SPONTANEOUS MUSIC, SINGING AND DANCING15.18 The spontaneous performance <strong>of</strong> music, singing or dancing does not amount to <strong>the</strong>provision <strong>of</strong> regulated entertainment and is not a licensable activity. The relevant part<strong>of</strong> <strong>the</strong> 2003 <strong>Act</strong> to consider in this context is paragraph 1(3) <strong>of</strong> Schedule 1 to <strong>the</strong> <strong>Act</strong>.This states that <strong>the</strong> second condition which must apply before an activity constitutes <strong>the</strong>provision <strong>of</strong> regulated entertainment is that <strong>the</strong> premises (meaning “any place”) at which<strong>the</strong> entertainment is, or entertainment facilities are, provided are made available for <strong>the</strong>purpose, or purposes which include <strong>the</strong> purpose, <strong>of</strong> enabling <strong>the</strong> entertainment concernedto take place. In <strong>the</strong> case <strong>of</strong> genuinely spontaneous music (including singing) and dancing,<strong>the</strong> place where <strong>the</strong> entertainment takes place will not have been made available to thosetaking part for that purpose.SMALL VENUES PROVIDING DANCING AND AMPLIFIED OR UNAMPLIFIED MUSIC15.19 In addition, <strong>section</strong> 177 <strong>of</strong> <strong>the</strong> 2003 <strong>Act</strong> applies to suspend most licensing conditionsrelating to music entertainment in certain small venues when <strong>the</strong> conditions specified in<strong>the</strong> licence are met. The <strong>section</strong> is directed at premises with a capacity <strong>of</strong> 200 or less andwhich are licensed for <strong>the</strong> provision <strong>of</strong> music entertainment such as, for example, somepubs with entertainment licences. A detailed description <strong>of</strong> <strong>section</strong> 177 follows below.15.20 Sub<strong>section</strong>s (1) and (2) <strong>of</strong> <strong>section</strong> 177 <strong>of</strong> <strong>the</strong> 2003 <strong>Act</strong> provide that where• a premises licence or club premises certificate authorises <strong>the</strong> supply <strong>of</strong> alcohol forconsumption on <strong>the</strong> premises and <strong>the</strong> provision <strong>of</strong> “music entertainment” (live music ordancing or facilities enabling people to take part in those activities);• <strong>the</strong> relevant premises are used primarily for <strong>the</strong> supply <strong>of</strong> alcohol for consumption on <strong>the</strong>premises; and• <strong>the</strong> premises have a permitted capacity limit <strong>of</strong> not more than 200 persons;• any conditions relating to <strong>the</strong> provision <strong>of</strong> <strong>the</strong> music entertainment imposed on <strong>the</strong>premises licence or club premises certificate by <strong>the</strong> licensing authority, o<strong>the</strong>r than those setout by <strong>the</strong> licence or certificate which are consistent with <strong>the</strong> operating schedule, will besuspended except where, <strong>under</strong> sub<strong>section</strong> (5), <strong>the</strong>y were imposed as being appropriate forpublic safety or <strong>the</strong> prevention <strong>of</strong> crime and disorder or both.15.21 Examples <strong>of</strong> premises used “primarily” for <strong>the</strong> supply <strong>of</strong> alcohol for consumption on <strong>the</strong>premises would include some public houses and some qualifying club premises, but wouldnot normally include, for example, a restaurant.120 AMENDED GUIDANCE ISSUED UNDER SECTION <strong>182</strong> OF THE LICENSING ACT 2003
