TENDER FORM(Instructions to Tenderers)1 Quotation must be enclosed in a properly sealed cover addressed to the MemberSecretary, HP Livestock Development Board, Pashudhan Bhawan, Shimla-5 bydesignation (and not by name). The quotations must be super scribed “Tender forCryogenic Storage Tank Vertical of 6000 Litrs. Capacity” as called for in tender noticein “______________ ” dated _______ . The quotations must reach the Office of MemberSecretary, HP Livestock Development Board, Pashudhan Bhawan, Shimla-171005 before2:00 PM of 12.02.2013 the date mentioned in the tender notice.2 In the event of the quotations being submitted by a firm it must be signed separately byeach member thereof or in the event of the absence of any partner it must be signed onhis behalf by a person holding a power of attorney authorizing him to do so, or in thecase of a company the quotations should be executed in the manner laid down in thesaid company’s articles of association. The signatures on the quotations shall be deemedto be authorized signature.3 All the columns of the quotations form shall be duly, properly and exhaustively filled in.The rates and units shall not be over written. Quotations shall always be both in thefigures and words the words “No Quotations” should be written across any or all of theitems in the schedule for which a tenderer does not wish to quote.4 Any omission in filling the columns of units and rates shall altogether debar a quotationfrom being considered.5 All corrections must be signed by the tenderers.6 Earnest money as indicated in terms & conditions must be deposited as Bank Draft/FDRof a Nationalized Bank in the favour of/pledged to Member Secretary, HP LivestockDevelopment Board, Shimla-5 and the same must accompany the tender form, withoutwhich it will not be considered. The said amount will be regarded as forfeitable to Boardif any successful tenderer fails within the time fixed by the Member Secretary, HPLivestock Development Board either to sign the contract on terms contained in theinvitation for tenders, its tender form and quotation form and condition of contractreferred in the invitation of tenders or to pay the additional security referred to in thenext clause below.7 The security may be paid in the form of the following:-Fixed Deposit Receipts duly pledged in the name Member Secretary, HP LivestockDevelopment Board, Shimla-5 from any scheduled bank are acceptable provided theseare countersigned by the State Bank of India, whereby the State Bank of Indiaundertakes full responsibility to indemnify this department, in case of default. Theabove deposits can also be accepted if these are countersigned by the Reserve Bank ofIndia advising this department that the Deposit Receipt may be accepted.8 The Member Secretary, HP Livestock Development Board, Pashudhan Bhawan, Shimla-5 will have the right of rejecting any or all of the quotations without assigning reasons.9 No tender will be considered unless and until all the documents are properly signed.

10 The quotation will be regarded as constituting an offer or offers open to acceptance onwhole or in part or parts at the discretion of Member Secretary, H.P. LivestockDevelopment Board up to ________ , however it can be extended.11 In the event of tender being accepted, the quotations will be converted into a contractwhich will be governed by the conditions given in Schedule “B” (Annexure) read withthese instructions.12 The Member Secretary, HP Livestock Development Board, Pashudhan Bhawan, Shimla-5 is authorized to debar any firms from future participation in the Purchase Programmeof the Store Purchase Organization and from having any such dealings withGovernment Department/Corporate body etc. in the State of Himachal Pradesh, whensuch firms quote rates in respect of various items of stores for which tenders are invitedby the Member Secretary, HP Livestock Development Board and are the lowest, butsuch firm decline to enter into rate contract.13 Income Tax and Sale Tax clearance certificates for the preceding year will be attached,failing which the tenders are liable to be rejected. Provided that the Governmentundertakings and such tenderers holding current valid registration, with the D.G.S. &D., and also Small Scale Industries units registered with the National Small IndustriesCorporation holding current valid registration certificate and also local industrial unitswho attach with the tender an attested copy of the permanent registration certificateissued by the General Manager, D.I.C. concerned, will be exempted from furnishingsuch Income Tax and Sales Tax clearance certificates.14 There will be no binding to purchase the items specified in the tender and whose ratesare being finalized.15 Any attempt at negotiation direct or indirect on the part of a tenderer with the authorityto whom he has submitted the tender or the authority who is competent finally to acceptit after he has submitted his tender or any endeavor to secure any interest for an actualor prospective tenderer or to influence by any means the acceptance of a particulartender will render the tender liable to exclusion from consideration.16 Legal disputes if any will be in the jurisdiction of Shimla Courts only.Read and accepted.Signature of the Tenderer

Schedule “B”TERMS AND CONDITIONSTender Forms alongwith specifications of the article(s) can be obtained fromOffice of the Member Secretary, HP Livestock Development Board, PashudhanBhawan, Shimla-5 on any working day between 10.00 AM to 5.00 PM either byhand after payment of Rs.2000/- in cash/Bank Draft or by Registered Post afterpayment of Rs. 2050/- in the form of Bank Draft which should be payable toMember Secretary, HPLDB, Shimla-5 at State Bank of India, Boileauganj , Shimla-5. Semen Bank Jeori, Chamba,Khaliar(Mandi), Ghanahatti (Shimla) and Tal (Hamirpur) in H.P.4 Quantity can be increased or decreased.5 Only Manufacturers or their distributors/agents/stockiest/authorizeddealers are entitled to submit their tenders. Offers by other firm than themanufacturers, must be accompanied authorizing them to quote rates andstanding guarantee for the satisfactory execution of supply orders failingwhich offers are liable to be ignored.6 All the tenderers are required to furnish users list of supplies of similar storeas per specifications demanded made by them along with documentary proofof performance, certificates from the users.7 The successful tenderers should supply the equipment immediately onreceipt of the supply order.8 In case, the lowest tenderers do not supply the material/equipment etc. thesecurity money would be required to be forfeited and the next lowesttenderer will be called.9 The conditional tenders will not be accepted.10. The Member Secretary, HP Livestock Development Board, PashudhanBhawan, Shimla-5 reserves the right of accepting or rejecting any or all thetenders without assigning any reasons thereof

The articles to be supplied under this contract will be the quality equal andanswerable in every respect to the specifications given in the listaccompanying with the tender and approved by the Member Secretary, HPLivestock Development Board, Pashudhan Bhawan, Shimla-5. The Contractorshall be responsible for all complaints as regard the quality. In case of disputeregarding quality of articles the decision of the Member Secretary, HPLivestock Development Board, Pashudhan Bhawan, Shimla-5 will be finaland binding on the contractor. It will be open to the Member Secretary, HPLivestock Development Board to send samples submitted by the tenderer/contractor to any laboratory for chemical analysis and the cost thereof willbe borne by the tenderer /contractor.12. The Contractor will be responsible for damage or loss in transit and replacegoods broken or lost within ten days from the date of notice thereof13. Unless otherwise specified in a requisition bills for the whole of the goodsreferred to in each indent in triplicate will be prepared and submitted by theContractor to the consignee for direct payment under intimation to theMember Secretary, HP Livestock Development Board, Pashudhan Bhawan,Shimla-5. The full amount will be verified as regards specification etc.14. The rates should be quoted inclusive of VAT.15. All the tenderers are required to submit the literature/catalogue ofequipments with the tender, failing which, the tender will not be considered.16. The payment will be released only after receiving the full equipment in goodconditions.17. Tender should be submitted in two separate envelops containing technicalbids and financial bids and both these envelopes should be contained insingle envelope. First, the envelope containing Technical bid alongwithEMD will be opened. The envelope containing financial bid shall beopened and finalized by the Departmental Purchase Committee in respectof only those firms whose technical bids are accepted as per technicalspecification recommended by the Technical Committee.18. All the tenderers are required to furnish user list of supplies of similar storemade by them along with documentary proof of rate and performance,certificates from the user.19. The tenders of only BIS marked products will be eligible and the tenderersquoting BIS marked products shall have to attach attested copy of the validBIS marking license.20. The Warranty period will be for two years from receipt of store article forreplacement / repair at their own cost.21. Manufacturers must be having an experience of manufacturing and sellingLiquid Nitrogen Containers of the demanded capacity for a minimum periodof five years in the Country.22. The Validity of Rate contract shall be for 365 days after the approval of therates which may be extended for another six months by the MemberSecretary, HPLDB if required.23. It will be binding on the part of the approved bidder to provide practicaltraining of its operation to nominated officer/Technician of the Departmentat bidders own cost till the attainment of proficiency in such operation.24. The successful tenderer will deposit 5% amount of the total amount ofexpected supply order as a security in the shape of FDR/Bank Guarantee ofany nationalized bank pledged in the name of Member Secretary, HPLivestock Development Board, Shimla- 5.Read and accepted.Signature of the Tenderer
