Application <strong>for</strong> a Licence to carry out a Charitable CollectionGuidance NotesThe purpose of these notes is to give guidance to persons intending to make an application<strong>for</strong> a charitable <strong>collection</strong>. The notes are produced <strong>for</strong> guidance only and the <strong>Council</strong> doesnot accept any responsibility or liability <strong>for</strong> any errors or omissions. If the applicant has anydoubts regarding the law in relation to charitable <strong>collection</strong>s they are advised to seek theirown legal advice.1. House to House CollectionsHouse to House Collections are regulated by the House to House Collections Act 1939A House to House Collection is a means of an appeal to the public, by way of visits fromhouse to house (including pub to pub), to give money or property. A "house" includes aplace of business.A licence is required from us be<strong>for</strong>e any <strong>collection</strong> can be carried out within the <strong>Wigan</strong>Borough, unless an exemption order has been granted by the Cabinet Office.A <strong>collection</strong> by the use of envelopes cannot be made under a licence issued by a localauthority.2. National Exemption Order SchemeUnder current law, the Minister <strong>for</strong> the Cabinet Office is responsible <strong>for</strong> the nationalexemption order scheme <strong>for</strong> house-to-house <strong>collection</strong>s. Organisations can generally obtainnational exemption orders if they have house-to-house <strong>collection</strong> licences in at least 70–100local authority licensing areas <strong>for</strong> the two preceding years. There are currently 43 nationalexemption order holders.Where an organisation / charity holds an order of exemption, as a matter of courtesy we askthat you in<strong>for</strong>m the Licensing Section of any planned <strong>collection</strong>s due to take place within the<strong>Wigan</strong> Borough. We will then record such details on our website so members of the publiccan be satisfied that the <strong>collection</strong> is bona fide.3. Street CollectionsStreet Collections are regulated by the Police, Factories, & c. (Miscellaneous Provisions) Act1916.A <strong>street</strong> <strong>collection</strong> means a <strong>collection</strong> of money or a sale of articles <strong>for</strong> the benefit ofcharitable or other purposes. A “<strong>street</strong>” includes any highway and public bridge, road, lane,footway, square, court, alley or passage, whether a thoroughfare or not.A <strong>permit</strong> is required from us be<strong>for</strong>e any <strong>collection</strong> can be carried out within the <strong>Wigan</strong>Borough.4. Application ProcessThe applicant must be the ‘promoter’ of the proposed <strong>collection</strong>. 'Promoter' means a personwho causes others to act as collectors <strong>for</strong> the purposes of the <strong>collection</strong>.7


Applications must be made at least 28 days prior to any proposed <strong>collection</strong>. You areadvised to check your proposed <strong>collection</strong> date(s) is / are available prior to submitting anapplication. Please see section 8 <strong>for</strong> details on how we allocate dates <strong>for</strong> <strong>collection</strong>s.The same application <strong>for</strong>m can be used to apply <strong>for</strong> a house to house <strong>collection</strong> licence anda <strong>street</strong> <strong>collection</strong> <strong>permit</strong>.If you have any difficulty in completing the application <strong>for</strong>m please contact the LicensingSection <strong>for</strong> assistance.We will notify the Police of your intended <strong>collection</strong> and would advise you that should the<strong>collection</strong> impose or cross any other boundary, that you should always check with any otherrelevant licensing authorities.5. How to make an application? How long will my application take?We will begin processing your application on receipt, unless there is a problem, in whichcase we will aim to contact you within 5 working days of receipt.As we recommend that applications are made at least 28 days in advance of any proposed<strong>collection</strong> your application will be considered during this period, and if approved a licence /<strong>permit</strong> will be issued be<strong>for</strong>e the proposed <strong>collection</strong> date(s).8

Fees and ChargesThere are no fees associated with house to house / <strong>street</strong> <strong>collection</strong> applications.8. Allocation of DatesThe Licensing Section are currently receiving a high demand of applications and sometimesthis can create problems when allocating dates.In respect of <strong>street</strong> <strong>collection</strong>s, it is the <strong>Council</strong>'s usual Policy that only one <strong>collection</strong> isallowed per year per area due to the number of charities / organisations wishing to hold<strong>collection</strong>s.In respect of house to house <strong>collection</strong>s, it is the <strong>Council</strong>'s usual Policy to only grant alicence <strong>for</strong> up to a maximum period of 31 days per year. This can be used as a whole monthor split into periods that suit your organisation / charity.Dates <strong>for</strong> house to house <strong>collection</strong>s get booked very quickly and there<strong>for</strong>e we adviseapplicants to make applications as far in advance as possible. However you are remindedthat applications must be made at least 28 days prior to any proposed <strong>collection</strong>(s).We do try to assist all charities / organisations where possible and do our best to avoid overlapping <strong>collection</strong>s. One reason <strong>for</strong> this is because if 2 or more <strong>collection</strong>s were carried outon or around the same time we do not feel each charity / organisation would benefit as muchas if the <strong>collection</strong>s were done at different times.We use a ‘first come, first served’ approach and on this basis the booking is ‘provisional’ untilall relevant documents / in<strong>for</strong>mation have been accepted.9. RegulationsWhere a licence or <strong>permit</strong> is granted the <strong>collection</strong> must be carried out in compliance with theappropriate regulations. A copy of which will be issued with any licence or <strong>permit</strong>.10. After the CollectionOnce the <strong>collection</strong> has taken place you will need to submit a <strong>for</strong>m of statement stating howmuch money has been raised and the amounts used <strong>for</strong> any expenses such as printing,stationery, collecting boxes etc.. This <strong>for</strong>m must be submitted within one month of the<strong>collection</strong>.The <strong>for</strong>m must be certified by the promoter of the <strong>collection</strong> and either an accountant orindependent responsible person.It is a legal requirement that even if no <strong>collection</strong> took place, you must submit a 'Nil' return.Returns can be submitted online or by post to the Licensing Section.9


Please note that organisations who fail to submit required statements within the time limitspecified or fail to notify the <strong>Council</strong> of any reason why the in<strong>for</strong>mation cannot be supplied asrequired may not be granted a <strong>permit</strong> <strong>for</strong> future charitable <strong>collection</strong>s.11. Public RegisterThe legislation does not require a public register to be kept.
