The public body conducting a public meeting shall ensure that at least one copy ofany requested notice and agenda for the meeting is continuously available for public reviewduring the entire 48-hour period preceding the meeting. Posting of the notice and agenda on awebsite that is maintained by the public body satisfies the requirement for continuous posting.If a notice or agenda is not continuously available for the full 48-hour period due to actionsoutside of the control of the public body, then that lack of availability does not invalidate anymeeting or action taken at a meeting.5 ILCS 120/2.02 ................................................................................ Public Act 97-922Creates the State Vehicle Use Act. Each State agency shall designate a vehicle use officer tomonitor the use of State-owned vehicles by that State agency. For cases in which a Stateemployee would otherwise use a State-owned vehicle but uses his or her own vehicle instead, aState agency may reimburse a State employee for automobile travel expenses in accordancewith the State Travel Regulations and Reimbursement Rates. Amends the Department ofCentral Management Services Law of the Civil Administrative Code of Illinois. Provides that theDepartment of Central Management Services shall distribute a spreadsheet or otherwise makedata entry available to each State agency to facilitate the collection of data for publishing onthe Department's website. Provides that each State agency shall be responsible for the validityand accuracy of the data provided. Provides that the Department shall, beginning on July 1,2013, make available to the public on its Internet website vehicle cost data and an annualvehicle breakeven analysis. Provides that the Department may not make any new motor vehiclepurchases until the Department sets forth procedures (rather than, promulgates rules to setforth procedures) to condition the purchase of new motor vehicles on (i) a determination ofneed based on a breakeven analysis, and (ii) a determination that no other available meanswould be more cost-effective to the State (rather than, on a determination of need based on abreakeven analysis only). Provides that the Department may purchase motor vehicles notmeeting or exceeding a breakeven analysis only if there is no alternative available to carry outagency work functions and the purchase is approved by the Manager of the Division of Vehiclesupon the receipt of a written explanation from the agency head of the operational needsjustifying the purchase.20 ILCS 405/405-280 ........................................................................ Public Act 97-1011Amends the Department of Natural Resources (Conservation) Law of the Civil AdministrativeCode of Illinois. Provides DNR shall have the authority to remove any individual or group ofindividuals engaging in illegal activities or disorderly conduct from any lands owned, leased, ormanaged by the Department and any lands that are dedicated as a nature preserve or bufferarea under the Illinois Natural Areas Preservation Act and deny future entry to the same by wayof revocation or suspension of access privileges. Provides that hearings on access privilegesshall be governed by administrative rule. Provides that the Department may assess a fee of upto $1,000 for the reinstatement of a suspended license, permit, registration, and otherprivileges that it administers in the exercise of its powers and duties under Illinois law.20 ILCS 805/805-518 new & 805-550 .............................................. Public Act 97-1020Amends the Department of Human Services Act. Provides that the Department of HumanServices shall prepare 2 reports on the impact of the new provisions of the Code of CriminalProcedure of 1963. Provides that a preliminary report shall be prepared and submitted to theGovernor and the <strong>General</strong> <strong>Assembly</strong> by November 1, <strong>2012</strong>. Provides that a final report shall beprepared and submitted to the Governor and the <strong>General</strong> <strong>Assembly</strong> by October 1, 2013. Eachreport shall be posted on the Department's website within a week of its submission. Providesthat each report shall discuss the number of admissions during the reporting period, any delayin admissions, the number of persons returned to the county under the new provisions of theCode of Criminal Procedure of 1963, and any issues the county sheriffs or other county officialsare having with the returns. Provides that each report shall include a recommendation from theDepartment of Human Services and one from an association representing Illinois sheriffswhether to continue the pilot study. Provides that if either report indicates that there areserious deleterious effects from the new provisions of the Code of Criminal Procedure of 1963or that the new provisions of the Code of Criminal Procedure of 1963 are not producingadequate results, the <strong>General</strong> <strong>Assembly</strong> may take necessary steps to eliminate the newprovisions prior to January 1, 2014. Amends the Code of Criminal Procedure of 1963. Providesthat whenever the court is sent a report from the supervisor of the defendant's treatment inwhich the treatment supervisor believes that the defendant has attained fitness, the treatmentprovider shall arrange with the court for the return of the defendant to the county jail beforethe 90 day period. Provides that the new provision is inoperative on and after January 1, 2014.20 ILCS 1305/1-60 new .................................................................... Public Act 97-873Amends the Department of Professional Regulation Law of the Civil Administrative Code ofIllinois. Provides that immediately after a licensed health care worker has been charged with(instead of after an Illinois State's Attorney files criminal charges alleging that a licensed healthcare worker committed) any offense that results in a certain specific sentence, then theprosecuting attorney (instead of a State's Attorney) shall provide notice to the Department ofFinancial and Professional Regulation of the health care worker's information and a copy of thecharges.20 ILCS 2105/2105-165 ......................................................................... Public Act 97-1040Amends Department of State Police Law. Training; Post-Traumatic Stress Disorder (PTSD). Provides that the fund is notsubject to sweeps or any other fiscal or budgetary maneuver from that fund into another Statefund. Amends the State Finance Act to add the State Police Merit Board Public Safety Fund as aspecial fund in the State treasury. Amends the Clerks of Courts Act. Provides that in addition toany other fines and costs, a person who is convicted of or pleads guilty to a violation of theCriminal Code of 1961, or of a similar provision of a local ordinance, or who is convicted of,5


pleads guilty to, or receives a disposition of court supervision for a violation of the IllinoisVehicle Code, or of a similar provision of a local ordinance, shall pay an additional fee of $15 tothe circuit court clerk. Provides that this fee shall not be considered a part of the fine forpurposes of any fine reduction for time served. Provides that 2.5% of the fee shall be retainedby the clerk to defray administrative costs. Provides that the clerk shall send the fees collectedunder this provision to the State Treasurer within 60 days after receipt for deposit into theState Police Merit Board Public Safety Fund.20 ILCS 2610/7.2, 30 ILCS 105/5.811 new & 705 ILCS 105/27.6 ..... Provides that an applicant for a Firearm Owner's Identification Card must bea resident of Illinois, except for a person who is employed as a law enforcement officer, anarmed security officer in Illinois, or by the United States Military permanently assigned inIllinois. Provides that if a person qualifies for a photograph exemption, in lieu of a photograph,the Firearm Owner's Identification Card shall contain a copy of the card holder's fingerprints.provides that whenever any person moves from the residence address named on his or hercard the person shall within 21 calendar days thereafter notify in a form and manner prescribedby the Department of State Police of his or her old and new residence addresses and the cardnumber held by him or her. Provides that any person whose legal name has changed from thename on the card that he or she has been previously issued must apply for a corrected cardwithin 30 calendar days after the change. Provides that the cost for a corrected card shall be $5which shall be deposited into the Firearm Owner's Notification Fund. Provides that it is grounds15


for the Department of State Police to deny an application for or to revoke and seize a FirearmOwner's Identification Card previously issued under the Act if the person is not a resident ofIllinois. Provides that the court shall not issue an order directing the Department of StatePolice to issue a Firearm Owner's Identification Card when the Card has been denied, revoked,or seized because of certain specified violations and the petitioner is otherwise prohibited fromobtaining, possessing, or using a firearm under federal law. Amends the Code of CriminalProcedure of 1963. In the statute that relates to the disposition of defendants sufferingdisabilities, provides that if the court imposes a sentence of imprisonment upon an offenderwho has a mental disability, the court shall direct the circuit court clerk to immediately notifythe Department of State Police, Firearm Owner's Identification (FOID) department, and shallforward a copy of the court order to the Department. Governor Amendatory VetoProposes to eliminate provisions of the bill that permit an active law enforcement officeremployed by a unit of local government to be eligible for and to retain a Firearm Owner'sIdentification Card if the officer has been a patient in a mental institution and as a result ofwork in law enforcement, is referred by the employing unit of local government for, orvoluntarily seeks, evaluation by a clinical psychologist, psychiatrist, or qualified examiner, andreceives care from a clinical psychologist, psychiatrist, or qualified examiner, so long as theofficer has not been involuntarily admitted as an inpatient in a mental institution or has notbeen an inpatient in a mental institution for more than 30 days. Proposes that an active lawenforcement officer employed by a unit of government which requires possession of a validFirearm Owner's Identification Card as a condition for employment who is covered by thisprovision but was not acting in a manner which was threatening to the officer, another person,or the public as determined by the treating clinical psychologist or physician, and as a result oftheir work is referred by the employer for or voluntarily seeks alcohol or mental healthtreatment may obtain relief from the Director of State Police. Proposes that nothing in theprovisions that deny eligibility for or permit revocation and seizure of a Firearm Owner'sIdentification Card of a person who has been a patient in a mental institution within the past 5years shall be interpreted to independently require or permit a unit of government, whichrequires the possession of a valid Firearm Owner's Identification Card as a condition ofemployment, to terminate, suspend, or place on leave without pay an officer from the time ofdenial, revocation, or seizure and while the officer's request for relief is pending. Proposes thatan active law enforcement officer employed by a unit of government, which requires thepossession of a valid Firearm Owner's Identification Card as a condition for employment, who iscovered by this provision but was not acting in a manner which was threatening to the officer,another person, or the public as determined by the treating clinical psychologist or physician,and as a result of the officer's work is referred by the employer for or voluntarily seeks: (1)alcohol abuse or dependence or alcohol-related depressive disorder evaluation or treatment bya licensed clinical psychologist, or physician licensed to practice medicine in all its branches; or(2) mental health evaluation or treatment, other than that for alcohol abuse or dependence oralcohol-related depressive disorder, by a licensed clinical psychologist, psychiatrist, or qualifiedexaminer, may obtain relief from the prohibition so long as the person has not receivedtreatment involuntarily at a mental institution, regardless of length of admission, or has notbeen voluntarily admitted to a mental institution for more than 30 days and not for more thanone incident within the past 5 years, and has not left such mental institution against medicaladvice. Proposes conditions under which the Director of the Department of State Police shallgrant expedited relief. Decreases until January 1, 2013 the required amount ofinsurance for certain vehicles to $25,000 for any one person in any one accident and $100,000for two or more persons in any one accident.
