ANNUAL SENATE BILL 2 SESSIONSDavid Bates <strong>of</strong> Range Road was just following up from what T. Case said, and to fully appreciate thedifference between the two articles. He noted that some <strong>of</strong> the petitioners came up and said a few wordsregarding them. Bates would like to hear from <strong>Town</strong> Council regarding the differences between the Articles.Attorney Campbell stated that it appeared to be targeted to the decision making process, however Article 19 ismore relative to the appearance and relevancy process before those boards. With the amendment to 18,pending review, he has less concern. Attorney Campbell fears that this Article encroaches the issue <strong>of</strong> who isa covered person. For an example, he chose Mr. Dubay who does work for the <strong>Town</strong> for free, he would beknown as a covered person. If he were to represent a client, he couldn’t do so in the future. AttorneyCampbell feels that that is wrong and the <strong>Town</strong> would be exposed to some liability issues.Moderator Griffin asked for a VOTE ON THE AMENDMENTS. VOTED IN THE AFFIRMATIVE.Discussion is now to the AMENDED Article.M. Sneider made a MOTION for an additional amendment and SECONDED by Selectman Breton.To read as follows:Prohibition Against Conflict <strong>of</strong> Interest.<strong>Town</strong> shall be defined as the <strong>Town</strong> <strong>of</strong> <strong>Windham</strong>.Covered Person shall be defined to include an elected <strong>Town</strong> <strong>of</strong>ficial, a non-elected <strong>Town</strong> <strong>of</strong>ficial, a <strong>Town</strong>employee, and any person or business (including the principals, partners, employees and owners <strong>of</strong> thebusiness) that have performed or are performing services pursuant to a contract or arrangement with or onbehalf <strong>of</strong> the <strong>Town</strong> whether or not the services were or are performed for compensation.Covered Period shall be defined as the time period during which the Covered Person serves or served as anelected town <strong>of</strong>ficial, non-elected town <strong>of</strong>ficial, town employee and/or person or business that performedservices under contract or arrangement with or on behalf <strong>of</strong> the <strong>Town</strong> and shall extend for a period <strong>of</strong> twoyears following the termination <strong>of</strong> any <strong>of</strong> the foregoing activities.A Covered Person shall not during the Covered Period:1. appear before any <strong>Town</strong> board as a principal, agent, attorney, representative or otherwise, on behalf<strong>of</strong> any person, business or entity; or,2. act as a principal, agent, attorney, representative or otherwise, on behalf <strong>of</strong> any person, business orentity for purposes <strong>of</strong> obtaining any permits, permissions, licenses, variances, grants, or approvalsfrom the <strong>Town</strong>.The provisions set forth above shall not prohibit a Covered Person from applying for or appearing before a<strong>Town</strong> board for purposes <strong>of</strong> obtaining a permit, permission, license, variance, grant, or approval from the<strong>Town</strong> with respect to the Covered Person’s personal residence. But, unless otherwise set forth below, it shallprohibit such conduct with respect to any business or entity in which the Covered Person has a legal and/orpecuniary interest.The provisions set forth above shall not prohibit a Covered Person from applying for real estate taxabatements with respect to a Covered Person’s real estate interests.A Covered Person shall not, with respect to a business or entity in which the Covered Person has an interest,be prohibited from applying for electrical permits, plumbing permits and such other permits or licenses issuedas part <strong>of</strong> and pursuant to the <strong>Town</strong>’s administrative function, but such Covered Person shall be prohibitedfrom bringing any matter regarding such business or entity before the Zoning Board <strong>of</strong> Adjustment, PlanningBoard, Board <strong>of</strong> Selectmen, or any <strong>Town</strong> Commission.2012 ANNUAL REPORTS 27 TOWN OF WINDHAM, NH
