• an application by a licence holder in relation to community premises authorised to sellalcohol to disapply <strong>the</strong> usual mandatory conditions set out in <strong>section</strong>s 19(2) and 19(3)<strong>of</strong> <strong>the</strong> 2003 <strong>Act</strong> concerning <strong>the</strong> supervision <strong>of</strong> alcohol sales by a personal licence holderand <strong>the</strong> need for a designated premises supervisor (DPS) who holds a personal licence(<strong>section</strong>s 25A and 41D); and• an application for minor variation <strong>of</strong> a premises licence (<strong>section</strong>s 41A to 41C) or clubpremises certificate (<strong>section</strong>s 86A to 86C).8.47 If an application to specify a new DPS or to disapply <strong>the</strong> mandatory conditions concerning<strong>the</strong> supervision <strong>of</strong> alcohol sales is made electronically via Business Link or <strong>the</strong> licensingauthority’s own electronic facility, <strong>the</strong> authority must notify <strong>the</strong> police no later than <strong>the</strong> firstworking day after <strong>the</strong> application is given.8.48 Where a simplified process requires <strong>the</strong> applicant (if <strong>the</strong>y are not also <strong>the</strong> personallicence holder) to copy <strong>the</strong> application to <strong>the</strong> licence holder for information, this will applyregardless <strong>of</strong> whe<strong>the</strong>r <strong>the</strong> application is made in writing or electronically. O<strong>the</strong>rwise <strong>the</strong>general <strong>guidance</strong> set out above (paragraphs 8.23 to 8.31) on electronic applications applies.MINOR VARIATIONS PROCESS8.49 Variations to premises licences or club premises certificates that will not impact adverselyon <strong>the</strong> licensing objectives are subject to a simplified ‘minor variations’ process. Under thisprocess, <strong>the</strong> applicant is not required to advertise <strong>the</strong> variation in a newspaper or circular,or copy it to responsible authorities. However, <strong>the</strong>y must display it on a white notice (todistinguish it from <strong>the</strong> blue notice used for full variations and new applications). The noticemust comply with <strong>the</strong> requirements set out in regulation 26A <strong>of</strong> <strong>the</strong> <strong>Licensing</strong> <strong>Act</strong> 2003(Premises licences and club premises certificates) Regulations 2005 (SI 2005/42). Inaccordance with those regulations, <strong>the</strong> notice must be displayed for a period <strong>of</strong> ten workingdays starting on <strong>the</strong> working day after <strong>the</strong> minor variation application was given to <strong>the</strong>licensing authority.8.50 On receipt <strong>of</strong> an application for a minor variation, <strong>the</strong> licensing authority must considerwhe<strong>the</strong>r <strong>the</strong> variation could impact adversely on <strong>the</strong> licensing objectives. It is recommendedthat decisions on minor variations should be delegated to licensing <strong>of</strong>ficers.8.51 In considering <strong>the</strong> application, <strong>the</strong> licensing authority must consult relevant responsibleauthorities (whe<strong>the</strong>r <strong>the</strong> application is made in writing or electronically) if <strong>the</strong>re is anydoubt about <strong>the</strong> impact <strong>of</strong> <strong>the</strong> variation on <strong>the</strong> licensing objectives and <strong>the</strong>y need specialistadvice, and take <strong>the</strong>ir views into account in reaching a decision.8.52 The licensing authority must also consider any relevant representations received fromo<strong>the</strong>r persons within <strong>the</strong> time limit referred to below. As stated earlier in this Guidance,representations are only relevant if <strong>the</strong>y clearly relate to <strong>the</strong> likely effect <strong>of</strong> <strong>the</strong> grant <strong>of</strong> <strong>the</strong>variation on <strong>the</strong> promotion <strong>of</strong> at least one <strong>of</strong> <strong>the</strong> licensing objectives.
