) <strong>the</strong> designated <strong>Sahtu</strong> organization shall consult with government <strong>and</strong> attempt to reachagreement on <strong>the</strong> proposed terms <strong>and</strong> conditions,(ii) if agreement cannot be reached, <strong>the</strong> designated <strong>Sahtu</strong> organization or <strong>the</strong> governmentmay refer <strong>the</strong> matter to arbitration pursuant to chapter 6, <strong>and</strong>(iii) conditions may not be imposed in relation to law en<strong>for</strong>cement or inspections authorizedby law,but may not o<strong>the</strong>rwise establish terms or conditions <strong>for</strong> <strong>the</strong> exercise of access rightspursuant to this chapter. This provision is not intended to restrict <strong>the</strong> establishment of anyterms <strong>and</strong> conditions agreed to by a person to whom such terms or conditions would apply.(b) Terms <strong>and</strong> conditions pursuant to (a) may include <strong>the</strong> identification of areas, locations,seasons or times in respect of which such access is restricted by reason of <strong>the</strong> protectionof <strong>the</strong> environment; conflict with harvesting by <strong>the</strong> participants or o<strong>the</strong>r uses of l<strong>and</strong> by <strong>the</strong>participants; conservation of wildlife <strong>and</strong> wildlife habitat; protection of <strong>Sahtu</strong> communities<strong>and</strong> camps; <strong>and</strong> requirements <strong>for</strong> notice or registration by persons exercising such access.Referenced Clauses: chapter 6, 7.1, 21.2, 21.3.1, 21.4.2, 21.4.3ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Provide to <strong>the</strong> NCIS <strong>and</strong> IAA implementation DSO after settlementsecretariats any terms <strong>and</strong> conditions, o<strong>the</strong>rlegislationthan fees or charges, proposed <strong>for</strong> <strong>the</strong> exerciseof access pursuant to clauses 21.2, 21.3.1,21.4.2, or 21.4.32. Review <strong>the</strong> proposed terms <strong>and</strong> conditions responsible governmentdepartments3. Advise <strong>the</strong> DSO as to who will represent NCIS, IAAgovernment in reaching an agreement on<strong>the</strong> proposed terms <strong>and</strong> conditions4. Hold discussions toward reaching an DSO, governmentagreement on <strong>the</strong> terms <strong>and</strong> conditions5. If agreement cannot be reached, ei<strong>the</strong>r DSO, governmentparty may refer <strong>the</strong> matter to arbitration6.
