This regulatory section will require institutions to report for each student whoduring an award year began attending or completed a program that preparesa student for gainful employment information needed to identify the studentand the location <strong>of</strong> the institution the student attended, the CIP code for theprogram, the date the student completed the program, the amounts the studentreceived from private educational loans and the amount from institutionalfinancing plans that the student owes the institution after completingthe program, and whether the student matriculated to a higher credentialedprogram at the same institution or another institution. Institutions will have todisclose information to prospective students about the occupations (bynames and SOC codes) that its programs prepare students to enter, alongwith links to occupational pr<strong>of</strong>iles on O–NET or its successor site, or if thenumber <strong>of</strong> occupations related to the programs on O–Net is more than ten(10), the institution may provide Web links to a representative sample <strong>of</strong> theSOCs for which its graduates typically find employment within a few yearsafter completing the program. In addition, the institution will also have to reportthe on-time graduation rate for students entering the program; the totalamount <strong>of</strong> tuition and fees it charges a student for completing the programwithin the normal timeframe, the typical costs for books and supplies, and thetypical costs for room and board, if applicable. The institution may include informationon other costs, such as transportation and living expenses, but itmust provide a Web link, or access, to the program cost information the institutionmakes available under § 668.43(a). Beginning July 1, 2011, the institutionmust provide prospective students with the placement rate for studentscompleting the program, as determined by the institution’s accrediting agencyor State requirements, until NCES develops and makes available a newplacement rate, and the median loan debt incurred by students who completedthe program, as provided by the Secretary, as well as other informationthe Secretary provided to the institution about the program. Separately,the institution must identify the median loan dept from title IV, HEA programloans, and the median loan debt from private educational loan and institutionalfinancing plans.668.8 ....................... This regulatory section provides for a new conversion ratio when convertingclock hours to credit hours. As finalized, this section will include an exemptionfor affected institutions if the accrediting agency or the State approvalagency finds that there are no deficiencies in the institutions policies and proceduresfor these conversions. Under the exception, the institution will use alower ratio and could consider student’s outside work in the total hours beingconverted to credit hours. Burden will increase for proprietary, not-for pr<strong>of</strong>itand public institutions when they measure whether certain programs whenconverted from clock hours to credit hours have sufficient credit hours to receivetitle VI, HEA funds.668.16 ..................... This regulatory section will be streamlined by moving most <strong>of</strong> the elements <strong>of</strong>satisfactory academic progress (SAP) from this section to § 668.34. Underthis proposal, the required elements <strong>of</strong> SAP will be expanded to providegreater institutional flexibility. Burden will increase for proprietary, not-for pr<strong>of</strong>itand public institutions to develop a high school diploma validity processand will increase when certain diplomas are verified.668.22 ..................... This regulatory section will consider a student to have withdrawn if the studentdoes not complete all the days in the payment period or period <strong>of</strong> enrollmentthat the student was scheduled to complete prior to withdrawing. Burden willincrease for individuals, proprietary, not-for pr<strong>of</strong>it and public institutions whenstudents in term-based programs with modules or compressed courses withdrawbefore completing more than 60 percent <strong>of</strong> the payment period or period<strong>of</strong> enrollment for which a calculation will be performed to determine theearned and unearned portions <strong>of</strong> title IV, HEA program assistance.668.34 ..................... This regulatory section has been restructured and the satisfactory academicprogress requirements have been expanded to allow for more frequentmeasuring <strong>of</strong> SAP. This regulatory section will require that for institutions that enter into written arrangementswith other institutions to provide for a portion <strong>of</strong> its programs’training by the institution that is not providing the degree or certificate, the institutionproviding the degree or certificate must provide a variety <strong>of</strong> disclosuresto enrolled and prospective students about the written arrangements.Burden will increase for proprietary, not-for pr<strong>of</strong>it and public institutions for reportingthe details <strong>of</strong> written arrangements with other institutions <strong>of</strong>fering aportion <strong>of</strong> a student’s program <strong>of</strong> study.668.55 ..................... This regulatory provision will require that all updated applicant data informationas a result <strong>of</strong> verification be reported to the Secretary via the Central ProcessingSystem. This also will cover changes made as a result <strong>of</strong> a dependentstudent becoming married during the award year when a financial aid administratorexercises their discretion to require marital status change to addressan inequity or accurately reflect the student’s ability to pay, suchchange in status due to marriage had previously been prohibited.668.56 ..................... This regulation changes from the current five mandatory items included in theverification process to a more flexible list <strong>of</strong> items that will be selected on anindividualized basis. For example, there is no need to verify data that can beobtained directly from the IRS. Burden will increase for individuals; however,the average number <strong>of</strong> data elements to be verified is expected to be reduced.668.57 ..................... This final regulatory provision will modify the requirements related to acceptabledocumentation required as a part <strong>of</strong> the verification process. It will allow forthe importation <strong>of</strong> data obtained directly from the IRS that has been unchangedand will provide other flexibilities that will reduce burden; however,due to the large increase in applicants, there will be an overall increase inburden.668.59 ..................... This provision eliminates all allowable tolerances and will require an institutionto submit to the <strong>Department</strong> all changes to an applicant’s FAFSA as a result<strong>of</strong> verification. Burden will increase for proprietary, not-for pr<strong>of</strong>it and public institutionsthat will recalculate title IV, HEA awards as a result <strong>of</strong> datachanges due to verification.668.144 ................... This regulatory section expands the required elements that a test publisher or aState must submit to the Secretary for approval.668.150 ................... This provision expands the provisions <strong>of</strong> the agreement between the Secretaryand the ability to benefit test (ATB) publishers or a State. The expanded provisionsinclude requiring test administrators to certify that they have not beendecertified, notification requirements when a test administrator is decertified,and providing test anomaly studies every eighteen months rather than every36 months. Burden will increase for individuals, proprietary, not-for pr<strong>of</strong>it andpublic institutions for the collection and maintenance <strong>of</strong> certifications, for requirednotifications, and for submission <strong>of</strong> test anomaly studies.668.151 ................... This provision will require independent test administrators to submit completedtests for scoring to the test publisher or the State in no more than two businessdays following the test. Institutions will be required to maintain a record<strong>of</strong> each individual who takes an ATB test and information about the test administrator.When the test taker has a disability, it will be the institution’s responsibilityto maintain documentation <strong>of</strong> the individual’s disability and anyaccommodation provided the individual.668.152 ................... This provision will require that test assessment centers provide either copies <strong>of</strong>the completed tests or lists <strong>of</strong> the test takers’ scores, including the test administrator’sname, address, and any other test administrator identifier to thetest publisher or State, as applicable, on a weekly basis.668.164 ................... This provision will require that institutions provide a way for Federal Pell Grantprogram recipients to obtain or purchase books and supplies by the seventhday <strong>of</strong> the payment period if certain conditions are met and a credit balanceor projected credit balance exists.
