7.12 Communicating a decisionPolicyInforming drivers of determinations7.12.1 A case manager or adjudicator will send an individual a letter thatdescribes the driver fitness determination, the reasons for thedetermination and the reconsideration process if thecase manager or adjudicator decides that:(a) an individual is not fit to drive(b) conditions must be imposed on an individual, or(c) restrictions must be imposed on an individual’s licence.Informing ICBC of determinations7.12.2 A case manager or adjudicator will direct ICBC to cancel a licenceif a driver fitness determination indicates that an individual is notfit to drive and the individual currently holds a licence.7.12.3 A case manager or adjudicator may direct ICBC to issue a class 5licence to an individual who holds a commercial licence if the casemanager or adjudicator determines that the individual is not fit todrive commercial vehicles but is fit to drive private vehicles.7.12.4 A case manager or adjudicator will inform ICBC that an individualis not fit to be licensed if a driver fitness determination indicatesthat an individual is not fit to drive and the individual does notcurrently hold a licence.Policy rationaleBoth for administrative fairness and public safety reasons, an individualmust be informed of a driver fitness determination that affects theirlicensing privileges, the reasons for the determination and the process forrequesting a reconsideration of a determination. If conditions orrestrictions are imposed, individuals must be made aware of the conditionsor restrictions so that they are able to comply with them in the future. If alicence is cancelled, the individual must be told to stop driving andsurrender their licence.71
