In case <strong>of</strong> any unscheduled holiday falling on the prescribed closing or openingday <strong>of</strong> the tender, the next working day will be treated as scheduled <strong>for</strong> opening or closing day <strong>of</strong>the tender as the case may be.9. 10. If the tenderers give wrong in<strong>for</strong>mation deliberately to create conditions <strong>for</strong> Acceptance <strong>of</strong> thetender, the DFPCL reserves the right to reject such tenders without assigning any reason.Not more than one tender will be submitted by one tenderer <strong>for</strong> the same work.11. The workmen and other persons to be engaged by the contractor <strong>for</strong> providing <strong>security</strong> serviceswill be the employees <strong>of</strong> the contractor. This shall not create nor shall it be deemed to create anyemployer-employee relationship between DFPCL and such workmen and the persons engaged bythe contractor. The <strong>security</strong> guards shall not claim any right <strong>for</strong> employment in DFPCL. This factshould be made known to them in clear terms.12. The successful tenderers shall be required to execute the <strong>for</strong>mal agreement with DFPCL withinthirty days <strong>of</strong> the issue <strong>of</strong> <strong>of</strong>fer <strong>of</strong> the contract and shall start contract on scheduled date asspecified in the <strong>of</strong>fer.13. The contractor shall make payment <strong>of</strong> wages to its <strong>security</strong> personnel latest by 10th <strong>of</strong> eachmonth .14. (hereinafter referred to as “DFPCL” desires toappoint Contractor providing <strong>security</strong> services/personnel/guards/supervisors (hereinafter referred to asthe "Security Agency" . The Security Agency should be registered under the provisions <strong>of</strong> theMaharashtra Private Security Guards ( Regulation <strong>of</strong> Employment and Welfare) Act, 1981 (hereinafterreferred to as the "Act") read with the Maharashtra Private Security Guards (Regulation <strong>of</strong>Employment and Welfare) Rules 1981 (hereinafter referred to as the "Rules") also read with theMaharashtra Private Security Guards (Regulation <strong>of</strong> Employment and Welfare) Scheme, 1981(hereinafter referred to as the "Scheme" ). The Security Agency is required to deploy only theExempted <strong>security</strong> guards/personnel under Section 23 <strong>of</strong> the Act. The Security Agency will berequired to strictly follow the Act, Rules, Scheme and other Notifications issued from time to time bythe appropriate Government. The Security Agency is also required to get itself fully acquainted withvarious Writ Petitions filed/pending be<strong>for</strong>e the Honorable High Court, Mumbai, and anyselection/appointment <strong>of</strong> the Security Agency shall be subject to the outcome <strong>of</strong> Writ Petition No.8927<strong>of</strong> 2004 and/or other Writ Petitions filed earlier in the High Court by the Maharashtra Rajya SurakshaRakshak Sangathana.1. 2. Eligibility <strong>for</strong> Security Guards and Security Supervisors:2.1 criteria <strong>for</strong> development <strong>of</strong> contract <strong>security</strong> guards.A) Qualification 10 th/12 th pass/ Ex Army/ Ex Paramilitary <strong>for</strong>ceB) Age Between 25 to 30 years.C) Physical appearance Wt. 60 Kg minHt. 5'6"minRobust physique-no physical / Mental disabilityD) Experience Minimum 5 years as a <strong>security</strong> guard.E) Additional qualification Fire fighting training.2.2 Security agency should deploy <strong>for</strong> the leave vacancy.2.3 Training that <strong>security</strong> contractor will impart prior to development(period 15 days) training on <strong>security</strong> system and physical training , including introduction to fire arms asper PASARA ACT 2005. Refresher course on <strong>security</strong> , <strong>security</strong> definition, applications etc. Basic training on handling <strong>of</strong> metal detector & CCTV Basic training on computer operations Preparation <strong>of</strong> duty roster & standard order procedures(SOP) Basic training on fire fighting & first aid. Training <strong>of</strong> <strong>security</strong> norms & SOP's followed at Deepak Fertilisers. Plus other essential training as decided by the Deepak Fertilisers management.2.4 Expectations from the quality staff deputed :- Better monitoring and high alertness. Good presentations & reception <strong>of</strong> visitors, guests Etc, Less crime rates at the gates, such as bribe, theft, <strong>for</strong>ceful robbery <strong>of</strong> drivers. Better vigilance. Smart turn out. Cost effective. Computer literature & better services to the the customer Hiring <strong>of</strong> <strong>security</strong> guards agency should not have police back up fro the contractors end.2.5 Other mandatory Requirements:a) No <strong>security</strong> staff should be from the existing <strong>security</strong> outsourced agency.b) The <strong>security</strong> outsourced agency should comply with all statutory requirements as per annexureattached .Page 6 <strong>of</strong> 19


c) No <strong>security</strong> person stay on over time beyond normal 8 hours duty. In extreme emergency ifsomebody has to stay on overtime it should be with prior permission from Admin/<strong>security</strong>Manager <strong>of</strong> DFPCL <strong>K7</strong>/ <strong>K8</strong>. The amount <strong>of</strong> overtime payable will not be reimbursed by DFPCL<strong>K7</strong>/<strong>K8</strong> and this has to be paid by the <strong>security</strong> outsourced agency. Under no circumstance, no<strong>security</strong> person per<strong>for</strong>m overtime beyond 8 hours.d) Every <strong>security</strong> person should be provided with proper uni<strong>for</strong>m and all required tolls andtackles to carry out the job smoothly.e) The Area in charge <strong>of</strong> the <strong>security</strong> outsourced agency has to take <strong>security</strong> rounds <strong>of</strong> all locationat least once in a week as a week as a surprise check during night hours. The surprise checks visitdetails such as name <strong>of</strong> visiting <strong>of</strong>ficer, date and time <strong>of</strong> their visit and observations should berecorded in the note book kept at the location. The approval <strong>of</strong> the <strong>security</strong> contract bill is subjectto minimum one surprise visit during night hours every week by the area in charge <strong>of</strong> <strong>security</strong>outsourced agency.f) The outsourced agency should submit the bills with relevant detalis to DFPCL <strong>K7</strong>/ <strong>K8</strong> by 2 nd<strong>of</strong> the subsequent moth along with the <strong>document</strong>s as per annexure attached copies <strong>of</strong> the paidchallans <strong>for</strong> making payments. The <strong>security</strong> outsourced agency bill payment will be made within15 days from the date <strong>of</strong> receipt <strong>of</strong> the bill if the bill is found correct in every respect.g) The outsourced agency should depute a person who will coordinate during changeover <strong>of</strong><strong>security</strong> guards from one shift to another shift.f) Whenever there are issues related to the contract <strong>security</strong>, DFPCL <strong>K7</strong>/<strong>K8</strong> <strong>of</strong>ficial willcommunicate to the outsourced agency and call <strong>for</strong> a meeting, a responsible person from theoutsourced agency should attend and resolve the issue on time.g) Liason with Security Guard Board is the responsibility <strong>of</strong> the <strong>security</strong> agency.NOTE : Neither Security Guard nor Security Supervisor should belong to any location within100 KMS from MIDC, Taloja, Raigad.3. Uni<strong>for</strong>mThe Security Agency shall provide uni<strong>for</strong>ms, shoes, stocking, belt, cap, photo identitycard, lathi , whistle and torches, including monsoon wear etc. to the <strong>security</strong> personnel, incase torch lights are not provided cost <strong>of</strong> torch lights may be recovered from payment.4. Character verification and antecedentsThe Security Agency should get the character/antecedence <strong>of</strong> each SecurityGuards/Supervisor verified be<strong>for</strong>e he is engaged and he should be able to produce theverification report as and when required <strong>for</strong> any departmental inquiry <strong>of</strong> the organisationor police concerning each Security Guard/Supervisor who may be engaged by him.Page 7 <strong>of</strong> 19


5. Identity:The Security Guard/Supervisor who may be engaged by Security Agency from time totime must carry the photo identity card , which shall have to be issued to him <strong>for</strong> the saidpurpose by the Agency. The identity card should be worn by each <strong>security</strong>guard/supervisor on their uni<strong>for</strong>m which shall in turn give details regarding their fullname, age, identification marks, signatures <strong>of</strong> the bearer and also <strong>of</strong> the issuing authorityand seal. A duplicate copy <strong>of</strong> each identity card should be made available to the SecurityDepartment <strong>of</strong> DFPCL, in advance. Present and permanent addressees <strong>of</strong> all <strong>security</strong>personnel including <strong>security</strong> supervisor should be made available to the Job Coordinatorbe<strong>for</strong>e their deployment at DFPCL.6. Special Assignment:The Security Guard/Supervisor should carry out any specific task as may be assigned tothem by DFPCL from time to time in the interest <strong>of</strong> the <strong>security</strong> <strong>of</strong> the premises, anyunauthorized activity may be objected and should be brought to the notice <strong>of</strong> the higherauthorities in writing. Security Supervisor should collect in<strong>for</strong>mation on <strong>security</strong> mattersand brief Job Coordinator immediately depending upon gravity <strong>of</strong> the situation.7. For any matter requiring police complaint/assistance, prior permission should be takenfrom DFPCL.8. Liaison:A responsible person <strong>of</strong> the Agency should liaise on its behalf with Job Co-ordinator <strong>of</strong>DFPCL, frequently.9. Removal <strong>of</strong> Security Guards/Supervisor:The Security Agency shall remove/change/replace any Security Guard/Supervisor, if atany time found unsuitable or undesirable in the opinion <strong>of</strong> DFPCL, and shall makeimmediate alternative arrangement to provide substitution <strong>for</strong> carrying out his obligationsundertaken under this contract. Notwithstanding the above, he will periodically change theguards from our locations and also rotate them on their duty posts.10. Duty checking:The Security Agency's Guard would be liable to be checked by Job Co-ordinator and hisrepresentative and <strong>for</strong> this purpose he should maintain a Guard Check book/GuardsAttendance/Schedule Register. Security Agency guards should also be checked by itssupervisors, or any <strong>of</strong> its <strong>of</strong>ficials <strong>for</strong> their upkeep, alertness and alcoholism. As specialassignment, they have to carry out intelligence work by taking rounds as and when askedto do so.11. Liability:Loss or damage to any material/property either through theft or otherwise due toPage 8 <strong>of</strong> 19


negligence <strong>of</strong> its Security Guard/Supervisor shall be made good by Security Agency at itsown cost. The decision as to whether the loss or damage through the theft is attributabledue to negligence <strong>of</strong> its Security Staff shall solely rest with DFPCL , who shall have theright to require Security Agency to pay the costs <strong>of</strong> such missing/damagedmaterial/property and it shall make good without any demur or objection on receipt <strong>of</strong> awritten demand from DFPCL, as and when circumstances arises.Page 9 <strong>of</strong> 19


12. Assignment:The Security Agency shall not assign or transfer this contract or part there<strong>of</strong> to any one.13. Compliance <strong>of</strong> Labour Regulations:a) The Security Agency is required to comply with the provisions <strong>of</strong> the Contract Labour(Regulation and Abolition) Act 1970, which includes maintenance <strong>of</strong> Attendance Register,maintenance <strong>of</strong> Payment Register, etc. The Security Agency has to deposit the wages <strong>of</strong> itsemployees in any Nationalized Bank in the account <strong>of</strong> the employees, as per MSGB Act and tocomply with the provisions <strong>of</strong> ESI/PF, etc. He is required to produce copies <strong>of</strong> allchallans/<strong>document</strong>s <strong>of</strong> having deposited the amount, every month along with his monthly bill.b) The Security Agency shall be responsible <strong>for</strong> the payments to Security Guards/Supervisorsemployed <strong>for</strong> the per<strong>for</strong>mance or carrying out the said work and that IIG, Navi Mumbai, shall inno event be liable and he shall keep DFPCL, indemnified against the same and from allproceedings in respect there<strong>of</strong>. The payment to the employees <strong>of</strong> Security Agency towardswages, allowances should be made by A/c payee cheque .c) The Security Agency shall be responsible and shall pay all compensation to its employeespayable under the provisions <strong>of</strong> the workmen’s Compensation Act and amendments thereto. Heshall be responsible <strong>for</strong> and pay the expenses <strong>for</strong> providing medical treatment to its employeeswho may suffer any bodily injury during the course <strong>of</strong> their service as a result <strong>of</strong> any accident orotherwise while in the premises. The employees (Security Guards/Supervisor) shall be deemedto be his employees <strong>for</strong> the purpose <strong>of</strong> the Shops & Establishments Act (Maharashtra State),Payment <strong>of</strong> Wages Act, Minimum Wages Act and all other Labour Laws, Rules and Regulationsthere under. DFPCL, reserves the right to check the actual payment <strong>of</strong> the wages registermaintained by him and also the connected <strong>document</strong>s in respect <strong>of</strong> the above.d) The Security Agency shall duly introduce the Contributory Insurance Scheme <strong>for</strong> its employeesunder him, if so required by law as envisaged by the provisions <strong>of</strong> the Employees’ StateInsurance Act, 1948.e) The Security Agency shall duly introduce the provident fund scheme <strong>for</strong> its employees if sorequired by law as envisaged under the provisions <strong>of</strong> Employees’ Provident Fund. As theSecurity Agency should see that the recoveries <strong>of</strong> Provident Fund in respect <strong>of</strong> his employees aremade regularly from the wages <strong>of</strong> his employees as per the terms <strong>of</strong> the Provident FundAct/Scheme, and the same is deposited regularly with the concerned authority.f) The Security Agency shall observe and implement all the laws <strong>of</strong> the land and the rules framedthere under such as Workmen’s Compensation Act, Industrial Disputes Act, Minimum WagesAct, Factories Act and Central Labour Act. and that IIG, Navi Mumbai, shall in no event beliable or responsible <strong>for</strong> any default that will arise out <strong>of</strong> non observance <strong>of</strong> such laws/rules onhis part and that he shall indemnify and keep indemnified DFPCL against any damage and/orinjury caused to the premises, or to the properties.g) Any acquiescence or waiver by DFPCL, <strong>of</strong> any delay, breach or default committed by him shallnot be deemed to be or considered as estoppels against DFPCL, or prevent DFPCL, fromexercising any <strong>of</strong> its rights under any <strong>of</strong> the provisions mentioned in this <strong>document</strong>s.Page 10 <strong>of</strong> 19


14) The Contract is initially <strong>for</strong> a period <strong>of</strong> One year and may be extended <strong>for</strong> a further period<strong>of</strong> one year depending upon the per<strong>for</strong>mance and other related factors. During the validity period<strong>of</strong> the Contract, there shall be no revision <strong>of</strong> the compensation payable to the Security Agencyexcept wage revision <strong>of</strong> the Workers as may be notified by MSGB or any other appropriateauthorities. The Security Agency shall ensure that he pays the minimum wages in <strong>for</strong>ce and asprescribed by the competent authorities. The Security Agency is required to maintain all<strong>document</strong>s and records as required under the statutory laws and rules in <strong>for</strong>ce from time to time.15) Payment:Bills raised by the Security Agency will be paid to the Security Agency within 15 days from thedate <strong>of</strong> submitting the same with all relevant <strong>document</strong>s to the Job Coordinator. Security Agencywill maintain a Muster Roll to record the presence on duty <strong>of</strong> Security Guards and SecuritySupervisor <strong>for</strong> each shift <strong>of</strong> the duty. Payment <strong>of</strong> the bills will be as per the Muster Roll, whichshould be got countersigned every day by Job Coordinator or his representative <strong>of</strong> DFPCL.16) The Security Agency shall be responsible <strong>for</strong> providing the requisite man-hours as detailedabove on round the clock basis on all days. If the persons falling sick avails leave or remainsabsent arrangement <strong>for</strong> the substitute should be made immediately. If at any time additionalman-hours are required, the same will be provided by the Security Agency <strong>for</strong> which paymentwill be made on pro-rata basis.17) Interest free Security Deposit <strong>of</strong> Rs., 4, 00,000/- (Rupees Four Lakhs Only) or 10% <strong>of</strong> ordervalue (Net <strong>of</strong> Taxes) which ever is higher, should be kept with DFPCL.18) The Security Agency and its persons employed by him at DFPCL have no camping rightwhatsoever in the company's premises.19) The members <strong>of</strong> the Security staff provided by the Security Agency should be employees<strong>of</strong> the Security Agency and all disputes between the Security Agency and the <strong>security</strong> staff shallbe resolved by the Security Agency and shall have no bearing on DFPCL. The Security Agencyshould indemnify any claim, title indebt, cost, damage, compensation in respect <strong>of</strong> its employeesposted on DFPCL premises.20) Liquidity damages <strong>of</strong> 1% per day <strong>of</strong> the monthly service charges shall be levied to a maximum <strong>of</strong>20% in a month <strong>for</strong> any breach <strong>of</strong> contractual obligations by the Security Agency as stipulated inthe terms and conditions in addition to the obligation under any other provisions in the contractand the Law <strong>of</strong> the Land.21) Earnest Money Deposit <strong>of</strong> Rs..400,000/- (Rupees Four Lakhs only) drawn in favour <strong>of</strong> the"Deepak Fertilisers and Petrochemicals Corportion Ltd” to be submitted along with the TechnicalBid.22) Last date <strong>of</strong> receipt <strong>of</strong> duly sealed and superscripted "Technical <strong>Tender</strong> <strong>for</strong> SecurityServices" is 17.10.12. by 17.00 hours.Page 11 <strong>of</strong> 19


23) Termination <strong>of</strong> the Contract:a) DFPCL shall be at liberty at its entire discretion to terminate this contract <strong>for</strong>thwithupon or at any time a breach or default <strong>of</strong> any <strong>of</strong> the terms and conditions containedherein or any other circular and/or rules framed subsequently, is committed by himand/or by his Security Guards or Security Supervisors, employed by it.b) Insolvency or dissolution <strong>of</strong> the partnership firm or death or adjudication as insolvent<strong>of</strong> any partner <strong>of</strong> the Security Agency.c) Liquidation, whether voluntary or otherwise or passing <strong>of</strong> an effective resolution <strong>for</strong>winding up, if it is a company or co-operative society.d) If any attachment is levied and continues to be levied <strong>for</strong> a period <strong>of</strong> seven days uponSecurity Agency effects or any individual/ partner <strong>for</strong> the time being <strong>of</strong> its firm or anymember <strong>of</strong> its co operative society.e) If any partner <strong>of</strong> its firm or any member <strong>of</strong> its co-operative society shall be convicted<strong>of</strong> any criminal <strong>of</strong>fence.f) If Security Agency shall either by himself or by his servants commit or suffer to beCommitted any act which, in the opinion <strong>of</strong> DFPCL , whose decision in that behalf shallbe final is prejudicial to the interest or good name <strong>of</strong> the Institute.g) If the period <strong>of</strong> this contract lapses and the service is continued, it shall beDeemed to be an agreement to continue the service on month to month basis. In suchevent, either party must give one month’s notice <strong>for</strong> termination <strong>of</strong> the service if theychoose to discontinue.h) Violation <strong>of</strong> the provisions <strong>of</strong> Contract Labour (R & A) Act 1970, MSGB Act andother acts, rules schemes or notifications issued by the Appropriate Govt. from time totime, as applicable.I) On termination/expiry <strong>of</strong> the contract, the, Security Agency will immediatelyremove all its personnel from the premises <strong>of</strong> DFPCL.Penalty:I) If any person deployed on <strong>security</strong> duties found accepting bribe , Rs. 5,000/- will beimposed as penalty <strong>for</strong> each case.II) If any Security Guard/ Security Supervisor found sleeping, Rs.500/ will be imposed aspenalty in addition to deduction wages <strong>of</strong> that day <strong>for</strong> each case.III) If any post kept vacant, Rs. 500/- will be imposed as penalty <strong>for</strong> each case.IV) Deployment <strong>of</strong> manpower on overtime will not be permitted more than eight hours at astretch (I.e, eight hours plus eight hours). In case <strong>of</strong> extreme requirements, O.T. Will notbe payable by DFPCL. Over time duties should not exceeded beyond 10% per month.
