82 Constitution of Kenya[Rev. 2009the specified date unless he has renounced his citizenship of that othercountry, taken the oath of allegiance and made and registered suchdeclaration of his intentions concerning residence as may be prescribedby or under an Act of Parliament.(5) For the purposes of this section, where, under the law of acountry other than Kenya, a person cannot renounce his citizenship ofthat other country, he need not make the renunciation but he may insteadbe required to make such declaration concerning that citizenship as maybe prescribed by or under an Act of Parliament.(6) In this section “the specified date” means –(a) in relation to a person to whom subsection (1) refers, thedate on which he attains the age of twenty-three years;(b)* in relation to a person to whom subsection (2) refers, 12 thDecember, 1965;(c) in relation to a person to whom subsection (3)(b) refers,the expiration of a period of two years commencing withthe date on which he acquired the citizenship of the countryother than Kenya; and(d) in relation to a person to whom subsection (4) refers, theexpiration of a period of three months after the date uponwhich he became a citizen of Kenya,or, in the case of a person of unsound mind, such later date as may beprescribed by or under an Act of Parliament.(7) Provision may be made by or under an Act of Parliament forextending beyond the specified date the period in which a person maymake a renunciation of citizenship, take an oath or make or register adeclaration for the purposes of this section, and, if provision is so made,that person shall not cease to be a citizen of Kenya upon the specifieddate but shall cease to be a citizen upon the expiration of the extendedperiod if he has not then made the renunciation, taken the oath or madeor registered the declaration, as the case may be.Interpretation.98. (1) In this Chapter -“the British Nationality Act, 1948” means the Act of that titleenacted by the Parliament of the United Kingdom;“British protected person” means a person who is a Britishprotected person for the purposes of the British Nationality Act, 1948;*See note at foot of page 70.
Rev. 2009]Constitution of Kenya 83and“the Minister” means the Minister who is for the time beingresponsible for matters relating to citizenship of Kenya.(2) For the purposes of this Chapter, a person born aboard aregistered ship or aircraft, or aboard an unregistered ship or aircraftof the Government of any country, shall be deemed to have been bornin the place in which the ship or aircraft was registered or, as the casemay be, in that country.(3) A reference in this Chapter to the national status of the fatherof a person at the time of that person’s birth shall, in relation to a personborn after the death of his father, be construed as a reference to thenational status of the father at the time of the father’s death; and wherethat death occurred before 12 th December, 1963 and the birth occurredafter 11 th December, 1963 the national status that the father would havehad if he had died on 12 th December, 1963 shall be deemed to be hisnational status at the time of his death.CHAPTER VIIFINANCE99. (1) Subject to subsection (2), all revenues or other moneysraised or received for the purposes of the Government of Kenya shallbe paid into and form a Consolidated Fund from which no moneys shallbe withdrawn except as may be authorized by this Constitution or byan Act of Parliament (including an Appropriation Act) or by a vote onaccount passed by the National Assembly under section 101.Consolidated Fundand other funds ofthe Government ofKenya.(2) Provision may be made by or under an Act of Parliamentfor any revenues or other moneys received for the purposes of theGovernment of Kenya to be paid into some public fund (other than theConsolidated Fund) established for a specific purpose, or to be retainedby the authority that received them for the purpose of defraying theexpenses of that authority, but no moneys shall be withdrawn from anysuch public fund unless the issue of those moneys has been authorizedby or under a law.(3) Where any moneys are charged by this Constitution or anyAct of Parliament upon the Consolidated Fund or any other public fundof the Government of Kenya, they shall be paid out of that fund by theGovernment of Kenya to the person or authority to whom payment isdue.
