B 2572Dikjarazzjoni ta’Żoni għall-Ħarsientas-Siġar.VERŻJONI ELETTRONIKA(2) L-Awtorità Kompetenti għandha tippubblikad-dettalji ta’ dak is-sit jew siti, bil-konfini tagħhom immarkati, fil-Gazzetta.(3) Kull Żona għall-Ħarsien tas-Siġar hekk nominatagħandha titqies bħala żona mħarsa skond l-Att jew l-Att dwaril-Ħarsien ta’ l-Ambjent, u għandha tkun soġġetta għal dawn irregolamenti.(4) Kull sit protett bħala Żona għall-Ħarsien tas-Siġar għandu jibqa’ mħares minkejja kull ċirkostanza intiża jewaċċidentali, li biha:(a) kull siġra li tinsab f’dik iż-żona protetta hi, kollhajew parti minnha, meqruda jew tmut; jew(b) is-sit iġarrab xi impatt ieħor.Integrazzjoni fin-Network EkoloġikuNazzjonali.A.L. 311 ta’ l-<strong>200</strong>6.Elenku reġistrat.(5) Kull Żona għall-Ħarsien tas-Siġar iddikjarata taħtdawn ir-regolamenti għandha ukoll tifforma parti integrali min-Network Ekoloġiku Nazzjonali stabbilit bir-regolament 5(1) tar-Regolamenti ta’ l-<strong>200</strong>6 dwar il-Protezzjoni tal-Flora, Fawna uAmbjenti Naturali, u tkun soġġetta għad-dispożizzjonijiet l-oħratar-regolament 5 ta’ l-istess regolamenti.7. Żoni għall-Ħarsien tas-Siġar identifikati u mħarsakonformement mad-dispożizzjonijiet tar-regolament 6 ta’ dawn irregolamenti,għandhom jiġu reġistrati f’elenku miżmum għal dakil-għan, u fir-reġistru pubbliku. L-elenku msemmi għandu jinżammf’forma elettronika b’tali manjiera li tkun tista’ ssir riċerka sabiexjiġi stabbilit l-istatus ta’ sit.TAQSIMA III: SPEĊI TA’ SIĠAR LI JKUNU QEGĦDINJIKKAĠUNAW ĦSARA LILL-BIODIVERSITÀ JEWLILL-<strong>AMBJENT</strong> NATURALI B’MOD ĠENERALILista ta’ speċi ta’ siġarli jikkaġunaw ħsaralill-biodiversità.8. (1) Is-siġar elenkati fi Skeda III li tinsab ma’ dawn irregolamentihuma meqjusa bħala speċi li jikkaġunaw ħsara liddiversitàbioloġika ta’ siġar jew imsaġar f’Malta, jew lill-ambjentnaturali b’mod ġenerali.


VERŻJONI ELETTRONIKAB 2573(2) L-ebda persuna m’għandha tnissel, tiżra, tħawwel,timporta, tesporta, tittrasporta, tbiegħ jew tpartat kwalunkwe speċielenkata fi Skeda III li tinsab ma’ dawn ir-regolamenti, sakemm matkunx awtorizzata kif imiss konformement mad-dispożizzjonijiettat-Taqsima VI ta’ dawn ir-regolamenti.9. (1) L-Awtorità Kompetenti tista’, f’dak iż-żmiendeterminat minnha, tordna lil xi persuna responsabbli mill-art fejntkun tinsab xi siġra msemmija fi Skeda III li tinsab ma’ dawn irregolamentisabiex tneħħi, taqla’, toqtol jew teqred xi siġra bħaldik, fejn dik it-tneħħija, fl-opinjoni ta’ l-Awtorità Kompetenti, tkuntikkostitwixxi titjib għall-ambjent.Miżuri ta’ titjib.L-Awtorita’ Kompetenti tista’ toħroġ metodu tat-twettiqbiex jiġi żgurat li dik l-ordni tkun eżegwita bl-anqas ħsara lillbiodiversita’.(2) Jekk xi persuna msemmija fid-dispożizzjonipreċedenti tonqos milli tħares dik l-ordni, l-Awtorità Kompetentitista’ tneħħi, taqla’, toqtol jew teqred dik is-siġra għas-spejjeż talpersunamsemijja.(3) Jekk il-persuna responsabbli mill-art fejn tinsab dikis-siġra ma tkunx magħrufa, l-Awtorità Kompetenti tista’ tippublikaordni bħal dik fil-Gazzetta u tneħħi dik is-siġra għas-spejjeż tagħhawara disgħin ġurnata mill-pubblikazzjoni ta’ l-ordni.10. L-Awtorità Kompetenti tista’ twaqqaf it-trasport ul-importazzjoni ta’ siġar li fl-opinjoni tagħha jistgħu jipperikolawid-diversità bioloġika ta’ siġar u msaġar f’Malta, jew li b’xi modikunu ta’ detriment għall-ambjent, jew għal xi raġuni oħra flinteressnazzjonali.Twaqqif ta’l-importazzjoni ta’siġar.TAQSIMA IV: REGOLAMENT TA’ <strong>ATT</strong>IVITAJIET11. Ebda persuna ma għandha twettaq azzjoni jew tipprovatwettaq kwalunkwe azzjoni, li, fl-opinjoni ta’ l-Awtorità Kompetentitista’ tkun ta’ ħsara għal kull siġra elenkata fi Skedi I u II li jinsabuma’ dawn ir-regolamenti, u, jew għad-diversità bioloġika ta’ xisiġra jew komunitajiet ta’ msaġar mħarsa f’Żona għall-Ħarsientas-Siġar jew f’kull żona protetta oħra, ħlief għal siġar ta’ speċielenkati fi Skeda III li tinsab ma’ dawn ir-regolamenti.Ħarsien talbiodiversità.

Ebda persuna ma għandha twaqqa’ jew tipprovatwaqqa’, taqta’ jew tipprova taqta’, tneħħi jew tipprova tneħħil-qoxra taz-zokk tas-siġra jew weraq tagħha, taqla’ jew tipprovataqla’, tneħħi jew tipprova tneħħi injam, twaħħal jew tipprovatwaħħal xi ħaġa ma’, jew b’xi mod teqred jew tipprova teqred,tagħmel ħsara jew tipprova tagħmel ħsara lil xi siġra jew lil xi partiminnha li hija elenkata fi Skedi I jew Skeda II li jinsabu ma’ dawnir-regolamenti jew xi siġra jew parti minnha li tkun tinsab f’Żonagħall-Ħarsien tas-Siġar jew f’xi żona protetta oħra, ħlief għal siġarta’ speċi elenkati fi Skeda III li tinsab ma’ dawn ir-regolamenti,ħlief bil-permess ta’ l-Awtorità Kompetenti:Iżda t-tqaċċit ta’ weraq ma japplikax għal siġar li humaelenkati fi Skeda II li tinsab ma’ dawn ir-regolamenti.Meta ma japplikaxir-regolament 12.13. Id-dispożizzjonijiet ta’ regolament 12 m’għandhomxjapplikaw fir-rigward ta’:(a) żbir ta’ siġar imkabbra b’mod ortikulturali elenkatifi Skeda I jew Skeda II li jinsabu ma’ dawn ir-regolamenti,inklużi siġar imkabbra b’mod ortikulturali li jinsabu f’Żonagħall-Ħarsien tas-Siġar jew f’xi żona protetta oħra, għarraġunispeċifika biex jevitaw aktar ħsara lil xi siġra li tkundiġa` jkollha l-ħsara u biex titjieb s-saħħa ġenerali tagħha;(b) żbir ta’ siġar imkabbra b’mod ortikulturali elenkatifi Skeda II li tinsab ma’ dawn ir-regolamenti, inklużi siġarimkabbra b’mod ortikulturali li jinsabu f’Żona għall-Ħarsientas-Siġar jew f’xi żona protetta oħra, biex tikkontrollat-tkabbir għar-raġunijiet speċifiċi ta’ ippreservar tassaħħatagħha, tittejjeb is-saħħa ġenerali tagħha, tittejjeb ilproduttivitàtal-frott jew biex jiġi evitat kull ħsara lil persunijew xi ħsara lill-proprjetà;(ċ) żbir ta’ siġar imkabbra b’mod ortikulturali elenkatifi Skeda I jew Skeda II li jinsabu ma’ dawn ir-regolamenti,jew xi siġra imkabbra b’mod ortikulturali li jinsabu f’Żonagħall-Ħarsien tas-Siġar jew f’xi żona protetta oħra, biextikkontrolla t-tkabbir għar-raġuni speċifika li tiġi evitatal-introduzzjoni probabbli ta’ ġrieden jew organiżmi lijgħamlu ħsara f’xi proprjetà:

Din teskludi dawkli jinsabu f’Żoni għall-Ħarsien tas-Siġar u xi siġar taż-żebbuġjew tal-ħarrub li għandhom aktar minn ħamsin sena, kif ukollsiġar li ġew imħawla għal skopijiet ta’ landscaping kif mitlubminn permess ta’ żvilupp.(e) Il-qtugħ, twaqqiegħ, kura u, jew qirda ta’ xi siġrali tkun infestata b’organiżmi li jikkawżaw ħsara jew biġrieden ta’ kwarantina, u mard elenkat f’Annessi I u II mar-Regolamenti ta’ l-<strong>200</strong>4 dwar il-Kwarantina tax-Xitel, warakonsultazzjoni xierqa mad-direttur responsabbli għas-saħħatax-xitel:A.L. 97 ta’ l-<strong>200</strong>4.Iżda d-dispożizzjonijiet ta’ dan ir-regolament għandhomikunu mingħajr preġudizzju għar-regolament 11 ta’ dawn irregolamentiu għal kull liġi jew regolament, dispożizzjoni,ftehim, pjan ta’ tmexxija, pjan ta’ immaniġġjar, ordni, permessjew liċenza jew xi kundizzjoni jew kunsens mogħti bis-saħħata’ xi liġi oħra jew regolament ieħor.14. Ebda persuna ma tista’ tqiegħed, tipprova tqiegħed,jew tħalli li jitqiegħed xi tajer, lastku, polystyrene, karti, jew xikombustibli jew materjal ieħor li jaqbad jew jisplodi, qrib xi siġraelenkata fi Skeda I jew Skeda II li jinsabu ma’ dawn ir-regolamentijew qrib xi siġra li tinsab f’Żona għall-Ħarsien tas-Siġar jew f’xiżona protetta.16. Ebda persuna ma tista’ tordom fl-art jew tipprova tordomfl-art, tarmi jew tipprova tarmi, jew tpoġġi jew tipprova tpoġġi xiħamrija, demel, skart, żibel, ġebel, terrapien, metall ta’ l-iskrappjew xi skart qrib xi siġra elenkata fi Skeda I jew Skeda II li jinsabuma’ dawn ir-regolamenti jew qrib xi siġra li tinsab f’Żona għall-Ħarsien tas-Siġar jew f’xi żona protetta, ħlief għall-ħamrija jewsubstrat għall-kura ta’ għelieqi maħduma, sakemm il-kwantitajietta’ dawk is-sustanzi ma jkunux ta’ detriment għas-siġar imħarsabis-saħħa ta’ dawn ir-regolamenti.17. (1) Kwalunkwe persuna li tqabbad jew tipprovatqabbad xi nar qrib xi siġra elenkata fi Skeda I jew Skeda II lijinsabu ma’ dawn ir-regolamenti, jew qrib xi siġra li tinsab f’żonaprotetta li mhux Żona għall-Ħarsien tas-Siġar, b’hekk tikkaġunaħsara bħala riżultat ta’ użu imprudenti jew negliġenti ta’ rekwiżitigħat-tipjip, sigaretti jew tabakk, logħob tan-nar jew materjalkombustibli ieħor, jew tonqos li tieħu prekawzjonijiet adegwatif’dan ir-rigward, tkun ħatja ta’ reat.(2) Ebda persuna ma għandha tqabbad jew tipprovatqabbad xi nar f’Żona għall-Ħarsien tas-Siġar:(a) għal skopijiet ta’ divertiment, inkluż u mhux limitatgħal-ħġejjeġ, barbikjus, nirien ħdejn kampijiet u logħob tannar;(b) li jista’ jikkaġuna ħsara bħala riżultat ta’ użuimprudenti jew negliġenti ta’ rekwiżiti għat-tipjip, sigaretti


VERŻJONI ELETTRONIKAB 2577jew tabakk, logħob tan-nar jew materjal kombustibli ieħor,jew li jonqos li jieħu prekawzjonijiet adegwati f’dan irrigward.(3) Id-dispożizzjonijiet ta’ dan r-regolament majapplikawx għal —(a) xi persuna li tqabbad ħuġġieġa li tista’ tiġikkontrollatha, jew(b) nar li jkun direttament konness ma’ jew meħtieġgħall-immaniġġjar taż-Żona għall-Ħarsien tas-Siġar jew żonaprotetta oħra inkwistjoni, bl-approvazzjoni mogħtija minnqabel mill-Awtorità Kompetenti:(ċ)privata.xi nar ikkontrollat ġol-konfini ta’ abitazzjoniIżda f’kull każ, il-persuna xorta għandha tibqa’responsabbli għal kull ħsara diretta, indiretta jewkonsegwenzjali, li ssir lil xi siġra elenkata fi Skeda I jewSkeda II li jinsabu ma’ dawn ir-regolamenti, jew lil xi siġrali tinsab f’Żona għall-Ħarsien tas-Siġar jew f’xi żona protettaoħra. L-Awtorità Kompetenti tista’ ukoll tieħu azzjoni bissaħħata’ dawn ir-regolamenti jekk il-persuna tonqos milliżżomm in-nar taħt kontroll bħala riżultat ta’ negliġenza jewazzjoni malizjuza.18. (1) Ebda persuna ma għandha tħalli jew tipprova tħalliannimali jikkaġunaw ħsara waqt li ikunu qegħdin jirgħu lil xi siġraelenkata fi Skeda I jew Skeda II li jinsabu ma’dawn ir-regolamenti.Ragħa.(2) Ebda persuna ma għandha tħalli jew tipprovatħalli annimali jirgħu f’xi Żona għall-Ħarsien tas-Siġar jew f‘żoniprotetti oħra.(3) Is-sid ta’ xi annimal li jikkaġuna ħsara bħaldik jista’ jiġi ordnat iħallas kumpens għall-ħsara hekk kaġunataskond kif il-Qorti tista’ tiddeċiedi. Jekk l-annimal ikun jappartjenigħal aktar minn sid wieħed, is-sidien kollha jistgħu jiġu ordnatibiex solidalment iħallsu kumpens għall-ħsara kaġunata minn dakl-annimal.


B 2578VERŻJONI ELETTRONIKATAQSIMA V: DISPOŻIZZJONIJIET SUPPLIMENTARIFUQ PERMESSI RELATATIDispożizzjonijietsupplimentari relatatima applikazzjonijietgħal permessi ta’żvilupp.19. (1) Kull fejn żvilupp, sew jekk waħdu jewf’kumbinazzjoni ma’ pjanijiet jew proġetti oħra, x’aktarx li jkollueffett avvers fuq siġar elenkati fi Skeda I jew Skeda II li jinsabuma’ dawn ir-regolamenti l-Awtorità Kompetenti tista’:(a) tirrifjuta l-applikazzjoni; jew(b) timponi kundizzjonijiet xierqa fil-permess; jew(ċ) titlob emendi fil-, jew rilokazzjoni ta’, l-iżvilupppropost; jew(d) tadotta kumbinazzjoni ta’ miżuri preċedenti kifikun xieraq fil-kuntest ta’ dawn ir-regolamenti.(2) Kull fejn żvilupp, sew jekk waħdu jewf’kumbinazzjoni ma’ pjanijiet jew proġetti oħra, x’aktarx li jkollueffett avvers fuq xi Żona għall-Ħarsien tas-Siġar jew f’żoni protettioħrajn, l-Awtorità Kompetenti tista’:(a) tirrifjuta l-applikazzjoni; jew(b) timponi kundizzjonijiet fil-permess jewlimitazjonijiet fil-permess xierqa;(ċ) tirrikjedi evalwazzjoni xierqa ta’ l-impatti; jew(d) tadotta kumbinazzjoni ta’ miżuri msemmija skondkif ikun xieraq fil-kuntest ta’ dawn ir-regolamenti.(3) Id-dispożizzjonijiet ta’ dan l-artiklu għandhomjapplikaw kemm għal applikazzjonijiet għall-permess ta’ żviluppoutline kif ukoll għal permess ta’ żvilupp full, u għandhom ukolljapplikaw meta tkun qegħda tiġi stabbilita konsiderazzjoni millġdidjew appell skond id-dispożizzjonijiet ta’ l-Att.(4) Żvilupp li x’aktarx ikollu effett avvers fuq xi siġraelenkata fi Skeda I jew Skeda II li jinsabu ma’ dawn ir-regolamenti


VERŻJONI ELETTRONIKAB 2579jew f’xi Żona għall-Ħarsien tas-Siġar jew f’żoni protetti oħra,m’għandux ikun permess b’ordni ta’ żvilupp skond l-artikolu 63ta’ l-Att, jew b’xi applikazzjoni għal modifiki minuri f’permess ta’żvilupp li jkun eżistenti.(5) Id-dispożizzjonijiet ta’ l-artikolu 77 ta’ l-Attgħandhom japplikaw f’każ li xi siġra protetta b’dawn irregolamentitkun affetwata b’mod sinifikanti u negattiv bil-ħruġ ta’permess ta’ żvilupp abbażi ta’ informazzjoni mhux korretta, mhuxkompleta, qarrieqa jew informazzjoni falza fl-applikazzjoni għalpermess relevanti. F’każ bħal dak, kull permess relatat maħruġ bissaħħata’ dawn ir-regolamenti għandu jkun ukoll null u bla effett.TAQSIMA VI: PERMESSI BIS-SAĦĦA TA’ DAWNIR-REGOLAMENTI20. Mingħajr preġudizzju għad-dispożizzjonijiet ta’ dawnir-regolamenti, l-Awtorità Kompetenti tista’ toħroġ permess qabelma jitwettqu xi attivitajiet regolati b’dawn ir-regolamenti:Permessi.Iżda l-Awtorità Kompetenti m’għandhiex toħroġ permess bħaldak jekk, wara li tikkonsidra l-attività proposta, tkun tal-opinjoni lidik l-attività mhix ġustifikata jew li l-impatt negattiv ta’ l-attivitàjgħelbu xi benefiċċji possibli.21. Mingħajr preġudizzju għal regolamenti ambjentalirelatati, ebda permess maħruġ bis-saħħa ta’ dawn ir-regolamentim’għandu jippermetti interventi li:Interventi mhuxpermessi.(a) jkunu diġà proposti f’applikazzjoni għal permess,notifikazzjoni, awtorizzazzjoni jew liċenza magħmula bissaħħata’ l-Att dwar il-Ħarsien ta’ l-Ambjent jew l-Att dwarl-Ippjanar ta’ l-Iżvilupp jew l-Att, li jkunu għadhom qegħdinjiġu proċessati, emendati, rikonsidrati jew appellati skond xiAtt imsemmi hawn aktar qabel;(b) jistgħu jipreġudikaw il-merti ta’ dak l-ipproċessar,emendi, rikonsiderazzjoni jew appell;(ċ) jistgħu jipreġudikaw il-merti ta’ talba għal xiawtorizzazzjoni jew liċenza meħtieġa għall-Atti msemmija


B 2580VERŻJONI ELETTRONIKAhawn aktar qabel, jew jistgħu jipreġudikaw il-merti ta’ xiappell minn xi deċiżjoni dwarhom; jew(d) jistgħu jipreġudikaw xi każ ta’ infurzar, każ filqortijew każijiet oħra li jkunu qegħdin sub-judice.Għandha ssirapplikazzjoni bilmiktub.22. (1) Il-persuna li tkun qegħda titlob permess għallattivitajietimsemmija fir-regolament 21, hawn aktar ’il quddiemimsejħa l-applikant, għandha tippreżenta applikazzjoni bil-miktublill-Awtorità Kompetenti qabel ma twettaq tali attivitajiet.(2) Sabiex tippermetti lill-Awtorità Kompetentibiex tkun tista’ tevalwa talba għal permess b’mod adegwat,l-applikazzjoni għandha:(a) jkollha d-dokumenti relevanti u kull informazzjonirekwiżita oħra kif speċifikat u mitlub mill-AwtoritàKompetenti;(b) għandha tindika jekk l-applikazzjoni taqax taħt xiwieħed mill-kriterji (a) sa (d) tar-regolament 22; u(ċ) tintbgħat fil-mod kif preskritt mill-Awtorita’Kompetenti.Kundizzjonijiet lijkunu japplikaw.23. (1) Kull meta l-Awtorità Kompetenti toħroġ permess,hija għandha timponi dawk il-kundizzjonijiet li tqis li huma xierqa.(2) Il-perjodu ta’ validità ta’ permess bħal dak għandujiġi wkoll stabbilit għad-diskrezzjoni ta’ l-Awtorità Kompetenti, ugħandu jiġi indikat b’mod ċar fil-permess.(3) Kull meta l-Awtorità Kompetenti tirrifjuta permessbħal dak, hija għandha tinforma lill-applikant bir-raġunijiet għaldak ir-rifjut.(4) L-Awtorità Kompetenti tista’ temenda, tissospendijew tirrevoka kull permess jew awtorizzazjoni oħra għal attivitajietli huma relatati ma’ dawn ir-regolamenti, filwaqt li tagħti raġunijietgħad-deċiżjoni tagħha.(5) Permess maħruġ bis-saħħa ta’ dawn ir-regolamenti

The title of these regulations is the Trees and WoodlandsProtection Regulations, <strong>2011</strong>.Citation.PART I: INTERPRETATION AND ADMINISTRATION2. In these regulations, unless the context otherwiserequires:“the Act” means the Environment and DevelopmentPlanning Act;Definitions.Cap. 504.“compensatory planting measures” means the plantingor making available of a number of trees as a replacement forevery damaged or uprooted tree, on the basis of the provisionsof guidelines established by the Competent Authority;“the Competent Authority” means the MaltaEnvironment and Planning Authority;L.N. 57 of <strong>200</strong>2.“development” shall have the same meaning as assignedto it in article 67 of the Act;“Director” means the Director responsible forenvironment protection within the Competent Authority, orhis designated representative;


B 2592VERŻJONI ELETTRONIKA“horticulturally-grown trees” means plantedtrees that are grown through horticulture and in artificialenvironments such as agricultural land, private gardens,roadsides and paved areas, and excludes trees in protectedareas or in areas outside the development zone growing intheir natural environment, whether originally planted or not;“near any tree” means five metres away from thecircumference of the tree canopy or ten metres away from thetree trunk, whichever is the larger;“outside the development zone” or “ODZ” means landoutside the boundary for development in a planning schemeor local plan;“owner” means either the direct owner or any personwho holds a title of lease, emphyteusis or any other rightof possession, or both owner of property and title together,jointly or separately;“pest” means any form of plant or animal life or anypathogenic agent, other than a beneficial organism, capable ofdirectly or indirectly injuring any plant material or beneficialorganism, and includes genetically modified pests;“person” means any person, whether natural or legal,corporate or incorporate, and includes any person acting onhis own behalf or under the instructions of any employer,master or owner;“primary branches” means branches originating from themain trunk or trunks of the tree;“protected areas” means any area protected throughthe Environment Protection Act or scheduled for ecologicaland scientific reasons under the Development Planning Act,including Tree Protection Areas, or under the Act;“protected tree species” means trees listed in Schedules Iand II to these regulations;“pruning” means the practice of cutting away of primarybranches, secondary branches, offshoots, and suckers ofhorticulturally-grown trees to influence the formation of thetree or to positively influence flowering, fruit yield and, or theoverall health status of the tree;


VERŻJONI ELETTRONIKA“related environment regulations” means the Flora,Fauna and Natural Habitats Protection Regulations, <strong>200</strong>6, theProtection of Birds Regulations, <strong>200</strong>6 and any other relatedlegislation;B 2593L.N. 311 of <strong>200</strong>6L.N. 79 of <strong>200</strong>6.“secondary branches” means branches originating fromthe primary branches of the tree;“site” shall also include a single property or more thanone property, irrespective of who is the owner of that propertywhich forms part of the site which is designated as a TreeProtection Area through the provisions of regulation 6;“smoking requisite”, “cigarette” and “tobacco” have thesame definition as is given to them in article 2 of the Tobacco(Smoking Control) Act;Cap. 315.“surgical intervention” means any treatment requiredto save a tree from disease or mechanical damage, structuralcollapse, as well as treatments to prevent further damage inan already damaged tree;“tree” means a perennial woody plant, whether deador alive, which in its adult form, has a main trunk or trunks,and secondary branches supported clear of the ground, anda distinct crown. This includes individuals in all stages ofgrowth;“Tree Protection Area” means any site published in theGazette in terms of the provisions of regulation 6 of theseregulations;“Urban Conservation Area” or “UCA” means a historicarea (village core) as identified in a planning scheme or localplan or other currently approved planning policies.3. The Competent Authority shall be responsible forthe administration, implementation and enforcement of theseregulations.Administration ofthese regulations.

Without prejudice to the related environment regulationsand provisions of Government Notice No. 269 of the 19thJuly, 1933 about a list of historical trees having an antiquarianimportance, the Conifer Trees (Preservation) Regulations, 1949published by Government Notice No. 328 of the 25th May, 1949,and tree preservation orders issued under Development PlanningAct, it is hereby declared that: —(a) the species of trees listed in Schedule I to theseregulations are protected in accordance with the terms andconditions set out in the said Schedule I;(b) the trees listed in Schedule II to these regulationsare protected in accordance with the terms and conditions setout in the said Schedule II; and(c) all trees sited in the Tree Protection Areas or otherprotected areas are protected, except trees listed in ScheduleIII.Criteria for selectionof important sites.5. The Competent Authority shall compile and whereappropriate update a list of important sites that:(a) contain representative types of Maltese woodlandcommunities; or(b) contain woodland and forest communitieswhich are in danger of disappearing in their natural area ofdistribution; or(c) contain woodland and forest communities whichhave a reduced natural area of distribution as a consequenceof their natural or man-induced regression or on account oftheir intrinsically restricted area; or(d) contain woodland habitats critical to the survival,reproduction and recovery of endangered, threatened orendemic species of flora or fauna; or(e) contain a single individual tree or a specifiedgroup of trees or a woodland of aesthetic, historical, cultural,arboricultural, scientific, educational or landscape interest; or


VERŻJONI ELETTRONIKAB 2595(f) include trees that in the Competent Authority’sopinion are prominent landmark trees of particular relevanceto the character of the site; or(g) contain rare, threatened or endangered tree specieswith a restricted distribution in Malta; or(h) are woodland and forest communities ofparticular importance because of their scientific, ecological,biodiversity, biogeographical, scientific, cultural or landscapeor educational interest; or(i) contain historical trees having an antiquarianimportance listed in Government Notice No. 269 of the 19thJuly, 1933; or(j) contain ex-situ live collections of rare, threatenedor endangered trees; or(k) in the Competent Authority’s opinion containsimilarly relevant features for protection that are not listedabove.6. (1) Once a site has been selected by the CompetentAuthority in line with the criteria established in regulation 5 hereof,the Competent Authority shall designate any such site as a TreeProtection Area.(2) The Competent Authority shall publish the detailsof such site or sites, with delineated boundaries, in the Gazette.Identification of TreeProtection Areas.Declaration of TreeProtection Areas.(3) Any such designated Tree Protection Area shall beconsidered a protected area in terms of the Act and the EnvironmentProtection Act and shall be subject to these regulations.(4) Any site protected as a Tree Protection Area shallremain protected notwithstanding any deliberate or accidentalcircumstance whereby:(a) any tree sited in any such protected area is, whollyor in part, destroyed or dies; or(b) any other impact is suffered by the site.


B 2596Integration into theNational EcologicalNetwork.L.N. 311 of <strong>200</strong>6.Registered index.VERŻJONI ELETTRONIKA(5) Any Tree Protection Area declared throughthese regulations shall also form an integral part of the NationalEcological Network set up by regulation 5(1) of the Flora, Faunaand Natural Habitats (Protection) Regulations, <strong>200</strong>6, and is subjectto the other provisions of regulation 5 of the said regulations.7. The Tree Protection Areas identified and protectedpursuant to the provisions of regulation 6 hereof, shall be registeredin an index held for that purpose, and in the public registry. Thesaid index shall be held in an electronic form in such manner thatresearch to determine the status of a site may be carried out.PART III: TREE SPECIES CAUSING DAMAGE TOBIODIVERSITY OR TO THE NATURAL ENVIRONMENTIN GENERALList of treespecies damagingbiodiversity.Improvementmeasures.8. (1) The trees listed in Schedule III to these regulationsare deemed to be species causing damage to biological diversityof trees or woodlands in Malta, or to the natural environment ingeneral.(2) No person shall propagate, sow, plant, import,export, transport, sell or exchange any species listed in ScheduleIII to these regulations, unless duly authorised in line with theprovisions of Part VI hereof.9. (1) (a) The Competent Authority may, within suchtime as it determines, order any person responsible for the landin which any tree listed in Schedule III to these regulations issited to remove, uproot, kill or destroy any such tree, where suchremoval would, in the Competent Authority’s opinion, constitutean environmental improvement.(b) A method statement may be issued by theCompetent Authority to ensure that such order is executedwith minimal damage to biodiversity.(2) If such person mentioned in the previous provisionfails to comply with any such order, the Competent Authority mayremove, uproot, kill or destroy any such tree at the expense of thesaid person.(3) If the person responsible for the land upon whichsuch tree is sited is unknown, the Competent Authority may publishsuch order in the Gazette and remove such a tree at its own expenseafter ninety days from the publication of the order.

The Competent Authority may stop the transportand importation of trees which in its opinion may endangerthe biological diversity of trees or woodlands in Malta, or bedetrimental in any way to the environment, or for any other reasonin the national interest.B 2597Staying of importationof trees.PART IV: REGULATION OF ACTIVITIES11. No person shall carry out or attempt to carry out anyaction, which, in the opinion of the Competent Authority maybe damaging to any tree listed in Schedules I and II to theseregulations, and, or to the biological diversity of any tree orwoodland community protected in a Tree Protection Area or anyother protected area, except for trees of species listed in ScheduleIII.12. No person shall fell or attempt to fell, cut or attempt tocut, strip off or attempt to strip off the bark or leaves of, uproot orattempt to uproot, remove or attempt to remove timber from, affixor attempt to affix something to, or in any way destroy or attemptto destroy, damage or attempt to damage, any tree or part thereoflisted in Schedule I or Schedule II or any tree or part thereof sitedin a Tree Protection Area or any other protected area, except treesof species listed in Schedule III, except by permission of theCompetent Authority:Protection ofbiodiversity.Prohibited activities.Provided that the cutting off of leaves does not applyto trees listed in Schedule II.13. The provisions of regulation 12 shall not apply withrespect to:Non-Applicability ofregulation 12.(a) the pruning of horticulturally-grown trees listedin Schedule I or Schedule II, including any horticulturallygrowntrees situated in a Tree Protection Area or any otherprotected area, for the specific reason of preventing furtherdamage in an already damaged tree and to enhance its overallhealth;(b) the pruning of horticulturally-grown trees listedin Schedule II, including any horticulturally-grown treessituated in a Tree Protection Area or any other protectedarea, to control growth for the specific reasons of preservingits strength, improving its overall health, improving its fruitproductivity or avoiding likely injury to persons or likelydamage to property;


B 2598VERŻJONI ELETTRONIKA(c) the pruning of horticulturally-grown trees listed inSchedule I or Schedule II, or any horticulturally-grown treesited in a Tree Protection Area or any other protected area, tocontrol growth for the specific reason of avoiding the likelyintroduction of rodent pests within a property:Provided that any primary branch, secondarybranch or offshoot to be pruned must lie withinthree metres from the walls of the building requiringprotection from the introduction of the said rodent pests;(d) the removal and uprooting of any olive groves andcarob groves planted after the last day of December 1998for harvesting purposes and other agricultural purpose. Thisexcludes trees found in Tree Protection Areas, any trees ofmore than fifty years of age, and trees planted for the purposeof landscaping as prescribed by a development permit;L.N. 97 of <strong>200</strong>4.(e) the cutting, felling, treatment and, or destructionof any tree that harbours quarantine pests and diseases aslisted in Annexes I and II of the Plant Quarantine (HarmfulOrganisms) Regulations, <strong>200</strong>4, after appropriate consultationwith the director responsible for plant health:Provided that the provisions of this regulation13 are without prejudice to regulation 11 of theseregulations or to any other law or regulation, provision,agreement, management plan, order, permit or licence orany condition or consent granted under any other law orregulation.Damaging substances14. (1) No person shall dump or attempt to dump, throwor attempt to throw, pour or attempt to pour, let fall or let reach orattempt to let fall or let reach biocide, defoliant, fertiliser, acid,alkali or other corrosive material, fuel or any other combustible orexplosive material, saline water, chemical or any other substancenear any tree listed in Schedule I or Schedule II or near any treesited in a Tree Protection Area or any protected area, which mayharm any such tree, save for uncontaminated fresh water forirrigation purposes and substances for the treatment of trees and ofarable land:Provided that in Tree Protection Areas, or wheresimilarly justified for conservation purposes, theCompetent Authority may prohibit such irrigation


VERŻJONI ELETTRONIKAB 2599or treatment if this would be in conflict with theconservation status of the trees in question or thebiodiversity of the area.(2) The Competent Authority may authorise the use ofsubstances prohibited in sub-regulation (1) or any other treatmentfor weeding or surgical interventions which may in its opinion berequired.15. No person shall place, attempt to place, or let be placedany tyre, rubber, polystyrene, paper, or any other combustible orexplosive material, near any tree listed in Schedule I or ScheduleII or near any tree sited in a Tree Protection Area or any protectedarea.16. No person shall bury in the ground or attempt to buryin the ground, dump or attempt to dump, or deposit or attemptto deposit any soil, manure, waste, rubbish, stones, rubble, scrapmetal or any refuse near any tree listed in Schedule I or ScheduleII or near any tree sited in a Tree Protection Area or any protectedarea, save for soil or substrate for the treatment of arable land,provided that the quantities of such substances are not detrimentalto the trees protected in terms of these regulations.17. (1) Any person who kindles or attempts to kindle a firenear any tree listed in Schedule I or Schedule II, or any protectedarea other than a Tree Protection Area, thereby causing damageas a result of imprudent or negligent use of smoking requisites,cigarettes or tobacco, fireworks or other combustible matter, oromits to take adequate precautions in connection therewith, shallbe guilty of an offence.Combustible orexplosive substancesBurying anddeposition of material.Fire.(2) No person shall kindle or attempt to kindle a firewithin a Tree Protection Area:(a) for entertainment purposes, including and notlimited to bonfires, barbecues, campfires and fireworks;(b) that causes damage as a result of imprudent ornegligent use of smoking requisites, cigarettes or tobacco,fireworks or other combustible matter, or omits to takeadequate precautions in connection therewith.


B 2600VERŻJONI ELETTRONIKA(3) The above provisions shall not apply to —(a) any person who kindles a fire which can becontrolled; or(b) a fire directly connected with or necessary to themanagement of the Tree Protection Area or other protectedarea in question, with the prior approval of the CompetentAuthority; or(c)dwelling:a controlled fire within the confines of a privateProvided that in all cases, the person shall still beliable for any direct, indirect or consequential damageto any tree listed in Schedule I or Schedule II, or to anyTree Protection Area or any other protected area. TheCompetent Authority may also take action in terms ofthese regulations if the person fails to keep the fire undercontrol as a result of negligence or malicious action.Grazing land.18. (1) No person shall allow or attempt to allow animalsto cause damage through grazing to any tree listed in Schedule I orSchedule II to these regulations.(2) No person shall allow or attempt to allow animalsto graze in any Tree Protection Area or other protected areas.(3) The owner of any animal that causes such damagemay be ordered to pay such compensation for the damage causedas the Court may direct. If an animal belongs to more than oneowner, all the owners may be ordered jointly and severally to paycompensation for the damage caused by such animal.

(1) Wherever a development, either individually orin combination with other plans or projects, is likely to have anadverse effect on any trees listed in Schedule I or Schedule II tothese regulations, the Competent Authority may:Supplementaryprovisions relatedto applicationsfor developmentpermissions.(a) refuse the application; or(b) impose appropriate permit conditions;(c) require amendments to, or relocation of, theproposed development; or(d) adopt a combination of the foregoing measures asmay be appropriate in the context of these regulations.(2) Wherever a development, either individually orin combination with other plans or projects, is likely to have anadverse effect on any Tree Protection Area or other protected areas,the Competent Authority may:(a) refuse the application; or(b) impose appropriate permit conditions(c) request an appropriate assessment of impacts; or(d) adopt a combination of the foregoing measures asmay be appropriate in the context of these regulations.(3) The provisions of this article shall apply inrespect of both outline development permit applications andfull development permit applications, and shall also apply indetermining a reconsideration or appeal under the provisions of theAct.(4) Development that is likely to have an adverse effecton any trees listed in Schedule I or Schedule II of these regulations,or on any Tree Protection Area or other protected areas, shall notbe permitted under a development order issued in terms of article63 of the Act or through an application for minor amendment of anexisting development permit.


B 2602VERŻJONI ELETTRONIKA(5) The provisions of article 77 of the Act shall applyin the event that any tree protected under these regulations issignificantly and adversely affected by a development permit issuedon the basis of incorrect, incomplete, misleading or fraudulentinformation contained in the relevant permit application. In suchevent, any related permit issued under these regulations shall alsobe null and void.PART VI: PERMITS UNDER THESE REGULATIONSPermits.20. Without prejudice to the provisions of these regulations,the Competent Authority may issue a permit prior to the carryingout of any activity regulated by these regulations:Provided that the Competent Authority shall not issuesuch a permit if, after considering the proposed activity, it isof the opinion that the activity is unjustified or that the adverseimpacts of the activity outweigh any possible benefits.Non-permissibleinterventions.21. Without prejudice to the related environmentregulations, no permit issued through these regulations shall permitinterventions that:(a) are already proposed in an application for a permit,notification, clearance or licence made under the EnvironmentProtection Act or the Development Planning Act or the Act,which is still being processed, amended, reconsidered orappealed in accordance with any of the aforementioned Acts;(b) would prejudice the merits of such processing,amendment, reconsideration or appeal;(c) would prejudice the merits of a request for anyclearance or licence required by the aforementioned Acts,or would prejudice the merits of an appeal from a decisionthereon; or(d) would prejudice any enforcement case, court case orother cases currently sub-judice.Application in writing.22. (1) The person requesting a permit for activitiesreferred to in regulation 21, hereinafter referred to as the applicant,shall submit in writing an application to the Competent Authorityprior to carrying out such activities.


VERŻJONI ELETTRONIKAB 2603(2) In order to enable the Competent Authority toadequately assess a request for permission, the application shall:(a) be accompanied by the relevant documents and anyother requisite information as specified and required by theCompetent Authority; and(b) indicate whether the application falls under anyone of the criteria listed in paragraphs (a) to (d) of regulation22; and(c) be submitted in the manner prescribed by theCompetent Authority.23. (1) Whenever the Competent Authority issues apermit, it shall impose such conditions as it may deem appropriate.Applicable conditions.(2) The period of validity of such permit shall also beestablished at the discretion of the Competent Authority, and shallbe clearly indicated in the permit.(3) Whenever the Competent Authority refuses suchpermission, it shall inform the applicant of the reasons for suchrefusal.(4) The Competent Authority may amend, suspendor revoke any permit or other authorisation for activities that arerelated to these regulations, giving reasons for its decision.(5) A permit granted under these regulations shallbe null and void in the event that any tree protected under theseregulations is significantly and adversely affected by a permitissued on the basis of incorrect, incomplete, misleading orfraudulent information contained in the relevant permit application.(6) The Competent Authority shall not issue or renewany permit if the applicant in question has infringed any of theterms, conditions, obligations or limitations of:(a) any other permit issued by the Competent Authorityunder these regulations;(b) any other permit issued by the Competent Authorityin relation to the site for which the permit is issued, whetherunder these regulations or otherwise; or


B 2604VERŻJONI ELETTRONIKA(c) any other permit issued through the relatedenvironment regulations.Compensatoryplanting measures.Permits concerningbona fide scientific oreducational studies.24. The Competent Authority shall apply compensatoryplanting measures for the permitted uprooting of trees listed inSchedule I or Schedule II, and of any tree sited in a Tree ProtectionArea or any other protected area.25. (1) In permits concerning bona fide scientific oreducational studies, and without prejudice to any other obligationsand conditions laid down by the Competent Authority, a permitholder shall be obliged to submit within a month from the expiry ofthe permit:(a) a detailed report of the activities undertaken;(b) the aim and what field of work or activity wascarried out;(c) the methodology employed;(d) the outcome and results achieved in connectionwith the permit; and(e) any other details as may be requested by theCompetent Authority in the permit.(2) A copy of any published results and otherpublications relevant to this permit shall reach the CompetentAuthority within three months from the date of publication.Emergency permits.Public register.26. The Director, may, on behalf of the CompetentAuthority, in cases of emergency or grave danger, issue atemporary permit for the carrying out of any activity regulated bythese regulations, and in so doing he may issue any such directivesand decisions he may deem appropriate.27. Details of persons, public entities and other institutionshaving been granted a permit in connection with these regulationstogether with the details of conditions imposed in such permissionsshall be recorded in an electronic register available for publicinspection.


VERŻJONI ELETTRONIKA28. During the execution of a permitted activity or operation,a copy of the permit shall be in the possession of any person who ison site during such activity or operation. This permit shall be madeavailable to any official of the Competent Authority and any dulyauthorised law enforcement official, including a Police or ArmedForces officer, Wardens and Environment Inspectors upon request.B 2605Person on site to holdcopy of permit.PART VII: PENALTIES29. (1) Any person who: —Penalties.(a) fails to comply with any provision of theseregulations, or with any order lawfully given in terms of anyprovision of these regulations, or(b) contravenes any restriction, prohibition orrequirement imposed by or under these regulations, or(c) acts in contravention of any provisions of theseregulations, or(d) conspires or attempts to conspire, aids or attemptsto aid, abets or attempts to abet, counsels or attempts tocounsel, procures or attempts to procure any other personto contravene the provisions of these regulations, or to failto comply with any such provision, including any orderlawfully given in terms of any provision of these regulations,or to contravene any restrictions, prohibitions or requirementimposed by or under the said regulations,shall be guilty of an offence against these regulations.(2) Any person who commits, or attempts to commitan offence against these regulations shall be liable:(a) on a first conviction relating to trees listed inSchedule I or trees sited in a Tree Protection Area or otherprotected areas except for those of species listed in ScheduleIII, to a fine (multa) of not less than €500 but not exceeding€2500 for each tree of less than ten years of age, with theexception of a first conviction in connection with regulation18, and to compensatory planting measures by way of civilliability;


B 2606VERŻJONI ELETTRONIKA(b) on a first conviction relating to trees listed inSchedule I or trees sited in a Tree Protection Area or otherprotected areas except for those of species listed in ScheduleIII, to a fine (multa) of not less than €1,250 but not exceeding€25,000 for each tree of more than ten years of age, with theexception of a first conviction in connection with regulation18, and to compensatory planting measures by way of civilliability;(c) on a first conviction relating to trees listed inSchedule II to these regulations to a fine (multa) of not lessthan €250 but not exceeding €2,500 for each tree of less thanten years of age, with the exception of a first conviction inconnection with regulation 18, and compensatory plantingmeasures by way of civil liability;(d) on a first conviction relating to trees listed inSchedule II to these regulations to a fine (multa) of not lessthan €350 but not exceeding €25,000 for each tree of morethan ten years of age, with the exception of a first convictionin connection with regulation 18, and compensatory plantingmeasures by way of civil liability;(e) on a first conviction relating to regulation 8 orregulation 10 of these regulations, to a fine of not less than€100 but not exceeding €500 for each tree;(f) on a first conviction relating to regulation 18, toa fine of not less than €50 but not exceeding €500 for eachtree;(g) on a second or subsequent conviction, to a fine(multa) of not less than €1,250 but not exceeding €50,000for every tree, or to imprisonment for a term not exceedingtwo years, or to both such fine and imprisonment.Remediation andmitigation expenses.(3) Any person found guilty of committing an offenceagainst these regulations shall be liable to all applicable penaltiesand compensatory planting measures by way of civil liability, andbe required to pay for:(a) the full expenses incurred for remedying to theCompetent Authority’s satisfaction the damage caused by thesaid infringement to the site, or to the conservation status ofthe tree species, or to both, as relevant;


VERŻJONI ELETTRONIKAB 2607(b) any other expense incurred or mitigation measuresrequired to remedy such doings, damage and infringement, orto contain or prevent more widespread impact; and(c) the liquidated value of any irreparable loss ordamage to the environment, biological diversity, landscape,natural heritage or cultural heritage, as may be relevant tothese regulations.(4) The Court shall order the offender to removethe causes of the offence and to undo anything which was donewithout a permit within a time sufficient for the purpose, but inany case not exceeding three months from the date of judgement,to be fixed by the Court; and, if the offender fails to comply withany such order within the time so fixed, he shall be liable to a fine(multa) of not less than €50 and not more than €150, as the Courtmay fix, for every day that the default continues after the expirationof the said time.(5) The provisions of article 23 and of sub-article (1)of article 30 of the Criminal Code shall, mutatis mutandis, applyto proceedings in respect of offences against these regulations,so however that the disqualification from holding or obtaining alicence, permit, clearance or authority shall in no case be for lessthan one year.Causes of damage.Cap. 9.(6) Notwithstanding the provisions of article 370of the Criminal Code, proceedings for an offence against theseregulations shall be taken before the Court of Magistrates (Malta)or the Court of Magistrates (Gozo), as the case may be, andshall be in accordance with the provisions of the Criminal Coderegulating the procedure before the said courts as courts of criminaljudicature.(7) Notwithstanding the provisions of the CriminalCode, the Attorney General shall always have a right of appeal tothe Court of Criminal Appeal from any judgement given by theCourt of Magistrates (Malta) or the Court of Magistrates (Gozo), inrespect of proceedings for any offence against these regulations.PART VIII: OTHER PROVISIONS30. The Trees and Woodlands (Protection) Regulations,<strong>200</strong>1 are hereby revoked.Revokes L.N. 12 of<strong>200</strong>1.
