(1) Except with his own consent, no person shall be hinderedin the enjoyment <strong>of</strong> his freedom <strong>of</strong> assembly and association, that is tosay, his right to assemble freely and associate with other persons andin particular to form or belong to trade unions or other associations forthe protection <strong>of</strong> his interests.Protection <strong>of</strong> freedom<strong>of</strong> assembly andassociation.(2) Nothing contained in or done under the authority <strong>of</strong> any lawshall be held to be inconsistent with or in contravention <strong>of</strong> this sectionto the extent that the law in question makes provision -(a) that is reasonably required in the interests <strong>of</strong> defence, publicsafety, public order, public morality or public health;(b) that is reasonably required for the purpose <strong>of</strong> protecting therights or freedoms <strong>of</strong> other persons;(c) that imposes restrictions upon public <strong>of</strong>ficers, members<strong>of</strong> a disciplined force, or persons in the service <strong>of</strong> a localgovernment authority; or(d) for the registration <strong>of</strong> trade unions and associations <strong>of</strong> tradeunions in a register established by or under any law, and forimposing reasonable conditions relating to the requirementsfor entry on such a register (including conditions as to theminimum number <strong>of</strong> persons necessary to constitute a tradeunion qualified for registration, or <strong>of</strong> members necessaryto constitute an association <strong>of</strong> trade unions qualified forregistration, and conditions whereby registration may berefused on the grounds that another trade union alreadyregistered or association <strong>of</strong> trade unions already registered,as the case may be, is sufficiently representative <strong>of</strong> the wholeor <strong>of</strong> a substantial proportion <strong>of</strong> the interests in respect <strong>of</strong>which registration <strong>of</strong> a trade union or association <strong>of</strong> tradeunions is sought),and except so far as that provision or, as the case may be, the thing doneunder the authority there<strong>of</strong> is shown not to be reasonably justifiable ina democratic society.81. (1) No citizen <strong>of</strong> <strong>Kenya</strong> shall be deprived <strong>of</strong> his freedom <strong>of</strong>movement, that is to say, the right to move freely throughout <strong>Kenya</strong>, theright to reside in any part <strong>of</strong> <strong>Kenya</strong>, the right to enter <strong>Kenya</strong>, the rightto leave <strong>Kenya</strong> and immunity from expulsion from <strong>Kenya</strong>.Protection <strong>of</strong> freedom<strong>of</strong> movement.
