GUIDELINES24.6 Private and commercial drivers with a neurological disorderApplicationAssessment guidelinesFitness guidelinesOSMV determinationguidelinesThese guidelines apply to driver fitness determinations for privateand commercial drivers who have: multiple sclerosis Parkinson’s disease cerebral palsy, or other neurological disorders.If further information regarding an individual’s medical condition isrequired, OSMV will request: a Driver’s Medical Examination Report additional information from the treating physician, or an assessment from a neurologist.If the treating physician indicates possible impairment of one or moreof the functions necessary for driving, OSMV will request functionalassessment(s) as appropriate for the type(s) of impairment and classof licence held, unless there has been no significant change in theindividual’s condition or functional ability since a previous functionalassessment.Individuals may drive if: they retain sufficient range of motion, strength and coordinationto perform the functions necessary for driving vehicles in theirlicence class they have sufficient cognitive function to drive safely any pain associated with the condition, or the drugs used to treatthe condition, does not adversely affect their ability to drivesafely where required, a road test or other functional assessmentindicates that they are able to compensate for any loss offunctional ability required for driving, and where permitted, they only drive with any vehicle modificationsand devices required to compensate for their functionalimpairment.OSMV may find individuals fit to drive if: the treating physician does not indicate possible impairment ofthe functions necessary for driving, or where the treating physician indicates that there may beimpairment of the functions necessary for driving, a functionalassessment indicates that they have the functional ability requiredfor their class of licence held.322
ConditionsRestrictionsRe-assessmentguidelinesPolicy rationaleNo conditions are required.OSMV will restrict an individual’s licence so that they only drivewith any permitted vehicle modifications and devices required tocompensate for their functional impairment. This may include one ormore of the following restrictions:26 Specified vehicle modifications required28 Restricted to automatic transmission51 [specify type of restriction]If the neurological disorder is progressive (e.g., multiple sclerosis orParkinson’s disease), OSMV will re-assess every 5 years or inaccordance with routine commercial or age-related re-assessment,unless a shorter re-assessment interval is recommended by thetreating physician.If the neurological disorder is not progressive (e.g., cerebral palsy),no re-assessment is required, other than routine commercial or agerelatedre-assessment.The potential functional impairments associated with neurologicaldisorders are variable.323
