13.12 Statements <strong>of</strong> policies should make clear that:• licensing is about regulating licensable activities on licensed premises, by qualifying clubsand at temporary events within <strong>the</strong> terms <strong>of</strong> <strong>the</strong> 2003 <strong>Act</strong>; and• conditions attached to various authorisations will be focused on matters which are within<strong>the</strong> control <strong>of</strong> individual licence holders and o<strong>the</strong>rs with relevant authorisations, i.e. <strong>the</strong>premises and its vicinity.13.13 A statement <strong>of</strong> policy should also make clear that licensing law is not <strong>the</strong> primarymechanism for <strong>the</strong> general control <strong>of</strong> nuisance and anti-social behaviour by individualsonce <strong>the</strong>y are away from <strong>the</strong> licensed premises and, <strong>the</strong>refore, beyond <strong>the</strong> direct control <strong>of</strong><strong>the</strong> individual, club or business holding <strong>the</strong> licence, certificate or authorisation concerned.None<strong>the</strong>less, it is a key aspect <strong>of</strong> such control and licensing law will always be part <strong>of</strong> aholistic approach to <strong>the</strong> management <strong>of</strong> <strong>the</strong> evening and night-time economy in town andcity centres.DUPLICATION13.14 Statements <strong>of</strong> licensing policy should include a firm commitment to avoid attachingconditions that duplicate o<strong>the</strong>r regulatory regimes as far as possible. Chapter 10 providesfur<strong>the</strong>r detail on this issue.STANDARDISED CONDITIONS13.15 Statements <strong>of</strong> policy should also make it clear that a key concept <strong>under</strong>scoring <strong>the</strong> 2003<strong>Act</strong> is for conditions to be tailored to <strong>the</strong> specific premises concerned. This effectively rulesout standardised conditions, as explained in paragraph 10.14 <strong>of</strong> this Guidance. However, itis acceptable for licensing authorities to draw attention in <strong>the</strong>ir statements <strong>of</strong> policy to pools<strong>of</strong> conditions which applicants and o<strong>the</strong>rs may draw on as appropriate.ENFORCEMENT13.16 The Government strongly recommends that licensing authorities should establish and setout joint-enforcement protocols with <strong>the</strong> local police and <strong>the</strong> o<strong>the</strong>r enforcing authorities anddescribe <strong>the</strong>m in <strong>the</strong>ir statement <strong>of</strong> policy. This will clarify <strong>the</strong> division <strong>of</strong> responsibilitiesbetween licence holders and applicants, and assists enforcement bodies to deployresources more efficiently.13.17 In particular, <strong>the</strong>se protocols should also provide for <strong>the</strong> targeting <strong>of</strong> agreed problem andhigh risk premises which require greater attention, while providing a lighter touch for lowrisk premises which are well run. In some local authority areas, <strong>the</strong> limited validity <strong>of</strong> publicentertainment, <strong>the</strong>atre, cinema, night café and late night refreshment house licences hasin <strong>the</strong> past led to a culture <strong>of</strong> annual inspections regardless <strong>of</strong> whe<strong>the</strong>r <strong>the</strong> assessed risksmake such inspections necessary. The 2003 <strong>Act</strong> does not require inspections to takeplace save at <strong>the</strong> discretion <strong>of</strong> those charged with this role.
