(Miscellaneous Provisions) <strong>Act</strong> 1982, ins<strong>of</strong>ar as its adoptive provisions relate to sexestablishments (sex shops, sex cinemas and sex entertainment venues), also contains alicensing regime for premises where such activities are carried on.2.16 Conditions on a premises licence are important in setting <strong>the</strong> parameters within whichpremises can lawfully operate. The use <strong>of</strong> wording such as “must”, “shall” and “will”, isencouraged. Conditions on licences must:• be precise and enforceable;• be unambiguous;• not duplicate o<strong>the</strong>r statutory provisions;• be clear in what <strong>the</strong>y intend to achieve; and,• be appropriate, proportionate and justifiable.PUBLIC SAFETY2.17 As a part <strong>of</strong> <strong>the</strong>ir duties <strong>under</strong> <strong>the</strong> 2003 <strong>Act</strong>, licence holders have a responsibility to ensure<strong>the</strong> safety <strong>of</strong> those using <strong>the</strong>ir premises. This concerns <strong>the</strong> safety <strong>of</strong> people using <strong>the</strong>relevant premises ra<strong>the</strong>r than public health which is addressed in o<strong>the</strong>r legislation. Physicalsafety includes <strong>the</strong> prevention <strong>of</strong> accidents and injuries and o<strong>the</strong>r immediate harms that canresult from alcohol consumption such as unconsciousness or alcohol poisoning. Conditionsrelating to public safety may also promote <strong>the</strong> crime and disorder objective as noted above.There will <strong>of</strong> course be occasions when a public safety condition could incidentally benefita person’s health more generally, but it should not be <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> condition asthis would be outside <strong>the</strong> licensing authority’s powers (be ultra vires) <strong>under</strong> <strong>the</strong> 2003 <strong>Act</strong>.Conditions should not be imposed on a premises licence or club premises certificate whichrelate to cleanliness or hygiene.2.18 A number <strong>of</strong> matters should be considered in relation to public safety. These may include:• Fire safety (see paragraphs 2.20 – 2.23);• Ensuring appropriate access for emergency services such as ambulances;• Good communication with local authorities and emergency services, for examplecommunications networks with <strong>the</strong> police and signing up for local incident alerts (seeparagraph 2.8 above);• Ensuring <strong>the</strong> presence <strong>of</strong> trained first aiders on <strong>the</strong> premises and appropriate first aid kits;• Ensuring <strong>the</strong> safety <strong>of</strong> people when leaving <strong>the</strong> premises (for example, through <strong>the</strong> provision<strong>of</strong> information on late-night transportation);AMENDED GUIDANCE ISSUED UNDER SECTION <strong>182</strong> OF THE LICENSING ACT 200311
