14 <strong>Constitution</strong> <strong>of</strong> <strong>Kenya</strong>[Rev. 2009(5) Where the Speaker conveys a resolution <strong>of</strong> the Cabinet to theChief Justice under subsection (2) or (3), he shall forthwith notify theperson in respect <strong>of</strong> whom the question arises, and that person may,by writing delivered to the Speaker within two days <strong>of</strong> his being sonotified, nominate for appointment as members <strong>of</strong> the tribunal to beappointed by the Chief Justice under this section not more than twopersons qualified to be so appointed.(6) A certificate <strong>of</strong> the Chief Justice under this section shallbe conclusive for the purposes <strong>of</strong> this <strong>Constitution</strong>, and shall not bequestioned in any court.(7) At any time when the <strong>of</strong>fice <strong>of</strong> Speaker <strong>of</strong> the NationalAssembly is vacant or the holder <strong>of</strong> that <strong>of</strong>fice is unable for any reasonto exercise the functions vested in him by this section, those functionsmay be exercised by the Deputy Speaker <strong>of</strong> the Assembly.Salary andallowances <strong>of</strong>President.6 <strong>of</strong> 1992, s. 6.13. (1) The President shall receive such salary, allowanceand benefits as may be determined by a resolution <strong>of</strong> the NationalAssembly.(2) Where the President ceases to hold <strong>of</strong>fice, he shall be entitledto receive a pension, gratuity and other allowances together with suchother benefits and facilities, including adequate security, <strong>of</strong>fice, staffand travel allowances, as may be prescribed by or under an Act <strong>of</strong>Parliament.(3) The salary and allowances payable to the President and anypension or gratuity payable to him on retirement shall be a charge uponthe Consolidated Fund.(4) The salary, allowances and privileges <strong>of</strong> the President shallnot be varied to his disadvantage while he holds <strong>of</strong>fice.(5) The pension and allowances payable to the President who hasceased to hold <strong>of</strong>fice and the facilities and other benefits available tohim shall not be varied to his disadvantage during his lifetime.Protection <strong>of</strong>President in respect<strong>of</strong> legal proceedingsduring <strong>of</strong>fice14. (1) No criminal proceedings whatsoever shall be institutedor continued against the President while he holds <strong>of</strong>fice, or against anyperson while he is exercising the functions <strong>of</strong> the <strong>of</strong>fice <strong>of</strong> President.(2) No civil proceedings in which relief is claimed in respect <strong>of</strong>anything done or omitted to be done shall be instituted or continuedagainst the President while he holds <strong>of</strong>fice or against any person whilehe is exercising the functions <strong>of</strong> the <strong>of</strong>fice <strong>of</strong> President.
