76 Constitution of Kenya[Rev. 2009(2) A woman who, on 11 th December, 1963, has been married toa person -(a) who becomes a citizen of Kenya by virtue of section 87;or(b) who, having died before 12 th December, 1963, would, butfor his death, have become a citizen of Kenya by virtue ofthat section,shall be entitled, upon making application in such manneras may be prescribed by or under an Act of Parliament, tobe registered as a citizen of Kenya.(3) A woman who, on 11 th December, 1963, has been married to aperson who becomes, or would but for his death have become, entitledto be registered as a citizen of Kenya under subsection (1) or (5), butwhose marriage has been terminated by death or dissolution before 12 thDecember, 1963, or is so terminated on or after that date but before thatperson exercises his right to be registered as a citizen of Kenya undereither of those subsections, shall be entitled, upon making applicationbefore the specified date in such manner as may be prescribed by orunder an Act of Parliament, to be registered as a citizen of Kenya.(4) A person who, on 11 th December, 1963, is a citizen of theUnited Kingdom and Colonies or of the Republic of Ireland and is onthat day ordinarily and lawfully resident in Kenya (otherwise than underthe authority of a pass issued under the Immigration Act as then in forceand conferring on him the right to remain in Kenya only temporarily)shall be entitled, upon making application before the specified date insuch manner as may be prescribed by or under an Act of Parliament,to be registered as a citizen of Kenya:Provided that a person who has not attained the age of twenty-oneyears (other than a woman who is or has been married) may not himselfmake an application under this subsection, but an application may bemade on his behalf by his parent or guardian.(5) A person who, on 11 th December, 1963, is a citizen of theUnited Kingdom and Colonies -(a) having become such a citizen under the British NationalityAct, 1948 by virtue of his having been naturalized in Kenyaas a British subject before that Act came into force; or(b) having become such a citizen by virtue of his having beennaturalized or registered in Kenya under that Act,

Every person born in Kenya after 11 th December, 1963 shallbecome a citizen of Kenya if at the date of his birth one of his parentsis a citizen of Kenya; except that a person shall not become a citizen ofKenya by virtue of this section if at the date of his birth -Persons born inKenya after 11thDecember, 1963,6 of 1985, s. 2.(a) his father possesses immunity from suit and legal processas is accorded to the envoy of a foreign state accredited toKenya; or(b) his father is a citizen of a country with which Kenya is atwar and the birth occurs in a place then under occupationby that country.90. A person born outside Kenya after 11 th December, 1963 shallbecome a citizen of Kenya at the date of his birth if at that date hisfather is a citizen of Kenya.91. A woman who has been married to a citizen of Kenyashall be entitled, upon making application in such manner as maybe prescribed by or under an Act of Parliament, to be registered as acitizen of Kenya.92. (1) A person who, being a Commonwealth citizen or acitizen of a country in Africa to which this subsection applies, has beenPersons born outsideKenya after 11thDecember, 1963.Marriage to a Kenyacitizen.Persons eligible to beregistered as Kenyacitizens.
