ANNEX AProject 19 - 3:Project Manager:Participant/Liaison:Clean up of hazardous waste sitesDepartment of Indian Affairs <strong>and</strong> Nor<strong>the</strong>rn Development (DIAND) – Nor<strong>the</strong>rnAffairs Program (NAP)<strong>Sahtu</strong> Tribal Council (STC)Obligations Addressed:19.3.4 Where government undertakes any program respecting <strong>the</strong> clean-up of hazardous waste siteson Crown l<strong>and</strong>s in <strong>the</strong> settlement area, such program shall apply to hazardous waste sites on<strong>Sahtu</strong> l<strong>and</strong>s existing at <strong>the</strong> date of settlement legislation, whe<strong>the</strong>r or not identified at that time,<strong>and</strong> government shall be responsible <strong>for</strong> <strong>the</strong> costs associated with such clean-up on <strong>Sahtu</strong>l<strong>and</strong>s. This provision shall not prevent government from recovering any such costs from aperson made liable <strong>for</strong> <strong>the</strong>se costs pursuant to legislation.Referenced Clauses: 19.3.3ACTIVITIES RESPONSIBILITY TIMING GUIDELINES(in sequence)1. Government undertakes a program to clean NAP existing or afterup hazardous waste sites on Crown l<strong>and</strong> insettlement legislation<strong>the</strong> <strong>Sahtu</strong> settlement area2. Using <strong>the</strong> criteria established <strong>for</strong> <strong>the</strong> clean NAP concurrent with-up program, identify hazardous waste sitesapplication of this phaseon <strong>Sahtu</strong> l<strong>and</strong>s existing at <strong>the</strong> date of settle-of program on Crownment legislation, whe<strong>the</strong>r or not identifiedl<strong>and</strong>s in <strong>the</strong> settlementat that time, including considering allareain<strong>for</strong>mation submitted regarding <strong>the</strong> locationof hazardous waste sites on <strong>Sahtu</strong> l<strong>and</strong>s<strong>and</strong> assessing this in<strong>for</strong>mation against <strong>the</strong>established criteria <strong>for</strong> <strong>the</strong> clean-up program3. Carry out clean-up program on <strong>Sahtu</strong> l<strong>and</strong>s NAP concurrent with applicausingsame techniques <strong>and</strong> criteria used ontion of this phase ofCrown l<strong>and</strong>sprogram on Crown l<strong>and</strong>sin <strong>the</strong> settlement areaTraining/Economic Opportunities:- Consistent with provisions in chapter 12, Economic Measures.<strong>Plan</strong>ning Assumptions:- The Arctic Environmental Strategy announced on April 29, 1991, contains an "Action on Waste"component. A program to clean up hazardous waste sites will be carried out under <strong>the</strong> auspices ofthis strategy in <strong>the</strong> North. Consequently, should a clean-up program be carried out in <strong>the</strong> <strong>Sahtu</strong>settlement area, no costs will be attributed to <strong>the</strong> implementation of <strong>the</strong> <strong>Sahtu</strong> claim.- Hazardous waste sites are sites on which toxic substances are stored or disposed of, as defined inPart II, section 11, Canadian Environmental Protection Act, R.S.1985, c. 16 (4th supp.)SAHTU IMPLEMENTATION PLAN 96
