Section 668.5 is amended by:■ A. Revising paragraph (a).■ B. Revising paragraph (c)(1).■ C. Adding new paragraph (e).The addition and revisions read asfollows:§ 668.5 Written arrangements to provideeducational programs.(a) Written arrangements betweeneligible institutions. (1) Except asprovided in paragraph (a)(2) <strong>of</strong> thissection, if an eligible institution entersinto a written arrangement with anothereligible institution, or with a consortium<strong>of</strong> eligible institutions, under which theother eligible institution or consortiumprovides part <strong>of</strong> the educationalprogram to students enrolled in the firstinstitution, the Secretary considers thateducational program to be an eligibleprogram if the educational program<strong>of</strong>fered by the institution that grants thedegree or certificate otherwise satisfiesthe requirements <strong>of</strong> § 668.8.(2) If the written arrangement isbetween two or more eligibleinstitutions that are owned or controlledby the same individual, partnership, orcorporation, the Secretary considers theeducational program to be an eligibleprogram if—(i) The educational program <strong>of</strong>feredby the institution that grants the degreeor certificate otherwise satisfies therequirements <strong>of</strong> § 668.8; and(ii) The institution that grants thedegree or certificate provides more than50 percent <strong>of</strong> the educational program.* * * * *(c) * * *(1) The ineligible institution ororganization has not—(i) Had its eligibility to participate inthe title IV, HEA programs terminatedby the Secretary;(ii) Voluntarily withdrawn fromparticipation in the title IV, HEAprograms under a termination, showcause,suspension, or similar typeproceeding initiated by the institution’sState licensing agency, accreditingagency, guarantor, or by the Secretary;VerDate Mar2010 14:10 Oct 28, 2010 Jkt 223001 PO 00000 Frm 00118 Fmt 4701 Sfmt 4700 E:\FR\FM\29OCR2.SGM 29OCR2(iii) Had its certification to participatein the title IV, HEA programs revokedby the Secretary;(iv) Had its application for recertificationto participate in the title IV,HEA programs denied by the Secretary;or(v) Had its application for certificationto participate in the title IV, HEAprograms denied by the Secretary;* * * * *(e) Information made available tostudents. If an institution enters into awritten arrangement described inparagraph (a), (b), or (c) <strong>of</strong> this section,the institution must provide theinformation described in § 668.43(a)(12)to enrolled and prospective students.* * * * *■ 14. Section 668.6 is added to subpartA to read as follows:§ 668.6 Reporting and disclosurerequirements for programs that preparestudents for gainful employment in arecognized occupation.(a) Reporting requirements. (1) Inaccordance with procedures establishedby the Secretary an institution mustreport information that includes—(i) For each student who enrolled ina program under § 668.8(c)(3) or (d)during an award year—(A) Information needed to identify thestudent and the institution the studentattended;(B) If the student began attending aprogram during the award year, thename and the Classification <strong>of</strong>Instructional Program (CIP) code <strong>of</strong> thatprogram; and(C) If the student completed aprogram during the award year—(1) The name and CIP code <strong>of</strong> thatprogram, and the date the studentcompleted the program;(2) The amounts the student receivedfrom private education loans and theamount from institutional financingplans that the student owes theinstitution upon completing theprogram; and(3) Whether the student matriculatedto a higher credentialed program at theinstitution or if available, evidence thatthe student transferred to a highercredentialed program at anotherinstitution; and(ii) For each program, by name andCIP code, <strong>of</strong>fered by the institutionunder § 668.8(c)(3) or (d), the totalnumber <strong>of</strong> students that are enrolled inthe program at the end <strong>of</strong> each awardyear and identifying information forthose students.(2)(i) An institution must report theinformation required under paragraph(a)(1) <strong>of</strong> this section—
