Deadline for submission <strong>of</strong> Quotation:Quotation must reach the Executive Engineer (MDO), 3 rdFloor OldAdministrative Office Building, <strong>Chennai</strong> <strong>Port</strong> Trust, Rajaji Salai, <strong>Chennai</strong> – 600001 at 1500 Hrs. on 01.07.2010.2. Quotation PricesThe amount quoted by the tenderer in the Bill <strong>of</strong> quantities shall allow for allcosts including labour, materials, equipment, transport charges, tests, etc.payable.3. Validity <strong>of</strong> QuotationQuotation shall remain valid for a period 60 days from the date <strong>of</strong> opening.4. Earnest Money Deposit (EMD)4.1 Each Quotation should be accompanied by an Earnest Money Deposit (EMD)amounting to Rs.3,200/- ( Rupees Three Thousand Two Hundred only )which shall be in the form <strong>of</strong> (i) Cash, (ii) Demand Draft / Pay Order / from anyNationalised Bank / Scheduled Bank drawn in favour <strong>of</strong> Chairman, <strong>Chennai</strong><strong>Port</strong> Trust, <strong>Chennai</strong> 600 001.4.2 In Case <strong>of</strong> 4.1 (i), the cash should be deposited at the <strong>of</strong>fice <strong>of</strong> the Deputy ChiefAccounts Officer (Engineering), <strong>Chennai</strong> <strong>Port</strong> Trust before 12.00 <strong>No</strong>on on thedate <strong>of</strong> opening <strong>of</strong> Quotation and the receipt obtained for the payment shouldbe enclosed with the Quotation.4.3 In this case <strong>of</strong> 4.1 (ii), the Demand Draft / Pay Order, the same should beenclosed with the Quotation and should not be sent separately.4.4 Under no circumstances should currency note be enclosed in the covercontaining the Quotation as Earnest Money.4


4.5 <strong>No</strong> other form <strong>of</strong> deposit towards Earnest Money shall be accepted.4.6 Quotation not accompanied by the Earnest Money Deposit in the mannerprescribed by the Trust will be summarily rejected.However Small Scale Units registered with the National Small IndustriesCorporation Ltd., are exempted from payment <strong>of</strong> Earnest Money Depositprovided a Certificate from the Registering Authority is produced tosubstantiate their status as a Small Scale Unit currently registered with theNational Small Industries Corporation Ltd.,However no exemption from payment <strong>of</strong> Security Deposit amount will beallowed in respect <strong>of</strong> Small Scale Units registered with National SmallIndustries Corporation Ltd.,“NOTE:To claim under Clause 4.6 above, the tenderers are required to producean attested copy <strong>of</strong> the NSIC registration Certificate. The attestation should befrom a Gazetted Officer <strong>of</strong> Central /State Government. Refund <strong>of</strong> EMD6.1 When the committee finalizes one <strong>of</strong> the tenderer for the said contract, EMDwill be refunded to all other tenderers at the earliest.6.2 The EMD <strong>of</strong> the successful tenderer will be refunded only after the remittance<strong>of</strong> security deposit in any manner as aforesaid. 7. Value Added Tax (VAT) will be applied to this contract as per provision <strong>of</strong> the actand will be recovered from the work bills as per the Tamilnadu Government VATprovision. Necessary certificate towards such "Tax deducted at source" will be issuedby the Trust's Finance department.8. The materials used on the work shall be <strong>of</strong> approved quality and as directed bythe Chief Engineer or his representatives. The contractor shall get the approval <strong>of</strong> thematerials before using them on the works.9. All Materials required for the work shall be arranged by the contractor on his owncost.10. Any spillages <strong>of</strong> paint on floors etc., shall be cleaned properly without claimingany extra cost.11. The contractor shall give a list <strong>of</strong> the workers posted for the above work with thedetails <strong>of</strong> name, age and address.12. While working at heights, the contractor should use non- skid type safetyladders with adequate strength. The contractor should also provide necessaryhelpers for all the works which are carried out at heights. Further, the contractormust provide safety belts to their workers working on heights.13. The work shall be completed within Two (2) Months from the seventh day <strong>of</strong>placing the order (or) the actual date <strong>of</strong> starting the work whichever is earlier.2. CEMENT REQUIRED FOR THE WORK.CEMENT REQUIRED FOR THE WORK TO BE PROCURED BY THECONTRACTOR AT THEIR OWN COST3. STEEL REQUIRED FOR THE WORK.<strong>No</strong> steel is involved in this work.4. SUPPLY OF DRINKING WATER AT THE SITE OF WORK:The Contractor shall make his own arrangements.5. SUPPLY OF WATER FOR THE WORK:Supply <strong>of</strong> water for the works:The contractor will be provided with one point subject to availability for thesupply <strong>of</strong> water near the site <strong>of</strong> work. He should make his own arrangementsfor tapping, storing and lifting, if any, including laying pipeline from the pointso provided. The cost <strong>of</strong> water supplied to the contractor plus meter hirecharges will be recovered at the rates prevailing from time to time and the watersupply is subject to cuts and other restrictions that may become necessaryfrom time to time. The water supply is also subject to departmental rules and18


egulations as regards shutdowns for repairs and overhauls. The contractorshall not claim damages for stopping water supply for any reason whatsoever.In case the department is unable to supply water due to any reason, thecontractor should not sink any well in the site. The contractor shall make hisown arrangements to get usable water at his own cost from out side.6. Electricity Supply for Works:Electricity Supply for Works:Electrical power required for the work by the contractor shall be arranged bythe contractor on his own by providing generators. However, subject to theavailability, the Electrical power required for the work will be provided by theTrust to the extent that can be conveniently spared by the Trust from time totime at 250 volts single phase 50 cycles or 440 volts 3 phase 50 cycles at twopoints one for power and the other for lighting at the nearby distribution boardonly with the metering facility and not at the site. The power and light pointswill be provided by the Trust at Trust’s cost. Any extension <strong>of</strong> wiring from theabove points for lighting and power at the distribution points to the site and itsremoval after the completion <strong>of</strong> contract will have to be arranged by thecontractor through licensed contractors at his own expense in such a manneras approved by the Chief Electrical Inspector to the Government <strong>of</strong> Tamilnaduand also by <strong>of</strong> the Chief Mechanical Engineer <strong>of</strong> the <strong>Chennai</strong> port Trust or hisrepresentative. The safety <strong>of</strong> the cabling (ie. Extension <strong>of</strong> wiring) andtransmission will be the responsibility <strong>of</strong> the contractor. If any extra point <strong>of</strong>supply is required the same will be arranged by the Trust at its discretionsubject to the availability <strong>of</strong> power or other facilities and the cost <strong>of</strong> the same,as detailed below will be recovered from contractor’s bill or any other amountdue to him by the Board. The cost <strong>of</strong> such work based on the labour chargeswith materials cost including overheads, storage and pr<strong>of</strong>it as fixed by theBoard from time to time shall be recovered from the contractor. Any materialsused for such extra work shall be deemed to be the property <strong>of</strong> the Trust andwill not be returned to the contractor.19


The contractor should make a Security deposit equivalent to three monthsconsumption charges as per TNEB <strong>No</strong>rms for the temporary connection. Thecontractor should pay every month electricity consumption as per the bill. Thesecurity deposit for electrical consumption will be refunded after thecompletion <strong>of</strong> the works.The cost <strong>of</strong> energy consumed by the contractor plus meter hire charges shall berecovered at the rates prevailing from time to time. The power supply shall besubject to cuts or other restrictions that may become necessary from time totime. The power supply shall also be subject to departmental rules andregulations as regards shutdown for repairs and overhauls. The contractorshall not claim damages for stoppage or cuts in electrical power supply for anyreason whatsoever. Whenever the contractor utilizes electricity for weldingpurposes from the power supply point provided by the Trust, he shall usecapacitors in the circuits to maintain the minimum power factor 0.85. If anycontractor is found to violate this requirement, the entire consumptionrecorded on the energy meter provided for power supply point shall be chargedat the revised rates (i.e.) the rate for power unit with an addition <strong>of</strong> 20% <strong>of</strong> rateper unit in addition to Central Excise surcharge <strong>of</strong> 3 paise per unit or asapplicable.7. MISCELLANEOUS CONDITIONS:(a) The Chief Engineer shall have the right to omit at his discretion one or moreitems <strong>of</strong> work when placing the order.(b) The quantities indicated in the schedule are only approximate and can beincreased or decreased at the discretion <strong>of</strong> the Chief Engineer. However, theconsequent variation in the Total Contract Value will be limited to 20%. The ratesquoted shall be firm for such variation. In case the variation results in the totalcontract value exceeding the prescribed percentage revision <strong>of</strong> rates, if any, shallbe applicable only for that portion <strong>of</strong> the contract carried out in excess <strong>of</strong> thepermissible percentage.20


8. SECURITY DEPOSIT:The Contractor shall deposit 5 % <strong>of</strong> the contract value as Initial SecurityDeposit for the due fulfillment <strong>of</strong> the conditions <strong>of</strong> the contract, within 7 days <strong>of</strong>receiving the order failing which the order shall be cancelled and other arrangementsmade for executing the work. In addition to the Initial Security 5% shall be recoveredfrom the successive part bills to fulfill the contract. The Security Deposit shall notbear any interest and the Security Deposit shall be forfeited in whole or part at thediscretion <strong>of</strong> the Chief Engineer, if in his opinion the contractor has failed to fulfil any<strong>of</strong> the conditions <strong>of</strong> the above contract. The Security Deposit shall be refunded to thecontractor along with the bill after the work is completed satisfactorily and certifiedby the Chief Engineer to that effect.9. The Contractor should produce Xerox copy <strong>of</strong> the photo identity card in theform <strong>of</strong> ration card or voter’s list for the Contractor and workers engaged by him toissue Harbour entry pass. The Harbour entry pass can be used along with the Xeroxcopy <strong>of</strong> the photo identity issued by Government Authority.10. The Workers should be in position to produce the Harbour entry pass issuedby the trust along with the photo identity card for verification purpose during thework at the port. Also the workers shall not indulge in any other undesirable /objectionable activities like pilferage or stealing the materials from the <strong>Port</strong>, for whichact, the contractor only will be held responsible and the work undertaken by theContractor will be terminated with immediate effect.11. The list <strong>of</strong> persons engaged by the contractor with detailed addresses should befurnished to the Chief Engineer’s representative / Executive Engineer concerned andthe same will be forwarded to the police station concerned for verification <strong>of</strong> characterand antecedents.. 12. Compensation for delay:If the contractor fails to complete the work in all respects within the timespecified or within the extended time that may be allowed by the Engineer, thecontractor shall pay or allow to the Board a sum <strong>of</strong> contract as liquidated andascertained damages and not by way <strong>of</strong> penalty, for every day/week or part there<strong>of</strong>21


eyond the said period or extended period as the case may be during which the workshall remain unfinished. Such damages will be deducted from any Amount payableto or to be payable to the contractor including encashment <strong>of</strong> Bank Guarantee or anySecurities/ Guarantees, if any available with the <strong>Port</strong> Trust. The maximum Amount<strong>of</strong> Liquidated Damages will be worked out based on the Total Contract value inclusive<strong>of</strong> all Taxes and Duties thereon.In case <strong>of</strong> part / portions <strong>of</strong> the contract work/ Supply order completed andtaken possession by the Trust and the Trust operates/ can be made for operation <strong>of</strong>the part portion/ supply order, the calculation <strong>of</strong> Liquidated damages will berestricted to the uncompleted/ undelivered value <strong>of</strong> the work/ supply order subject tothe amount <strong>of</strong> the maximum percentage prescribed for the Liquidated Damages/ LateDelivery charges <strong>of</strong> the total value <strong>of</strong> the contract/supply.The Liquidated Damages/ Late Delivery charges will be worked out as follows;i).The Liquidated Damages/ Late Delivery charges whose period <strong>of</strong> contract / deliveryis above four weeks, Liquidated Damages/ Late Delivery charges will be ½% (halfpercent) per week or part there<strong>of</strong> <strong>of</strong> the total value <strong>of</strong> the contract subject to amaximum <strong>of</strong> 5% <strong>of</strong> the total value <strong>of</strong> contract.The payment <strong>of</strong> such damages does not relieve the contractor <strong>of</strong> his obligationsto complete the works or from any other <strong>of</strong> his obligations or liabilities under thiscontract.CHIEF ENGINEER<strong>CHENNAI</strong> <strong>PORT</strong> <strong>TRUST</strong>22


<strong>CHENNAI</strong> <strong>PORT</strong> <strong>TRUST</strong>SCHEDULE ‘C’GENERAL CONDITIONS1. <strong>No</strong> materials will be supplied free by the Trust and it is the responsibility <strong>of</strong> thecontractor to procure and supply all the materials required for the work at their cost.2. If any materials issued to the contractor by the Trust for the use on the work is lostor damaged, the cost there<strong>of</strong> at the prevailing market rate or at the Trust’s issue ratewhichever is higher plus 20% storage charges in either case will be recovered fromany money due or that may become due to the contractor.3. The quantities given in the schedule <strong>of</strong> quantities are those upon which theapproximate estimated cost <strong>of</strong> the work is based but they are subject to alterations,omissions, deductions and additions and do not necessarily show the actualquantities <strong>of</strong> the work to be done.4. The specification <strong>of</strong> all other materials shall be as per the Civil Engineering WorksManual <strong>of</strong> <strong>Chennai</strong> <strong>Port</strong> Trust with latest amendments unless otherwise specifiedand/or relevant Indian Standard specifications as applicable. All BIS specificationreferred to in this schedule shall be the latest version.5. The work is to be carried out with due diligence and executed to a workman likemanner. The material used when supplied by the contractor is to be <strong>of</strong> the best <strong>of</strong> itskind and in all cases to be subject to the approval <strong>of</strong> the Chief Engineer whosedecision to the rate <strong>of</strong> progress the quality <strong>of</strong> the work or materials, sizes etc., is final6. The Chief Engineer may cancel the contract at his option at any time without noticefor any reason including poor progress <strong>of</strong> work and may remove bad work ormaterials and have it replaced deducting the value <strong>of</strong> the work rejected or materialsremoved and the cost <strong>of</strong> replacing it as he may think proper from any amount due orthat may become due to the contract. The decision <strong>of</strong> the Chief Engineer is final andwill be binding on the contractor.7. In case the contractor leaves the work incomplete the Chief Engineer shall have theright to have the work completed through any other agency and recover the extraexpenditure incurred by the Trust in so doing from any money due or to become dueto the contractor.8. The Contractor shall conform and comply with the regulations and by–Laws <strong>of</strong> the<strong>Chennai</strong> <strong>Port</strong> Trust Board and <strong>of</strong> all other local authorities such as the Corporation <strong>of</strong>23


<strong>Chennai</strong>. The Chief Electrical Inspector to Government <strong>of</strong> Tamilnadu, the TamilnaduElectricity system, the Factories Act, the Government Customs and PoliceDepartment, etc The contractor shall conform to rules, regulations, etc. concerninginjury to workman compensation for injury to workmen, Insurance for workman etc.The Contractor shall also conform to contract labour (Regulations and Abolition)Central Rule 1971 etc.9. The Contractor shall be responsible for any accident, damage for injury caused to anyhis employees or property or any person or property in course <strong>of</strong> the work and shallhold the <strong>Port</strong> Trust blameless in respect there<strong>of</strong> any also in respect <strong>of</strong> any claimmade by any person or any reasons whatsoever.10. The contractor shall be solely responsible for reporting to the Board and PoliceDepartment immediately <strong>of</strong> any serious or fatal accident inside the Trust’s premisesto any <strong>of</strong> his employees/workmen engaged by him or any persons involved in anaccident at site <strong>of</strong> work.11. The work shall be carried out without causing any inconvenience to the Trust and toother works in progress in the neighborhood and any losses to the Trust.12. Only vehicles licensed by the Board will be allowed inside the <strong>Port</strong> premises.Admission into the Harbour is regulated by issue <strong>of</strong> passes for the contractorand his staff. Entry passes will be issued free <strong>of</strong> cost to the contractor. The contractoris solely responsible for all the details incorporated in the passes; the Trust isindemnified against their misuse.The entry passes shall be produced at the time <strong>of</strong> entry and any other timewhen demanded by the CISF personnel or department <strong>of</strong>ficials.Further, in the event <strong>of</strong> loss <strong>of</strong> entry passes or identity card issued to thecontractor or their labour, Rs.20/- will be imposed as penalty in each case.Engineering Department shall recommend the contractor/ firms to registerwith the pass section. Applicants should apply in the prescribed format to get a codenumber for the firm from the Pass section and should produce authorized signature<strong>of</strong> two persons per firm who will sign the pass application. Any changes in theAuthorized signatories, both <strong>of</strong> the firm’s <strong>of</strong>ficials should be intimated to pass sectionimmediately.Provision for individual and vehicle Harbour Entry Permits are alone availablein the Pass Section Module and not for the Materials.As per ISPS requirements all the <strong>Port</strong> users should submit antecedentverification / police verification or Pass port copy <strong>of</strong> their employees / contractworkers, since it is a pre- requisite for issuing all <strong>Port</strong> Entry passes.13. Only vehicles licensed by the Board will be allowed to ply inside the harbour. Privatecarts <strong>of</strong> any kind are not permitted within the harbour area.14. The work shall be carried out only during Trust’s working days between 7-30 A.M.and 5-00 P.M.24


15. The quantities <strong>of</strong> work executed will be measured and payment made once a monthgenerally except in the case <strong>of</strong> work for which the time for completion is specified assix weeks or less than six weeks in which case payment will be made once only onsatisfactory completion <strong>of</strong> the work.16. It shall be clearly understood that the rates mentioned in the schedules are inclusive<strong>of</strong> everything required to be done for the proper completion <strong>of</strong> the work according tothe specifications drawings, general conditions and special conditions even thoughspecific mention there<strong>of</strong> has been omitted in the specification and drawings.17. Measurements recorded by the person authorized by the Chief Engineer to makethem will be accepted by the contractor who will be given the opportunity <strong>of</strong>witnessing the measurements taken.18. All payments made by the Trust to the contractor for the work shall be rounded <strong>of</strong>f tothe nearest rupee.19. The work shall be completed within Two (2) months from the 7 th day <strong>of</strong> placing theorder or actual date <strong>of</strong> starting the work whichever is earlier.20. If the progress <strong>of</strong> work is held up owing to circumstances which in the opinion <strong>of</strong> theChief Engineer are beyond the control <strong>of</strong> the Contractor, Such as War, stormyweather and other reasonable causes, the Chief Engineer may at his discretion, grantto the Contractor such extension <strong>of</strong> time as he considers reasonable for thecompletion <strong>of</strong> the work.
