'Vodafone Essar Sports King Promotion' (hereinafter the “Scheme”)

‘Vodafone Essar Sports King Promotion’(hereinafter the “Scheme”)TERMS & CONDITIONSPlease read these terms and conditions carefully before registering for/participating in theScheme. By proceeding with registration for and/or participating in the Scheme, you agree tobe legally bound by these terms and conditions:1. The Scheme is organized by Vodafone Essar South Ltd. and is valid from 14 th May till 30 thMay 2008, for valid Vodafone Subscribers only and the winner shall be entitled to getbrand new ‘TVS Star City bike’ and not in monetary terms.2. Criteria for participating in the Scheme is as under:a. Any Vodafone subscribe who will subscribe to ‘Sports Combo Pack’ withinthe above specified period will become eligible for inclusion of his /hername(s) in the Lucky Draw. The subscription charges are Rs. 99/- per month.b. No of winner/prize: 01(one).c. In the lucky draw, if the first chosen person fails to meet the criteriamentioned herein then Vodafone Essar reserves the right to choose the nextwinner who meets the criteria contained herein.3. The winner shall be responsible for compliances, registration process & formalities andproduction of any /all such documents as may be required by the authorities inconnection with the prize.4. The winner will be selected /chosen by an independent third party /charteredaccountant firm . Picked random selection. _____________________________.5. The Winner ("Winner") may be announced on or around 10 th June 2008 throughVodafone's website 'www.vodafone.in' and/or through any other manner as Vodafonemay deem appropriate. The Winner shall be responsible to procure the prize from the designated location, asinformed by Vodafone, Within the time mentioned in the SMS forwarded by VodafoneEssar or by 25/06/2008, which ever is later, The Winner shall be responsible to save thesaid communication and show it at the designated place for claiming the prize.7. Only valid/active Vodafone Subscriber of the respective Vodafone number would beentitled to the prize and it would be subscriber's responsibility to produce all suchdocument and/or credentials to prove his/her identity to the complete satisfaction ofVodafone.8. An Active Vodafone Essar Subscriber means a subscriber whose Vodafone Essar mobilenumber subscription is valid and whose Vodafone Essar number is active on VodafoneEssar network and his /her is having balance greater than zero (prepaid) or all duescleared (postpaid) at the time of distribution of the Prize by the Company /Organizers.9. A Valid Subscriber means having valid Subscription of Vodafone Essar cellular mobiletelephony services as per Law.10. In the event, the Winner fails to produce documents and /or credentials to prove his/her identity to the complete satisfaction of Vodafone Essar then Vodafone Essar shallbe entitled to choose another Winner and announce him the winner without any claimfrom the earlier selected winner. The participants unconditionally confirm and agree torescind any claim against Vodafone Essar in any such eventuality.11. The Subscribers/participants/winners hereby irrevocably authorizeVodafone/Organizers, that the data gathered during and/or after the Scheme in respectof the participants (including Subscriber name and photograph etc.) shall be theproperty of Vodafone and Vodafone and its subsidiaries and shall be entitled to use thesame in any communications including marketing promotions and advertisementsalong with/without Vodafone’s brand.12. Vodafone shall not be liable in any manner for any mishap, accident, injury or damagesetc. of whatsoever nature, caused to the Winner while claiming the benefits of the Prizes.Further, Vodafone shall not be liable in any manner for any loss, damage, theft, or anyother mishap caused to the Prize and / or in respect of the Prize.13. Apart from the entitlement to the above Prize, the Winner or his /her legal heirs will haveno other rights or claims against Vodafone/Organizers.14. The prize(s) under the scheme is neither assignable nor transferable under anycircumstances.15. Prizes can’t be redeemed in cash.16. All costs, expenses and incidental costs/taxes/levies related to the prize shall beexclusively borne by the subscriber and no claim of whatsoever nature will beentertained by Vodafone in this regard.17. Vodafone Essar South limited is neither responsible nor guarantees the quality of thegoods/services being offered as prizes nor is liable for any defect or deficiency of goodsor services so obtained/availed by subscribers under this scheme.

18. The prize shall be subject to such other terms and conditions as may be applicable tospecific prizes and shall have to be duly compiled with by the winner.19. The prize to the winner shall be given subject to compliance with all applicable statutorylegislations/ processes /formalities in connection with the prize and on production allsuch documents/papers as required by Vodafone Essar South limited before acceptingthe delivery of the prize. Any failure on the part of the winner to comply with directionsissued by Vodafone Essar South limited for claim of prize shall entitle Vodafone EssarSouth limited to forfeit the prize.20. The employees of Vodafone Essar and its group companies, vendors, affiliate orassociate companies shall not be eligible for this scheme.21. This scheme cannot be used in conjunction with any alternative scheme, offer orpromotion.22. The terms and conditions stated herein shall not override the terms and conditions ofthe standard subscribe application form23. Vodafone Essar reserve the right to extend, cancel, discontinue, prematurely withdraw,change, alter or modify this scheme or any part thereof including the eligibility criteria atits sole discretion at anytime during it’s validity as may be required in view of businessexigencies and/or changes by regulatory authority and/or statutory changes and/or byany judicial order which shall be binding on the Subscriber.24. Vodafone Essar/Organizers reserve the right to change / modify the Scheme or termsand conditions of the Scheme, at any time at its own discretion, without assigning anyreason. Vodafone Essar/Organizers shall not be obliged to give any prior notice foraforesaid change / modification. All subscribers are requested to review the updatedTerms and Conditions regularly at www.vodafone.in.25. In case of any dispute or difference in respect of or in connection with the Schemeand/or the Prize herein, the decision of Vodafone Essar/Organizers shall be final andbinding on all concerned.26. Any dispute/matter arising out of or in relation to the Scheme is subject to jurisdiction ofcompetent court/s of Delhi alone.
