WReier-Aviles on DSKGBLS3C1PROD with RULES266962 Federal Register / Vol. 75, No. 209 / Friday, October 29, 2010 / Rules and Regulations(1) The information necessary for theSecretary to determine that the test theState uses measures a student’s skillsand abilities for the purpose <strong>of</strong>determining whether the student has theskills and abilities the State expects <strong>of</strong>a high school graduate in that State;(2) The passing scores on that test;(3) Any guidance on the interpretation<strong>of</strong> scores resulting from anymodifications <strong>of</strong> the test for individualswith disabilities;(4) A statement regarding how the testwill be kept secure;(5) A description <strong>of</strong> retestingprocedures and the analysis upon whichthe criteria for retesting are based;(6) Other evidence establishing thetest’s compliance with the criteria forapproval <strong>of</strong> tests as provided in§ 668.146;(7) A description <strong>of</strong> its testadministrator certification process thatprovides—(i) How the State will determine thatthe test administrator has the necessarytraining, knowledge, skill, and integrityto test students in accordance with theState’s requirements; and(ii) How the State will determine thatthe test administrator has the ability andfacilities to keep its test secure againstdisclosure or release;(8) A description <strong>of</strong> the test anomalyanalysis that the State will conduct andsubmit to the Secretary that includes—(i) An explanation <strong>of</strong> how the Statewill identify potential test irregularitiesand make a determination that testirregularities have occurred;(ii) An explanation <strong>of</strong> the process andprocedures for corrective action (up toand including decertification <strong>of</strong> a testadministrator) when the Statedetermines that test irregularities haveoccurred; and(iii) Information on when and how theState will notify a test administrator, theSecretary, and the institutions for whichthe test administrator had previouslyprovided testing services for that State,that the test administrator has beendecertified;(9)(i) An explanation <strong>of</strong> any accessibletechnologies that are available toaccommodate individuals withdisabilities; and(ii) A description <strong>of</strong> the process for atest administrator to identify and reportto the test publisher whenaccommodations for individuals withdisabilities were provided, for scoringand norming purposes; and(10) The name, address, telephonenumber, and e-mail address <strong>of</strong> a contactperson to whom the Secretary mayaddress inquiries.(11) A technical manual thatincludes—(i) An explanation <strong>of</strong> the methodologyand procedures for measuring thereliability <strong>of</strong> the test;(ii) Evidence that different forms <strong>of</strong>the test, including, if applicable, shortforms, are comparable in reliability;(iii) Other evidence demonstratingthat the test permits consistentassessment <strong>of</strong> individual skill andability;(iv) Evidence that the test was normedusing—(A) Groups that were <strong>of</strong> sufficient sizeto produce defensible standard errors <strong>of</strong>the mean and were notdisproportionately composed <strong>of</strong> anyrace or gender; and(B) A contemporary sample that isrepresentative <strong>of</strong> the population <strong>of</strong>persons who have earned a high schooldiploma in the United States;(v) Documentation <strong>of</strong> the level <strong>of</strong>difficulty <strong>of</strong> the test;(vi) Unambiguous scales and scalevalues so that standard errors <strong>of</strong>measurement can be used to determinestatistically significant differences inperformance; and(vii) Additional guidance on theinterpretation <strong>of</strong> scores resulting fromany modifications <strong>of</strong> the test forindividuals with temporaryimpairments, individuals withdisabilities and guidance on the types <strong>of</strong>accommodations that are allowable;(12) the manual provided to testadministrators containing proceduresand instructions for test security andadministration, and the forwarding <strong>of</strong>tests to the State.(Approved by the <strong>Office</strong> <strong>of</strong> Management andBudget under control number 1845–0049)(Authority: 20 U.S.C. 1091(d))§ 668.145 Test approval procedures.(a)(1) When the Secretary receives acomplete application from a testpublisher or a State, the Secretaryselects one or more experts in the field<strong>of</strong> educational testing and assessment,who possess appropriate advanceddegrees and experience in testdevelopment or psychometric research,to determine whether the test meets therequirements for test approval containedin §§ 668.146, 668.147, 668.148, or668.149, as appropriate, and to advisethe Secretary <strong>of</strong> their determinations.(2) If the test involves a languageother than English, the Secretary selectsat least one individual who is fluent inthe language in which the test is writtento collaborate with the testing expert orexperts described in paragraph (a)(1) <strong>of</strong>this section and to advise the Secretaryon whether the test meets the additionalcriteria, provisions, and conditions fortest approval contained in §§ 668.148and 668.149.VerDate Mar2010 14:10 Oct 28, 2010 Jkt 223001 PO 00000 Frm 00132 Fmt 4701 Sfmt 4700 E:\FR\FM\29OCR2.SGM 29OCR2(3) For test batteries that containmultiple sub-tests measuring contentdomains other than verbal andquantitative domains, the Secretaryreviews only those sub-tests coveringthe verbal and quantitative domains.(b)(1) If the Secretary determines thata test satisfies the criteria andrequirements for test approval, theSecretary notifies the test publisher orthe State, as applicable, <strong>of</strong> theSecretary’s decision, and publishes thename <strong>of</strong> the test and the passing scoresin the Federal Register.(2) If the Secretary determines that atest does not satisfy the criteria andrequirements for test approval, theSecretary notifies the test publisher orthe State, as applicable, <strong>of</strong> theSecretary’s decision, and the reasonswhy the test did not meet those criteriaand requirements.(3) If the Secretary determines that atest does not satisfy the criteria andrequirements for test approval, the testpublisher or the State that submitted thetest for approval may request that theSecretary reevaluate the Secretary’sdecision. Such a request must beaccompanied by—(i) Documentation and informationthat address the reasons for the nonapproval<strong>of</strong> the test; and(ii) An analysis <strong>of</strong> why theinformation and documentationsubmitted meet the criteria andrequirements for test approvalnotwithstanding the Secretary’s earlierdecision to the contrary.(c)(1) The Secretary approves a test fora period not to exceed five years fromthe date the notice <strong>of</strong> approval <strong>of</strong> thetest is published in the Federal Register.(2) The Secretary extends theapproval period <strong>of</strong> a test to include theperiod <strong>of</strong> review if the test publisher orthe State, as applicable, re-submits thetest for review and approval under§ 668.144 at least six months before thedate on which the test approval isscheduled to expire.(d)(1) The Secretary’s approval <strong>of</strong> atest may be revoked if the Secretarydetermines that the test publisher or theState violated any terms <strong>of</strong> theagreement described in § 668.150, thatthe information the test publisher or theState submitted as a basis for approval<strong>of</strong> the test was inaccurate, or that thetest publisher or the State substantiallychanged the test and did not resubmitthe test, as revised, for approval.(2) If the Secretary revokes approval<strong>of</strong> a previously approved test, theSecretary publishes a notice <strong>of</strong> thatrevocation in the Federal Register. Therevocation becomes effective—
Federal Register / Vol. 75, No. 209 / Friday, October 29, 2010 / Rules and Regulations66963WReier-Aviles on DSKGBLS3C1PROD with RULES2(i) One hundred and twenty days fromthe date the notice <strong>of</strong> revocation ispublished in the Federal Register; or(ii) An earlier date specified by theSecretary in a notice published in theFederal Register.(Approved by the <strong>Office</strong> <strong>of</strong> Management andBudget under control number 1845–0049)(Authority: 20 U.S.C. 1091(d))§ 668.146 Criteria for approving tests.(a) Except as provided in § 668.148,the Secretary approves a test under thissubpart if—(1) The test meets the criteria set forthin paragraph (b) <strong>of</strong> this section;(2) The test publisher or the Statesatisfies the requirements set forth inparagraph (c) <strong>of</strong> this section; and(3) The Secretary makes adetermination that the information thetest publisher or State submitted inaccordance with § 668.144(c)(17) or(d)(8), as applicable, provides adequateassurance that the test publisher or Statewill conduct rigorous test anomalyanalyses and take appropriate action iftest administrators do not comply withtesting procedures.(b) To be approved under this subpart,a test must—(1) Assess secondary school levelbasic verbal and quantitative skills andgeneral learned abilities;(2) Sample the major content domains<strong>of</strong> secondary school level verbal andquantitative skills with sufficientnumbers <strong>of</strong> questions to—(i) Adequately represent each domain;and(ii) Permit meaningful analyses <strong>of</strong>item-level performance by students whoare representative <strong>of</strong> the contemporarypopulation beyond the age <strong>of</strong>compulsory school attendance and haveearned a high school diploma;(3) Require appropriate test-takingtime to permit adequate sampling <strong>of</strong> themajor content domains described inparagraph (b)(2) <strong>of</strong> this section;(4) Have all forms (including shortforms) comparable in reliability;(5) Have, in the case <strong>of</strong> a test that isrevised, new scales, scale values, andscores that are demonstrablycomparable to the old scales, scalevalues, and scores;(6) Meet all standards for testconstruction provided in the 1999edition <strong>of</strong> the Standards for <strong>Education</strong>aland Psychological Testing, prepared bya joint committee <strong>of</strong> the American<strong>Education</strong>al Research Association, theAmerican Psychological Association,and the National Council onMeasurement in <strong>Education</strong> incorporatedby reference in this section.Incorporation by reference <strong>of</strong> thisdocument has been approved by theDirector <strong>of</strong> the <strong>Office</strong> <strong>of</strong> the FederalRegister pursuant to the Director’sauthority under 5 U.S.C. 552(a) and 1CFR part 51. The document alsomay be obtained from the American<strong>Education</strong>al Research Association at:http://www.aera.net; and(7) Have the test publisher’s or theState’s guidelines for retesting,including time between test-taking, bebased on empirical analyses that arepart <strong>of</strong> the studies <strong>of</strong> test reliability.(c) In order for a test to be approvedunder this subpart, a test publisher or aState must—(1) Include in the test booklet orpackage—(i) Clear, specific, and completeinstructions for test administration,including information for test takers onthe purpose, timing, and scoring <strong>of</strong> thetest; and(ii) Sample questions representative <strong>of</strong>the content and average difficulty <strong>of</strong> thetest;(2) Have two or more secure, equated,alternate forms <strong>of</strong> the test;(3) Except as provided in §§ 668.148and 668.149, provide tables <strong>of</strong>distributions <strong>of</strong> test scores which clearlyindicate the mean score and standarddeviation for high school graduates whohave taken the test within three yearsprior to the date that the test issubmitted to the Secretary for approvalunder § 668.144;(4) Norm the test with—(i) Groups that are <strong>of</strong> sufficient size toproduce defensible standard errors <strong>of</strong>the mean and are not disproportionatelycomposed <strong>of</strong> any race or gender; and(ii) A contemporary sample that isrepresentative <strong>of</strong> the population <strong>of</strong>persons who have earned a high schooldiploma in the United States; and(5) If test batteries include sub-testsassessing different verbal and/orquantitative skills, a distribution <strong>of</strong> testscores as described in paragraph (c)(3)<strong>of</strong> this section that allows the Secretaryto prescribe either—(i) A passing score for each sub-test;or(ii) One composite passing score forverbal skills and one composite passingscore for quantitative skills.VerDate Mar2010 14:10 Oct 28, 2010 Jkt 223001 PO 00000 Frm 00133 Fmt 4701 Sfmt 4700 E:\FR\FM\29OCR2.SGM 29OCR2(Approved by the <strong>Office</strong> <strong>of</strong> Management andBudget under control number 1845–0049)(Authority: 20 U.S.C. 1091(d))§ 668.147 Passing scores.Except as provided in §§ 668.144(d),668.148, and 668.149, to demonstratethat a test taker has the ability to benefitfrom the education and training <strong>of</strong>feredby the institution, the Secretaryspecifies that the passing score on eachapproved test is one standard deviationbelow the mean score <strong>of</strong> a sample <strong>of</strong>individuals who have taken the testwithin the three years before the test issubmitted to the Secretary for approval.The sample must be representative <strong>of</strong>the population <strong>of</strong> high school graduatesin the United States.(Authority: 20 U.S.C. 1091(d))§ 668.148 Additional criteria for theapproval <strong>of</strong> certain tests.(a) In addition to satisfying the criteriain § 668.146, to be approved by theSecretary, a test must meet the followingcriteria, if applicable:(1) In the case <strong>of</strong> a test developed fora non-native speaker <strong>of</strong> English who isenrolled in a program that is taught inhis or her native language, the test mustbe—(i) Linguistically accurate andculturally sensitive to the population forwhich the test is designed, regardless <strong>of</strong>the language in which the test iswritten;(ii) Supported by documentationdetailing the development <strong>of</strong> normativedata;(iii) If translated from an Englishversion, supported by documentation <strong>of</strong>procedures to determine its reliabilityand validity with reference to thepopulation for which the translated testwas designed;(iv) Developed in accordance withguidelines provided in the 1999 edition<strong>of</strong> the ‘‘Testing Individuals <strong>of</strong> DiverseLinguistic Backgrounds’’ section <strong>of</strong> theStandards for <strong>Education</strong>al andPsychological Testing prepared by ajoint committee <strong>of</strong> the American<strong>Education</strong>al Research Association, theAmerican Psychological Association,and the National Council onMeasurement in <strong>Education</strong> incorporatedby reference in this section.Incorporation by reference <strong>of</strong> thisdocument has been approved by theDirector <strong>of</strong> the <strong>Office</strong> <strong>of</strong> the FederalRegister pursuant to the Director’sauthority under 5 U.S.C. 552(a) and 1CFR part 51.
