ANNEX AProject 20 - 1:Project Manager:Participant/Liaison:Shared drainage basin agreementsDepartment of Indian Affairs <strong>and</strong> Nor<strong>the</strong>rn Development (DIAND) – Nor<strong>the</strong>rnAffairs Program (NAP)<strong>Sahtu</strong> Tribal Council (STC), Government of <strong>the</strong> Northwest Territories (GNWT)Department of Renewable Resources (DRR), O<strong>the</strong>r government departmentsObligations Addressed:20.1.11 (a) Government shall use its best ef<strong>for</strong>ts to negotiate agreements with o<strong>the</strong>r jurisdictions whichmanage drainage basins shared with <strong>the</strong> settlement area <strong>for</strong> <strong>the</strong> management of water in<strong>the</strong> shared drainage basin.(b) Government shall consult with <strong>the</strong> <strong>Sahtu</strong> Tribal Council with respect to <strong>the</strong> <strong>for</strong>mulation ofgovernment positions on <strong>the</strong> management of water in a shared drainage basin be<strong>for</strong>enegotiating an agreement pursuant to (a).Referenced Clauses: 25.1.1(a), 25.1.1 (b)ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Make contact with o<strong>the</strong>r jurisdictions NAP, GNWT - DRR after settlementsharing drainage basins with <strong>the</strong> <strong>Sahtu</strong>legislationsettlement area requesting <strong>the</strong> negotiationof water management agreements wheresuch agreements have not already beenreached or where such negotiations havenot been concluded2. If <strong>the</strong> o<strong>the</strong>r jurisdiction agrees to enter into NAP, GNWT - DRR,negotiations, consult with <strong>the</strong> STC with STCrespect to <strong>the</strong> <strong>for</strong>mulation of governmentpositions be<strong>for</strong>e negotiating an agreement3. Consider <strong>the</strong> views of <strong>the</strong> STC <strong>and</strong> enter NAP, GNWT - DRRinto negotiations toward an agreement<strong>Plan</strong>ning Assumptions:- The L<strong>and</strong> <strong>and</strong> Water Board will be involved in any negotiations entered into pursuant to this process.- If appropriate, funding will be made available to <strong>the</strong> STC to enable <strong>the</strong>m to develop a response to <strong>the</strong>government proposal.- After settlement legislation, <strong>the</strong> STC may request government <strong>for</strong> in<strong>for</strong>mation about any concludedagreements <strong>and</strong> any current discussions or negotiations regarding shared drainage basinagreements <strong>and</strong> <strong>for</strong> an overview of any proposals <strong>for</strong> shared drainage basin agreements <strong>for</strong> <strong>the</strong>settlement area.SAHTU IMPLEMENTATION PLAN 103
