RFP document for Independent Engineer for roads under Rewa Divisionappointed, the third arbitrator shall, at the request of eitherParty, be appointed by Secretary, the Indian Council ofArbitration, New Delhi.(c) If, in a dispute subject to Clause SC 8.2.1 (b ), one Party fails toappoint its arbitrator within thirty (30) days after the otherParty has appointed its arbitrator, the Party which hasnamed an arbitrator may apply to the Secretary, IndianCouncil of Arbitration, New Delhi, to appoint a solearbitrator for the matter in dispute, and the arbitrator appointedpursuant to such application shall be the sole arbitrator for thatdispute.8.2.2 Rules of ProcedureArbitration proceedings shall be conducted in accordance withprocedures of the Arbitration & Conciliation Act 1996, ofIndia .8.2.3 Substitute ArbitratorsIf for any reason an arbitrator is unable to perform his function, asubstitute shall be appointed in the same manner as the originalarbitrator.8.2.4 Qualifications of ArbitratorsThe sole arbitrator or the third arbitrator appointed pursuantto paragraphs (a) through (c) of Clause 8.2.1 hereof shall bean internationally/nationally recognized legal or technical expertwith extensive experience in relation to the matter in dispute.IV.
