GUIDELINES FOR LM STS SUPPLIERS REGARDING COUNTRYOF ORIGIN<strong>Country</strong> of <strong>Origin</strong> Requirements for <strong>Lockheed</strong> <strong>Martin</strong>Simulation Training and Support “LM STS”.LM STS requires ALL products to be marked with the <strong>Country</strong> of <strong>Origin</strong>and the commercial documentation (i.e. the packing list and invoice) tocontain information for each line item regarding the <strong>Country</strong> of <strong>Origin</strong>of the product.For products that cannot be individually marked or are on the j-listunder 19 CFR sec 134.33, the container must be marked with the <strong>Country</strong>of <strong>Origin</strong>. The marking must be permanent, legible, and conspicuouslylocated.Failure to provide <strong>Country</strong> of <strong>Origin</strong> markings on the product and<strong>Country</strong> of <strong>Origin</strong> information on the commercial documents may result indelayed payment and/or returned product per the <strong>Country</strong> of <strong>Origin</strong> textnote on the Purchase Order.I NAFTA Certificates of <strong>Origin</strong> for ProductDelivered to LM STS San DiegoThis document is for use as a general guideline only, and is notintended to replace the NAFTA rules of origin or any NAFTA legislation.For NAFTA <strong>Origin</strong>ating products being delivered to LM STS in San Diego,LM STS requires a NAFTA CERTIFICATE OF ORIGIN, (example located inExhibit A). Failure to provide a completed NAFTA Certificate of <strong>Origin</strong>may result in delayed payment and/or returned product per the <strong>Country</strong>of <strong>Origin</strong> text note on the Purchase Order.LM STS prefers that all NAFTA Certificates of <strong>Origin</strong> are issued by theactual manufacturer of the product. Although LM STS prefers all NAFTACertificates to be issued and signed by the actual manufacturer, ifsuppliers are unwilling to disclose the manufacturer, LM STS willaccept a NAFTA Certificate issued and signed by a non manufacturingsupplier if the certificate is based on the actual manufacturer’s NAFTACertificate.Only product manufactured in the United States, Canada and/or MexicoMAY (not always eligible) be eligible for treatment as “NAFTAORIGINATING.”A. NAFTA CERTIFICATES OF ORIGIN FOR DISTRIBUTORSIf you are not the manufacturer of the product but a distributor of theproduct, and the actual manufacturer of the product is located in theUnited States, Canada or Mexico, please request a NAFTA Certificate of<strong>Origin</strong> from the Manufacturer. Once received, pass it on to the LM STScontact along with the other commercial documents as noted on thePurchase Order. LM STS requires all service providers that deliver a tangible productto LM STS to follow the <strong>Country</strong> of <strong>Origin</strong> procedures outlined in thisguidance document. Suppliers providing items such as technical manualsshould determine whether the tangible technical manuals qualify as“NAFTA <strong>Origin</strong>ating” and if so follow procedures outlined in section Ior II of this document as applicable. preferential tariff treatment, each good must meet at least one of the criteriabelow.Preference CriteriaA. The good is “wholly obtained or produced entirely” in the territory of one ormore of the NAFTA countries as referenced in Article 415. Note: The purchaseof a good in the territory does not necessarily render it “wholly obtained orproduced”. If the good is an agricultural good, see also criterion F and Annex703.2. (Reference: Article 401(a) and 415)B. The good is produced entirely in the territory of one or more of the NAFTAcountries and satisfies the specific rule of origin, set out in Annex 401, thatapplies to its tariff classification. The rule may include a tariff classificationchange, regional value-content requirement, or a combination thereof. The goodmust also satisfy all other applicable requirements of Chapter Four. If the goodis an agricultural good, see also criterion F and Annex 703.2. (Reference: Article401 (b))C. The good is produced entirely in the territory of one or more of the NAFTAcountries exclusively from originating materials. Under this criterion, one ormore of the materials may not fall within the definition of “wholly produced orobtained”, as set out in Article 415. All material used in the production of thegood must qualify as “originating” by meeting the rules of Article 401(a) through(d). If the good is an agricultural good, see also criterion F and Annex 703.2.Reference: Article 401(c).D. Goods are produced in the territory of one or more of the NAFTA countries butdo not meet the applicable rule of origin, set out in Annex 401, because certainnon-originating materials do not undergo the required change in tariffclassification. The goods do nonetheless meet the regional value-contentrequirement specified in Article 401 (d). This criterion is limited to thefollowing two circumstances.1. The good was imported into the territory of a NAFTA country in anunassembled or disassembled form but was classified as an assembled good,pursuant to H.S. General Rule of Interpretation 2(a), or2. The good incorporated one or more non-originating materials, provided foras parts under the H.S., which could not undergo a change in tariffclassification because the heading provided for both the good and its partsand was not further subdivided into subheadings, or the subheading providedfor both the good and its parts and was not further subdivided.Note: This criterion does not apply to Chapters 61 through 63 of the H.S.(Reference: Article 401(d))E. Certain automatic data processing goods and their parts, specified in Annex308.1, that do not originate in the territory are considered originating uponimportation into the territory of a NAFTA country from the territory of anotherNAFTA country when the most-favored-nation tariff rate of the good conformsto the rate established in Annex 308.1 and is common to all NAFTA countries.(Reference: Annex 308.1)


F. The good is an originating agricultural good under preference criterion A, B, orC above and is not subject to a quantitative restriction in the importing NAFTAcountry because it is a “qualifying good” as defined in Annex 703.2, Section Aor B (please specify). A good listed in Appendix 703.2B.7 is also exempt fromquantitative restrictions and is eligible for NAFTA preferential tariff treatment ifit meets the definition of “qualifying good’ in Section A of Annex 703.2. Note1: This criterion does not apply to goods that wholly originate in Canada or theUnited States and are imported into either country. Note 2: A tariff rate quota isnot a quantitative restriction.Field 8: For each good described in Field #5, state “YES” if you are the producer of thegood.
