Section 1. IntroductionOn June 28, 1994, EPA promulgated a final rule (published in the Federal Register July5, 1994) modifying the definition of the glycol ethers category on the list of toxic chemicalsunder Section 313 of the Emergency Planning and Community Right-to-Know Act of 1986(EPCRA), 42 U.S.C. 11001 et.seq. The effect of this modification, which is described at 59 FR34386, is that many high molecular weight glycol ethers were excluded from the category. Asdescribed in the final rule, this modification was made retroactive for the 1993 reporting year forreports due July 1, 1994. This modification is also effective for all subsequent reporting years.As part of this modification and as the result of public comment, EPA changed the categoryname at 40 CFR 372.65(c) from 'glycol ethers' to 'certain glycol ethers'. However, this documentwill refer to the constituents of this category simply as glycol ethers. At the time of themodification, EPA indicated that the Agency would work with the public and the regulatedcommunity to develop, as appropriate, interpretations and guidance that the Agency determinesare necessary to facilitate accurate reporting for the modified glycol ethers category. Thisdocument constitutes such guidance.Who Must ReportA plant, factory, or other facility is subject to the provisions of EPCRA section 313, if itmeets all three of the following criteria:CIt is included in a covered Standard Industrial Classification (SIC) code as listedin the following table; andIndustrial SectorSIC codeManufacturing 20-39Metal mining 10 (except 1011, 1081, and 1094)Coal Mining 12 (except 12411)Electrical utilitiesTreatment, Storage, and Disposal facilitiesSolvent recovery services4911, 4931, and 4939, limited to facilities that combust coaland/or oil for the purpose of generating electricity fordistribution in commerce4953, limited to RCRA Subtitle C permitted or interim statusfacilities7389, limited to facilities primarily engaged in solventrecovery services on a contract or fee basisChemical distributors 5169Petroleum bulk terminals 5171CIt has 10 or more full-time employees (or the equivalent 20,000 hours per year);and2
