Shannon Fiecke, Shakopee Valley News(5) M<strong>in</strong>utes:On a motion by Commissioner Ulrich, seconded by Commissioner Marschall, <strong>the</strong> M<strong>in</strong>utes <strong>of</strong>January 24, 2012 were approved unanimously.(6) Recognition <strong>of</strong> Interested Citizens:Jeffrey Will, Jordan, proposed <strong>the</strong> idea <strong>of</strong> develop<strong>in</strong>g 15 acres <strong>of</strong> <strong>County</strong>-owned propertylocated along Highway 169 <strong>in</strong> S<strong>and</strong> Creek Township as a trap shoot<strong>in</strong>g range. Mr. Will statedthat he is <strong>the</strong> head coach <strong>for</strong> <strong>the</strong> Jordan trap shoot<strong>in</strong>g team <strong>and</strong> he expressed <strong>the</strong> frustration all<strong>the</strong> teams have with <strong>the</strong> lack <strong>of</strong> available facilities. Mr. Will provided estimated costs, possiblefund<strong>in</strong>g sources <strong>and</strong> potential revenue estimates.(7) Consent Agenda:A. Commissioner Marschall moved, seconded by Commissioner Ulrich to authorize <strong>the</strong>extension <strong>of</strong> <strong>the</strong> Grant Agreement with <strong>the</strong> <strong>Board</strong> <strong>of</strong> Water <strong>and</strong> Soil Resources Fiscal Year 2010Competitive Grant Program – Project C10-30. <strong>The</strong> motion carried unanimously.B. Mr. Nelson expla<strong>in</strong>ed that when <strong>the</strong> orig<strong>in</strong>al <strong>Scott</strong> WMO Plan was approved <strong>in</strong> 2009 anumber <strong>of</strong> studies were underway <strong>and</strong> it was anticipated that amendments would be needed.<strong>The</strong> process <strong>for</strong> <strong>the</strong> Amendment from <strong>the</strong> time it is released <strong>for</strong> review until it is submitted to <strong>the</strong><strong>Board</strong> <strong>of</strong> Water <strong>and</strong> Soil Resources <strong>for</strong> consideration <strong>and</strong> approval <strong>and</strong> presented to <strong>the</strong> <strong>County</strong><strong>Board</strong> <strong>for</strong> f<strong>in</strong>al approval was outl<strong>in</strong>ed.Mr. Nelson reviewed <strong>the</strong> follow<strong>in</strong>g new capital projects which are be<strong>in</strong>g added to <strong>the</strong> <strong>Scott</strong>WMO Plan. PAGE 7February 7, 2012Commissioner Marschall moved, seconded to Commissioner Ulrich to authorize <strong>the</strong> release<strong>of</strong> <strong>the</strong> <strong>Scott</strong> Watershed Management Organization Plan Amendment #2 <strong>for</strong> <strong>the</strong> 60 day reviewperiod. <strong>The</strong> motion carried unanimously.(11) Assure Long Term Fiscal Stability:Commissioner Menden expressed his disapproval <strong>of</strong> <strong>the</strong> <strong>County</strong> policy that allows annualcontracts under $25,000 to be approved by <strong>the</strong> <strong>County</strong> Adm<strong>in</strong>istrator without hav<strong>in</strong>g to bepresented to <strong>the</strong> <strong>Board</strong> <strong>of</strong> <strong>Commissioners</strong>. Commissioner Menden stated that he would like thislimit lowered to $10,000. Commissioner Menden specifically mentioned his concern regard<strong>in</strong>g<strong>the</strong> contract with a lobbyist <strong>and</strong> <strong>the</strong> contract <strong>for</strong> a shed on <strong>the</strong> Doyle-Kennefick property.Commissioner Menden felt that <strong>the</strong> public <strong>and</strong> <strong>the</strong> <strong>Commissioners</strong> are f<strong>in</strong>d<strong>in</strong>g out aboutcontracts <strong>and</strong> projects after <strong>the</strong> fact. Commissioner Wagner agreed with CommissionerMenden <strong>and</strong> stated his displeasure with <strong>the</strong> lobbyist contract.<strong>Commissioners</strong> Ulrich <strong>and</strong> Marschall disputed Commissioner Menden’s claims stat<strong>in</strong>g that<strong>the</strong> shed at <strong>the</strong> Doyle-Kennefick had been discussed at several <strong>County</strong> <strong>Board</strong> meet<strong>in</strong>gs <strong>and</strong>that <strong>the</strong> lobbyist contract had been presented at <strong>the</strong> Chair/Vice Chair meet<strong>in</strong>g <strong>and</strong> <strong>the</strong> <strong>Scott</strong><strong>County</strong> Legislative Committee. Commissioner Ulrich provided examples <strong>of</strong> how <strong>Scott</strong> <strong>County</strong><strong>and</strong> cities have benefited from fund<strong>in</strong>g that has been received through <strong>the</strong> help <strong>of</strong> a lobbyist.Chair Wolf suggested that ra<strong>the</strong>r than chang<strong>in</strong>g <strong>the</strong> policy, if a Commissioner has an issueor question regard<strong>in</strong>g a specific contract, that contract could be brought be<strong>for</strong>e <strong>the</strong> <strong>Board</strong>regardless <strong>of</strong> <strong>the</strong> amount.Considerable discussion followed <strong>and</strong> Chair Wolf requested that this item be discussedfur<strong>the</strong>r <strong>in</strong> a <strong>County</strong> <strong>Board</strong> workshop.(12) Manage Challenges <strong>and</strong> Create Opportunities:Commissioner Menden questioned <strong>the</strong> h<strong>and</strong>l<strong>in</strong>g <strong>of</strong> a compla<strong>in</strong>t that has been filed aga<strong>in</strong>stan employee by ano<strong>the</strong>r employee. Commissioner Menden stated that he heard about itthrough <strong>the</strong> grapev<strong>in</strong>e <strong>and</strong> was not able to get a copy <strong>of</strong> <strong>the</strong> compla<strong>in</strong>t or any <strong>in</strong><strong>for</strong>mationregard<strong>in</strong>g it. Commissioner Menden stated that he does not want any <strong>Scott</strong> <strong>County</strong> employee,<strong>in</strong>clud<strong>in</strong>g Employee Relations, oversee<strong>in</strong>g or controll<strong>in</strong>g any part <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigation to ensurethat no one controls <strong>the</strong> outcome <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigation.Commissioner Menden moved, seconded by Commissioner Wagner to totally farm out <strong>the</strong><strong>in</strong>vestigation to ano<strong>the</strong>r <strong>County</strong> so that no one can say that we had someth<strong>in</strong>g to do with <strong>the</strong>outcome.Commissioner Ulrich requested <strong>in</strong><strong>for</strong>mation from Employee Relations Director Jack Kemme<strong>and</strong> <strong>County</strong> Attorney Pat Ciliberto regard<strong>in</strong>g this issue. Mr. Kemme expla<strong>in</strong>ed <strong>the</strong> processfollowed when an employee files a compla<strong>in</strong>t aga<strong>in</strong>st ano<strong>the</strong>r employee. He also stated that <strong>the</strong><strong>in</strong>vestigation has been outsourced <strong>and</strong> that <strong>the</strong> <strong>in</strong>vestigation is underway. Mr. Cilibertoexpla<strong>in</strong>ed that <strong>the</strong> Data Practices Act prohibits <strong>the</strong> release <strong>of</strong> <strong>in</strong><strong>for</strong>mation regard<strong>in</strong>g thiscompla<strong>in</strong>t. He also outl<strong>in</strong>ed <strong>the</strong> process that was used <strong>in</strong> choos<strong>in</strong>g <strong>the</strong> <strong>in</strong>vestigator. <strong>The</strong>established policy that will be followed once <strong>the</strong> <strong>in</strong>vestigation has been completed was alsoexpla<strong>in</strong>ed.
