Regional, municipal andlocal plans are all legally binding.Planning levelsAccording to the Planning and Building Act no.73/1997 (PBA) there is compulsory statutoryplanning at two governmental levels; the national and municipal levels. Planning at nationaland municipal level; i.e. development plans in the form of municipal comprehensive plansand detailed plans prepared by the municipalities, and sector plans at the national level.Regional plans, prepared by two or more local authorities are voluntary but encouraged bythe act. The <strong>SEA</strong> requirements apply to all plans stipulated by the PBA.Planning at the national levelThere is no formal physical planning at the national level in Iceland, but the ministriesprepare national strategies for the individual sectors such as transport and energy. Othernational planning instruments are parliamentary decisions regarding regional development,afforestation, soil protection programme etc. Although these plans are not stipulated by thePlanning and Building Act and are not a part of the physical planning system, they includedecisions that have considerable consequences for the development and preconditions forplanning in the countries’ different regions. An example of such a plan is the nationaltransport strategy and the national strategy for energy use and the national plan for natureprotection.Regional planningThere is no governmental level in Iceland, but the municipalities can partake in voluntarycooperation and prepare so-called regional plans, which are encouraged in the PBA. Theregional plans are in that way voluntary and cover two or more municipalities and stipulationsfor land use in the whole of the area.Planning at the municipal levelAccording to the Planning and Building Legislation all municipalities must prepare land useplans that cover the whole of the municipality and shall handle land use and development inthe municipality for twelve years ahead of time. The municipal plans shall be revised everyfourth year. Furthermore, the municipalities shall prepare detailed plans for areas wheredevelopment is proposed.73
