INSTRUCTIONS TO TENDERERSFOR CONTRACT MANPOWER SUPPLY1. DefinitionsIn this tender document and associated documentation, the following termsshall be interpreted as follows:a) “EPFO” means Employees Provident Fund Organization.b) "The Supplier" mean the eligible Companies which bids or quotes therates for House Keeping as required on contract basis by the EmployeesProvident Fund Organization Regional Office Kandivali.c) "The Contract" means the agreement entered into between the successfultenderer and the EPFO as recorded in the DRAFT CONTRACT FORM signed by theparties, including all the attachments and appendices thereto, and alldocuments incorporated by reference therein;d) "The Contract Cost" means the amount payable to the successful tendererunder the contract for the full and proper performance of its contractualobligations;e) "House Keeping" means sweeping & mopping of closed premises, sweepingof open premises and cleaning of toilets and cleaning of window pane,fans, tube lights etc.f) “Comprehensive House Keeping” means house keeping with inclusion oflabour and material.g) "Services" means services (duties assigned) expected to be rendered bythe House Keeping provided and other obligations of the Supplier coveredunder the Contract.2. NATURE OF WORKi) The agency should start the work at 7.30 AM every day and complete thejob by 9.00 AM and thereafter where ever required.ii) All required material such as broom, mug, bucket, brush, supri, acid,phenoyl, chemical, shop, detergent, naphthalene, perfume ball, duster,map, scrubber etc shall be provided by the agency and shall be kept intheir custody for which EPFO Regional office, Mumbai-III, Kandivali is nothaving any responsibility.iii) In case of damage or loss of office property on account of anyact/negligence of employees of Housekeeping agency, the agency shall haveto bear the cost of repairs or replacement.iv) Sweeping of open Area in office premises and Staff quarters premisesand collect of waste materials and disposal of the same shall be done ondaily basis and as per instructions of the office authority from time totime.

v) Sweeping and mopping of closed area in office building and stair casein staff quarters including Cleaning of the floor area with wet floordusters and detergent, disinfectants etc once in the morning beforeopening of the office thereafter every 2 hours specifically in the area ofcorridor, stairs, etc.vi) Cleaning of toilets and urinals with detergent and disinfectant,deodorants, in the morning and again in the afternoon after recess hoursor as may be specified by the office authority.vii) Dusting of carpets, durries and vacuum cleaning of EDP and officerscabins on every Saturday.Viii) Spray of flit & Air freshener etc in the room for keeping the samefree from flies etc.ix) Alldiseasesthe workmen of the contractor shall be free from infectiousx) The persons engaged both men and women for the work should wearproper uniform with Identity Cards. The persons engaged for the works willnot be allowed to stay in the premises after completion of the work.xi) The workmen deputed to this office for Housekeeping services at notime shall claim to be EPFO employees and the Agency shall discharge allGovernment liabilities for these workmen.xii) All day to day work shall be supervised by supervisor nominated bythe Housekeeping Agency.4. TERMS OF PAYMENTThe EPFO Regional Office, Mumbai-III, Kandivali will pay only contractamount to the successful bidder after deducting TDS and he will beresponsible for observing labour laws and making other statutory paymentsas applicable.The Service charges will be the only income for the agency.Payment to be made monthly after submission of bills by the agency and itsscrutiny by the office.5. COST OF TENDER:The Tenderer shall bear all costs associated with the preparation andsubmission of its tender, and the EPFO Regional Office Kandivali will inno case be responsible or liable for these costs, regardless of theconduct or outcome of the tendering process.6. PRE QUALIFICATION CRITERIA:(a) The EPFO Regional Office, Mumbai-III Kandivali is looking for wellestablished and known agency in the field of House Keeping. Therefore, theagency shall be of Indian origin and a respectable outfit.

(b) The Tenderer shall have a minimum turnover of Rs.5 Lakhs from businessrelating to the House Keeping Services for the financial year 2009-2010 or2010-2011. Document in support of turnover must be enclosed with the bid.(c) Company should not have been blacklisted by any organization in India.(d) The company must be registered and complying under appropriate Actsand shall have the necessary permission of the competent authority. (EPF,ESI, Labour License, Service Tax, PAN of I.T., etc. copies in proof ofeach such compliance/permission as stated above must be enclosed with thetechnical bid.(e) Notwithstanding anything stated above, the EPFO Regional Office,Mumbai-III Kandivali reserves the right to assess the Tenderer’sFinancial, Technical and Manpower capability for performing the contract.7. OFFER VALIDITY PERIODThe tender offer must be valid for fifteen months from the last date ofsubmission of the tender and this validity period must be mentioned in thebid.8. CONTRACT PERIODThe contract, which will be finalized through this tender process, will bevalid for one year; however, this may be extended for another one year bythe EPFO Regional Office Kandivali on the same terms and condition asoffered initially.9. COMPLETENESS OF TENDER OFFERSThe Tenderer is expected to examine all instructions, forms, terms &conditions in the Tender Document. Failure to furnish information requiredas per the tender documents or submission of a tender offer notsubstantially responsive in every respect to the tender documents will beat the Tenderer's risk and may result in rejection of its tender offer.The tender offer is liable to be rejected out rightly without anyintimation to the Tenderer if complete information as called for in thetender document is not given therein, or if particulars asked for in theForms / Performa in the tender are not fully furnished or found false onscrutiny.10. EMD (EARNEST MONEY DEPOSIT)Tenderers are required to give a Bank Guarantee of the amount of Rs.50,000/- (Fifty Thousand) valid till the date of validity of the contractas Earnest Money Deposit along with their offer. This bank guarantee mustbe submitted in the format specified in Bid Security Form (BSF). Offers,made without EMD / Bid Security, will be rejected outright. The Bankguarantee must be in the name of the EPFO Regional Office, Mumbai-IIIKandivali drawn on any Scheduled Bank / Nationalized Bank / Foreign Bankpayable at Kandivali Mumbai.EMD / Bid Security of Unsuccessful Tenderers will be discharged / returnedwithin 30 days from finalization of the contract.EMD / Bid Security of the successful Tenderers will be discharged onexecuting the Contract and furnishing the Security Deposit.

The documentary evidence of the Tenderer's qualifications to performthe Contract,shall establish to the EPFO Regional Office Kandivalisatisfaction that the Tenderer is eligible as per the criteriaoutlined in the Pre Qualification Criteria above. This includes thefollowing:a) Details of Tenderer,s (Annexure B) registration from theconcerned statutory authorities as per prequalification criteria.b) Performance Statement (Annexure C)vi) Power of Attorney in favour of the person signing the bids.13. ENVELOPE-II (COMMERCIAL OFFER):ENVELOPE -II: The Commercial Offer must be given in a sealed envelope. Itmust give all the relevant price information and shall not contradict thetechnical offer in any manner.i. Tender Reference Numberii. Commercial Envelope for itemTenderer shall submit their rates only in the Bid Form (Annexure -D) givenin the tender. Price quoted other than the bid form shall be liable to berejected. The Bid Form must be filled in completely, without any errors,erasures or alterations.14. ERASURES OR ALTERATIONS AND SIGNING OF TENDER OFFERSThe Tender Offer shall be typed or written in ink and shall be signed bythe Tenderer or a person or persons duly authorized in writing to bind theTenderer to the Contract. Such authorization shall be indicated by powerof-attorneyaccompanying the tender offer. All pages of the Tender Offershall be initialed by the person or persons signing the Tender Offer.The Tender Offer shall contain no interlineations, erasures or overwritingexcept as necessary to correct errors made by the Tenderer, in that casesuch corrections shall be initialed by the person or persons signing theoffer.15. COSTS & CURRENCYThe offer must be given in Indian Rupees only.16. SUBMISSION OF TENDER OFFERSSealed Tender offers shall be received by the EPFO Regional Office,Mumbai-III, Kandivali at the address specified above not later than thetime and date specified in the invitation for Tender offers. In the eventof the specified date for the submission of tender offers being declared aholiday, the offers will be received up to the appointed time on the nextworking day.The EPFO Regional Office, Mumbai-III, Kandivali may, at its discretion,extend this deadline for submission of offers by amending the TenderDocuments. In that case all rights and obligations of the EPFO RegionalOffice, Mumbai-III Kandivali and tender previously subject to the deadlinewill thereafter be subject to the deadline as extended. LATE TENDER OFFERSAny tender offer received by the EPFO Regional Office, Mumbai-III,Kandivali after the deadline prescribed for submission of the same,pursuant to the clause above, will not be entertained.

18. MODIFICATION AND WITHDRAWAL OF OFFERSThe Tenderer may modify or withdraw his offer after its submission,provided that written notice of the modification or withdrawal is receivedby the EPFO Regional Office, Mumbai-III Kandivali prior to the closingdate and time prescribed for submission of offers. No offer can bemodified by the Tenderer, subsequent to the closing date and time forsubmission of offers.19. PRELIMINARY SCRUTINYPrior to the detailed evaluation, the EPFO Regional Office, Mumbai-IIIKandivali will determine the substantial responsiveness of each offer tothe tender documents. For purpose of this Clause, a substantiallyresponsive bid is one, which is in conformity with all the terms andconditions of the Tender Documents without any material deviations. TheEPFO Regional Office, Mumbai-III Kandivali determination of an offer’sresponsiveness will be based on the contents of the tender offer itselfwithout recourse to extrinsic evidence.The EPFO Regional Office, Mumbai-III, Kandivali will scrutinize the offersin respect of their completeness, submission of technical documents dulysigned, etc. Only qualified Tenders will be considered for furtherprocess.The EPFO Regional Office Kandivali reserves the right to waive any minorinfirmity or irregularity in a tender offer, if it finds in the interestof the organisation. The request forsuch clarifications and the response shall be in writing. To speed up thetender process, the EPFO Regional Office, Mumbai-III Kandivali at itsdiscretion may ask for any technical clarification to be submitted bymeans of facsimile by the Tenderer. In such cases, original copy of thedocument describing the technical clarifications must be sent to the EPFORegional Office Mumbai-III Kandivali by means of courier / in person.21. SHORT-LISTING OF TENDERERSThe EPFO Regional Office Mumbai-III Kandivali will short-list onlytechnically qualified Tenders based on compliance of the qualificationcriteria (QCR), and the commercial offers of only such Tenderers will beopened.22. PRICE COMPARISONSThe EPFO Regional Office, Mumbai-III, Kandivali will evaluate afteropening the offers and if there exists any discrepancy between words andfigures, the amount indicated in words will be considered.23. AWARD CRITERIAi) The empanelment will be done to the Tenderer who’s Commercial Offer hasbeen determined to be the lowest evaluated offer and those Tenderers whoseevaluated Commercial Offers are within 10% of the lowest evaluated offer,provided they are willing to enter into the contract at the lowest rates.ii) However, it is the discretion of the EPFO Regional Office, Mumbai-IIIKandivali to choose suppliers to requisition, which cannot be challenged.

iii) Raising any objection by the supplier over the selection of thesupplier by the EPFO Regional Office Kandivali amounts to violation of theterms & conditions of the contract for which supplier will be liable forpenal and other actions within Kandivali Mumbai jurisdiction.23. RIGHT OF DECISION BY EPFO Regional Office, Mumbai-III,KandivaliThe EPFO Regional Office, Mumbai-III, Kandivali reserves the right toaccept or reject any tender offer, and to annul the tendering process andreject all tenders at any time prior to award of contract, without therebyincurring any liability towards the affected Tenderer(s) or any obligationto inform the affected Tenderer(s) on the grounds for the action taken bythe EPFO Regional Office Kandivali.24. NO COMMITMENT TO ACCEPT LOWEST OR ANY TENDERThe EPFO Regional Office, Mumbai-III, Kandivali shall be under noobligation to accept the lowest or any other offer receivedin response to this tender notice and shall be entitled to reject any orall offers, including those received late, or incomplete, withoutassigning any reason there for. The EPFO Regional Office, Mumbai-III,Kandivali reserves the right to make any changes in the terms andconditions.25. CORRUPT OR FRAUDULENT PRACTICESThe EPFO Regional Office, Mumbai-III Kandivali requires that the Tenderersunder this tender observe the highest standards of ethics during theprocurement and execution of such contracts. In pursuance of this policy,the EPFO Regional Office, Mumbai-III Kandivali defines the terms set forthas follows:i) “Corrupt practice” means the offering, giving, receiving or solicitingof anything of value to influence the action of the public official ingetting the contractii) Any document favoring Tenderer seen in the concerned file which hasnot been submitted officially and following the procedure, both theTenderer and the public official will be considered to be indulged intothe corrupt practice and fraudulence.iii) In the event of corrupt practice and fraudulence in addition to penalaction as per the terms and conditions of the contract as well as legalaction shall be initiated against the concerned.iv) “Fraudulent practice” means a misrepresentation of facts in order toinfluence execution of a contract to the detriment of the EPFO RegionalOffice Kandivali, and includes collusive practice among Tenderers (priorto or after bid submission) designed to establish bid prices at artificialnoncompetitive levels and to deprive the EPFO Regional Office Kandivali ofthe benefits of the free and open competition;v) The EPFO Regional Office, Mumbai-III Kandivali will reject a proposalfor award if it is prima-facie established that the Tenderer recommendedfor award has engaged in corrupt or fraudulent practices in competing forthe contract in question.vi) The EPFO Regional Office, Mumbai-III Kandivali will declare a Tendererineligible, either indefinitely or for a stated period of time, to beawarded a contract if at any time it is found that the Tenderer hasengaged in corrupt and fraudulent practices in competing for, or inexecuting, a contract.
