Rev. 2009]<strong>Constitution</strong> <strong>of</strong> <strong>Kenya</strong> 83and“the Minister” means the Minister who is for the time beingresponsible for matters relating to citizenship <strong>of</strong> <strong>Kenya</strong>.(2) For the purposes <strong>of</strong> this Chapter, a person born aboard aregistered ship or aircraft, or aboard an unregistered ship or aircraft<strong>of</strong> the Government <strong>of</strong> any country, shall be deemed to have been bornin the place in which the ship or aircraft was registered or, as the casemay be, in that country.(3) A reference in this Chapter to the national status <strong>of</strong> the father<strong>of</strong> a person at the time <strong>of</strong> that person’s birth shall, in relation to a personborn after the death <strong>of</strong> his father, be construed as a reference to thenational status <strong>of</strong> the father at the time <strong>of</strong> the father’s death; and wherethat death occurred before 12 th December, 1963 and the birth occurredafter 11 th December, 1963 the national status that the father would havehad if he had died on 12 th December, 1963 shall be deemed to be hisnational status at the time <strong>of</strong> his death.CHAPTER VIIFINANCE99. (1) Subject to subsection (2), all revenues or other moneysraised or received for the purposes <strong>of</strong> the Government <strong>of</strong> <strong>Kenya</strong> shallbe paid into and form a Consolidated Fund from which no moneys shallbe withdrawn except as may be authorized by this <strong>Constitution</strong> or byan Act <strong>of</strong> Parliament (including an Appropriation Act) or by a vote onaccount passed by the National Assembly under section 101.Consolidated Fundand other funds <strong>of</strong>the Government <strong>of</strong><strong>Kenya</strong>.(2) Provision may be made by or under an Act <strong>of</strong> Parliamentfor any revenues or other moneys received for the purposes <strong>of</strong> theGovernment <strong>of</strong> <strong>Kenya</strong> to be paid into some public fund (other than theConsolidated Fund) established for a specific purpose, or to be retainedby the authority that received them for the purpose <strong>of</strong> defraying theexpenses <strong>of</strong> that authority, but no moneys shall be withdrawn from anysuch public fund unless the issue <strong>of</strong> those moneys has been authorizedby or under a law.(3) Where any moneys are charged by this <strong>Constitution</strong> or anyAct <strong>of</strong> Parliament upon the Consolidated Fund or any other public fund<strong>of</strong> the Government <strong>of</strong> <strong>Kenya</strong>, they shall be paid out <strong>of</strong> that fund by theGovernment <strong>of</strong> <strong>Kenya</strong> to the person or authority to whom payment isdue.
