66 Constitution of Kenya[Rev. 2009law shall be held to be inconsistent with or in contravention of thissection to the extent that the law in question makes provision which isreasonably required -(a) in the interests of defence, public safety, public order, publicmorality or public health; or(b) for the purpose of protecting the rights and freedoms ofother persons, including the right to observe and practise areligion without the unsolicited intervention of members ofanother religion,and except so far as that provision or, as the case may be, thething done under the authority thereof is shown not to bereasonably justifiable in a democratic society.(6) References in this section to a religion shall be construedas including references to a religious denomination, and cognateexpressions shall be construed accordingly.Protection of freedomof expression.79. (1) Except with his own consent, no person shall be hinderedin the enjoyment of his freedom of expression, that is to say, freedomto hold opinions without interference, freedom to receive ideas andinformation without interference, freedom to communicate ideas andinformation without interference (whether the communication be to thepublic generally or to any person or class of persons) and freedom frominterference with his correspondence.(2) Nothing contained in or done under the authority of any lawshall be held to be inconsistent with or in contravention of this sectionto the extent that the law in question makes provision -(a) that is reasonably required in the interests of defence, publicsafety, public order, public morality or public health;(b) that is reasonably required for the purpose of protectingthe reputations, rights and freedoms of other persons or theprivate lives of persons concerned in legal proceedings,preventing the disclosure of information received inconfidence, maintaining the authority and independence ofthe courts or regulating the technical administration or thetechnical operation of telephony, telegraphy, posts, wirelessbroadcasting or television; or(c) that imposes restrictions upon public officers or upon personsin the service of a local government authority, and except sofar as that provision or, as the case may be, the thing done

(1) Except with his own consent, no person shall be hinderedin the enjoyment of his freedom of assembly and association, that is tosay, his right to assemble freely and associate with other persons andin particular to form or belong to trade unions or other associations forthe protection of his interests.Protection of freedomof assembly andassociation.(2) Nothing contained in or done under the authority of any lawshall be held to be inconsistent with or in contravention of this sectionto the extent that the law in question makes provision -(a) that is reasonably required in the interests of defence, publicsafety, public order, public morality or public health;(b) that is reasonably required for the purpose of protecting therights or freedoms of other persons;(c) that imposes restrictions upon public officers, membersof a disciplined force, or persons in the service of a localgovernment authority; or(d) for the registration of trade unions and associations of tradeunions in a register established by or under any law, and forimposing reasonable conditions relating to the requirementsfor entry on such a register (including conditions as to theminimum number of persons necessary to constitute a tradeunion qualified for registration, or of members necessaryto constitute an association of trade unions qualified forregistration, and conditions whereby registration may berefused on the grounds that another trade union alreadyregistered or association of trade unions already registered,as the case may be, is sufficiently representative of the wholeor of a substantial proportion of the interests in respect ofwhich registration of a trade union or association of tradeunions is sought),and except so far as that provision or, as the case may be, the thing doneunder the authority thereof is shown not to be reasonably justifiable ina democratic society.81. (1) No citizen of Kenya shall be deprived of his freedom ofmovement, that is to say, the right to move freely throughout Kenya, theright to reside in any part of Kenya, the right to enter Kenya, the rightto leave Kenya and immunity from expulsion from Kenya.Protection of freedomof movement.
