If OSMV determines that an individual is not fit to hold a licence of aparticular class, under section 92 of the MVA the Superintendent maydirect ICBC to cancel an individual’s licence. Because the medicalcondition guidelines often specify different standards for commercial andprivate drivers, an individual may be fit to drive private vehicles, eventhough they are not fit to drive commercial vehicles. In this situation, acase manager or adjudicator may direct ICBC to issue a class 5 licenceafter cancelling an individual’s commercial licence.72
