Specification <strong>of</strong>Passing Score; Approval <strong>of</strong> StateProcess§ 668.141 Scope.(a) This subpart sets forth theprovisions under which a student whohas neither a high school diploma norits recognized equivalent may becomeeligible to receive title IV, HEA programfunds by—(1) Achieving a passing score,specified by the Secretary, on anindependently administered testapproved by the Secretary under thissubpart; or(2) Being enrolled in an eligibleinstitution that participates in a Stateprocess approved by the Secretaryunder this subpart.(b) Under this subpart, the Secretarysets forth—(1) The procedures and criteria theSecretary uses to approve tests;(2) The basis on which the Secretaryspecifies a passing score on eachapproved test;(3) The procedures and conditionsunder which the Secretary determinesthat an approved test is independentlyadministered;(4) The information that a testpublisher or a State must submit, as part<strong>of</strong> its test submission, to explain themethodology it will use for the testanomaly studies as described in§ 668.144(c)(17) and (d)(8), asappropriate;(5) The requirements that a testpublisher or a State, as appropriate—(i) Have a process to identify andfollow up on test score irregularities;(ii) Take corrective action—up to andincluding decertification <strong>of</strong> testadministrators—if the test publisher orthe State determines that test scoreirregularities have occurred; and(iii) Report to the Secretary the names<strong>of</strong> any test administrators it decertifiesand any other action taken as a result <strong>of</strong>test score analyses; and(6) The procedures and conditionsunder which the Secretary determinesthat a State process demonstrates thatstudents in the process have the abilityto benefit from the education andtraining being <strong>of</strong>fered to them.(Authority: 20 U.S.C. 1091(d))§ 668.142 Special definitions.The following definitions apply tothis subpart:Assessment center: A facility that—(1) Is located at an eligible institutionthat provides two-year or four-yeardegrees or is a postsecondary vocationalinstitution;(2) Is responsible for gathering andevaluating information about individualstudents for multiple purposes,including appropriate course placement;(3) Is independent <strong>of</strong> the admissionsand financial aid processes at theinstitution at which it is located;(4) Is staffed by pr<strong>of</strong>essionally trainedpersonnel;(5) Uses test administrators toadminister tests approved by theSecretary under this subpart; and(6) Does not have as its primarypurpose the administration <strong>of</strong> ability tobenefit tests.VerDate Mar2010 14:10 Oct 28, 2010 Jkt 223001 PO 00000 Frm 00130 Fmt 4701 Sfmt 4700 E:\FR\FM\29OCR2.SGM 29OCR2ATB test irregularity: An irregularitythat results from an ATB test beingadministered in a manner that does notconform to the established rules for testadministration consistent with theprovisions <strong>of</strong> subpart J <strong>of</strong> part 668 andthe test administrator’s manual.Computer-based test: A test taken bya student on a computer and scored bya computer.General learned abilities: Cognitiveoperations, such as deductive reasoning,reading comprehension, or translationfrom graphic to numericalrepresentation, that may be learned inboth school and non-schoolenvironments.Independent test administrator: A testadministrator who administers tests at alocation other than an assessment centerand who—(1) Has no current or prior financialor ownership interest in the institution,its affiliates, or its parent corporation,other than the fees earned foradministering approved ATB teststhrough an agreement with the testpublisher or State and has nocontrolling interest in any otherinstitution;(2) Is not a current or formeremployee <strong>of</strong> or consultant to theinstitution, its affiliates, or its parentcorporation, a person in control <strong>of</strong>another institution, or a member <strong>of</strong> thefamily <strong>of</strong> any <strong>of</strong> these individuals;(3) Is not a current or former member<strong>of</strong> the board <strong>of</strong> directors, a current orformer employee <strong>of</strong> or a consultant to amember <strong>of</strong> the board <strong>of</strong> directors, chiefexecutive <strong>of</strong>ficer, chief financial <strong>of</strong>ficer<strong>of</strong> the institution, its affiliates, or itsparent corporation or <strong>of</strong> any otherinstitution, or a member <strong>of</strong> the family <strong>of</strong>any <strong>of</strong> these individuals; and(4) Is not a current or former student<strong>of</strong> the institution.Individual with a disability: A personwho has a physical or mentalimpairment which substantially limitsone or more major life activities, has arecord <strong>of</strong> such an impairment, or isregarded as having such an impairment.Non-native speaker <strong>of</strong> English: Aperson whose first language is notEnglish and who is not fluent inEnglish.Secondary school level: As applied to‘‘content,’’ ‘‘curricula,’’ or ‘‘basic verbaland quantitative skills,’’ the basicknowledge or skills generally learned inthe 9th through 12th grades in UnitedStates secondary schools.Test: A standardized test, assessmentor instrument that has formal protocolson how it is to be administered in orderto be valid. These protocols include, forexample, the use <strong>of</strong> parallel, equatedforms; testing conditions; time allowed

Tests may also includeadaptive instruments that usecomputerized algorithms for selectingand administering items in real time;however, for such instruments, the size<strong>of</strong> the item pool and the method <strong>of</strong> itemselection must ensure negligible overlapin items across retests.Test administrator: An individualwho is certified by the test publisher (orthe State, in the case <strong>of</strong> an approvedState test or assessment) to administertests approved under this subpart inaccordance with the instructionsprovided by the test publisher or theState, as applicable, which includesprotecting the test and the test resultsfrom improper disclosure or release, andwho is not compensated on the basis <strong>of</strong>test outcomes.Test item: A question on a test.Test publisher: An individual,organization, or agency that owns aregistered copyright <strong>of</strong> a test, or hasbeen authorized by the copyright holderto represent the copyright holder’sinterests regarding the test.(Authority: 20 U.S.C. 1091(d))§ 668.143 [Reserved]§ 668.144 Application for test approval.(a) The Secretary only reviews testsunder this subpart that are submitted bythe publisher <strong>of</strong> that test or by a State.(b) A test publisher or a State thatwishes to have its test approved by theSecretary under this subpart mustsubmit an application to the Secretary atsuch time and in such manner as theSecretary may prescribe. Theapplication must contain all theinformation necessary for the Secretaryto approve the test under this subpart,including but not limited to, theinformation contained in paragraph (c)or (d) <strong>of</strong> this section, as applicable.(c) A test publisher must include withits application—(1) A summary <strong>of</strong> the precise editions,forms, levels, and (if applicable) subtestsfor which approval is being sought;(2) The name, address, telephonenumber, and e-mail address <strong>of</strong> a contactperson to whom the Secretary mayaddress inquiries;(3) Each edition, form, level, and subtest<strong>of</strong> the test for which the testpublisher requests approval;(4) The distribution <strong>of</strong> test scores foreach edition, form, level, or sub-test forwhich approval is sought, that allowsthe Secretary to prescribe the passingscore for each test in accordance with§ 668.147;(5) Documentation <strong>of</strong> testdevelopment, including a history <strong>of</strong> thetest’s use;(6) Norming data and other evidenceused in determining the distribution <strong>of</strong>test scores;(7) Material that defines the contentdomains addressed by the test;(8) Documentation <strong>of</strong> periodic reviews<strong>of</strong> the content and specifications <strong>of</strong> thetest to ensure that the test reflectssecondary school level verbal andquantitative skills;(9) If a test being submitted is arevision <strong>of</strong> the most recent editionapproved by the Secretary, an analysis<strong>of</strong> the revisions, including the reasonsfor the revisions, the implications <strong>of</strong> therevisions for the comparability <strong>of</strong> scoreson the current test to scores on theprevious test, and data from validitystudies <strong>of</strong> the test undertakensubsequent to the revisions;(10) A description <strong>of</strong> the manner inwhich test-taking time was determinedin relation to the contentrepresentativeness requirements in§ 668.146(b)(3) and an analysis <strong>of</strong> theeffects <strong>of</strong> time on performance. Thisdescription may also include themanner in which test-taking time wasdetermined in relation to the otherrequirements in § 668.146(b);(11) A technical manual thatincludes—(i) An explanation <strong>of</strong> the methodologyand procedures for measuring thereliability <strong>of</strong> the test;(ii) Evidence that different forms <strong>of</strong>the test, including, if applicable, shortforms, are comparable in reliability;(iii) Other evidence demonstratingthat the test permits consistentassessment <strong>of</strong> individual skill andability;(iv) Evidence that the test was normedusing—(A) Groups that were <strong>of</strong> sufficient sizeto produce defensible standard errors <strong>of</strong>the mean and were notdisproportionately composed <strong>of</strong> anyrace or gender; and(B) A contemporary sample that isrepresentative <strong>of</strong> the population <strong>of</strong>persons who have earned a high schooldiploma in the United States;(v) Documentation <strong>of</strong> the level <strong>of</strong>difficulty <strong>of</strong> the test;(vi) Unambiguous scales and scalevalues so that standard errors <strong>of</strong>measurement can be used to determinestatistically significant differences inperformance; and(vii) Additional guidance on theinterpretation <strong>of</strong> scores resulting fromany modifications <strong>of</strong> the test forindividuals with temporaryVerDate Mar2010 14:10 Oct 28, 2010 Jkt 223001 PO 00000 Frm 00131 Fmt 4701 Sfmt 4700 E:\FR\FM\29OCR2.SGM 29OCR2impairments, individuals withdisabilities and guidance on the types <strong>of</strong>accommodations that are allowable;(12) The manual provided to testadministrators containing proceduresand instructions for test security andadministration, and the forwarding <strong>of</strong>tests to the test publisher;(13) An analysis <strong>of</strong> the item-content <strong>of</strong>each edition, form, level, and (ifapplicable) sub-test to demonstratecompliance with the required secondaryschool level criterion specified in§ 668.146(b);(14) A description <strong>of</strong> retestingprocedures and the analysis upon whichthe criteria for retesting are based;(15) Other evidence establishing thetest’s compliance with the criteria forapproval <strong>of</strong> tests as provided in§ 668.146;(16) A description <strong>of</strong> its testadministrator certification process thatprovides—(i) How the test publisher willdetermine that the test administrator hasthe necessary training, knowledge, skill,and integrity to test students inaccordance with this subpart and thetest publisher’s requirements; and(ii) How the test publisher willdetermine that the test administrator hasthe ability and facilities to keep its testsecure against disclosure or release;(17) A description <strong>of</strong> the test anomalyanalysis the test publisher will conductand submit to the Secretary thatincludes—(i) An explanation <strong>of</strong> how the testpublisher will identify potential testirregularities and make a determinationthat test irregularities have occurred;(ii) An explanation <strong>of</strong> the process andprocedures for corrective action (up toand including decertification <strong>of</strong> acertified test administrator) when thetest publisher determines that testirregularities have occurred; and(iii) Information on when and how thetest publisher will notify a testadministrator, the Secretary, and theinstitutions for which the testadministrator had previously providedtesting services for that test publisher,that the test administrator has beendecertified; and(18)(i) An explanation <strong>of</strong> anyaccessible technologies that areavailable to accommodate individualswith disabilities, and(ii) A description <strong>of</strong> the process for atest administrator to identify and reportto the test publisher whenaccommodations for individuals withdisabilities were provided, for scoringand norming purposes.(d) A State must include with itsapplication—
